In that you would need to submit a "Improvement patent" which takes inventive step out of the equation. I had email JN previously and he staed they were seeking a "NEW" patent vs a improvement patent.
If I am correct, I believe inventive step must also be part of the patent. Am I incorrect in that regard? I'm surely not a patent attorney..

SLTD does not need a patent!
The patent is not needed to find a MFG to build the MFG prototype and do field testing. They will be doing this step prior to launching the panel. This is where we will find out the power output of the panel and most likely cost to manufacture.
The patent is only needed at the point where they put the panel on the market and waiting for the other patent to expire is fine and dandy as it expires in August of next year I believe. Maybe someone can confirm that date...

Thoughts for the day
Anyhow, I only have a few moments so I will make this brief.
1. JN stated in a previous PR that they were in talks with two companies to build the MFG prototype and test.
2. JN stated in a previous PR that they hoped to have this completed by the end of december
3. JN just submitted the S3 offering for 50M
4. JN knows he cannot sell the offering at .18 and make any money.
5. JN knows he does not want to pay taxes on the offering on this quarter so the S3 will not likely be executed until the 1st quarter.
From these 5 things, use your own imagination to figure out what the next PR might be and when...

Should have checked my etrade instead of taking the quick route. Anyhow looking over the SEC documents, I honestly cannot find where it states a company with a cap of over 75 million is removed from the 1/3 rule. Do you have more info on that?

They have no control over when their shares are sold. A trust basically sells the shares for them at a time that the owner of the security has no clue about. Look back over previous posts regarding insider sales. They are using the proceeds right now to simply pay the executives a salary commensurate with others in their field at which otherwise they would not be able to have a person of JN's caliber running the company.
They can only sell 1/3 of their float SEC rules for an S3 filing... 74.5 million shares. to get 50 million, they need their PPS to be around .67

I have no idea, I guess it depends on events. I'm just saying that everyone is freaking acting like they are adding 250M to the float when they cannot do it. 74M is the max shares that can be offered. and do you think JN will sell 74M only to make 14 million? I doubt that.
74M shares X $.675 = 50M
That is how high the stock price must be for them to make 50M

Has any of the above made you scared? Are you scared of an S3 that will allow the company to solidify its bottom line and continue its growth? Please explain your fears. I have not sold because I am not scared and do not trade on emotion. Fear is emotion and you should never trade on emotion.
