I haven't been able to find the potential amount of damages specified by NLST. From SeekingAlpha link to 10K:
1. NSLT is seeking an exclusion order that directs U.S. Customs and Border Protection to stop allegedly infringing SK hynix RDIMM and LRDIMM products from entering the United States; and
2. NLST is seeking damages (did not specify). HOWEVER, they did state: Patents cover RDIMM/LRDIMM feat., which we believe are strategic product lines that together account for a significant portion of SK hynix's total rev. & profits.
2018 REV: $8.3 BILLION. PROFIT: $1.43B. Those are just 2018 numbers. This has the makings of a monster settlement. MONSTER.

I think you are correct with respect to timing (hence why I am jumping in and out). The only near term game changer would news of partnership or BO, though given the delicate nature of the relationship with the FDA, would it be prudent to announce something with another company prior to the near term meeting with the FDA?

Given we're just two months out from their next court date, I thought it made sense to flesh out, to the extent possible, best and worst case scenarios with the understanding the litigation won't end any time soon. However, if the German court were to deliver a decision favorable to CRMD, what are the #'S?
On January 16, 2015, we filed a complaint against TauroPharm GmbH and its managing directors in the District Court of Cologne, Germany. In the complaint, we allege violation of the German Unfair Competition Act by TauroPharm for the unauthorized use of its proprietary information obtained in confidence by TauroPharm. We allege that TauroPharm is improperly and unfairly using its proprietary information relating to the composition and manufacture of Neutrolin, in the manufacture and sale of TauroPharm’s products TauroLockTM, TauroLock-HEP100 and TauroLock-HEP500. We seek a cease and desist order against TauroPharm from continuing to manufacture and sell any product containing taurolidine (the active pharmaceutical ingredient (“API”) of Neutrolin) and citric acid in addition to possible other components, damages for any sales in the past and the removal of all such products from the market. An initial hearing in the District Court of Cologne, Germany was held on November 19, 2015 to consider our claims. The judge made no decision on the merits of our complaint. On January 14, 2016, the court issued an interim decision in the form of a court order outlining several issues of concern that relate primarily to court's interest in clarifying the facts and reviewing any and all available documentation, in particular with regard to the question which specific know-how was provided to TauroPharm by whom and when. We have prepared the requested reply and produced the respective documentation. TauroPharm has also filed another writ within the same deadline and both parties have filed further writs at the end of April setting out their respective argumentation in more detail. A further oral hearing in this matter was held on November 15, 2016. In this hearing, the court heard arguments from CorMedix and TauroPharm concerning the allegations of unfair competition. The court made no rulings from the bench, and indicated that it is prepared to further examine the underlying facts of our allegations. On March 7, 2017, the court issued another interim decision in the form of a court order outlining again several issues relating to the argumentation of both sides in the proceedings. In particular the court requested us to further specify our requests and to further substantiate in even more detail which know know-how was provided by Biolink to TauroPharm by whom and when. The court also raised the question whether the know-how provided at the time to TauroPharm could still be considered to be secret know-how or may have become public in the meantime. The court granted both sides the opportunity to reply to this court order and provide additional facts and evidence until May 15, 2017. Both parties have submitted further writs in this matter and the court had scheduled a further hearing for May 8, 2018. After having been rescheduled several times, the hearing is now scheduled to take place on November 20, 2018.
What does that mean? Did they give a PT? I have never heard of them.
With the investor conference next week, they purposefully buried this on a Friday afternoon.
While existing shareholders are rightfully excited about not having to delist and go OTC, courting new investors with that overhang wasn’t something they likely even want to bring up while trying to court new investors.
For the lack of a better term, while the news is good for us, it’s a flower in the attic for CRMD.
The conference is at The St. Regis on 5th ave (rooms start @ $1,400 a night). No heavyweight investor(s) wants to hear about how a company just dodged a bullet by not being delisted during a sales pitch, IMO.
Also, I can’t say I am tickled about their presentation time: 4:40 PM next Thursday (the last day of the conference) may not exactly be playing to a packed house.
Lastly, if CRMD isn’t already being nibbled on and this conference is indeed vital to the company, then we’re not nearly along far enough to entertain talk of partnership or buyout.
In a perfect world, we’ll get an 8K next Thursday disclosing material information about their flagship product that is going to be included in the presentation prior to the 4:40 PM presentation.
In the end, I think we might have one hell of a week and a pretty strong September. If CRMD can close the gap to $1.05 by EOM, I think we’re in for one hell of a Q4.

Under what circumstances would CRMD remain in compliance with the Exchange given share price has remained relatively constant? Has the ATM been the deciding factor?
Asked another way, is it possible there are factor(s) that we may not be privy, that would ensure compliance (e.g. details of possible partnership, etc.)?

CRMD has (I believe) the magic elixir, but getting from point A to point B is the $64,000 question.
We’re all familiar with the unknowns: will FDA require 2nd Phase 3; when is data unblinded; financing; go it alone, partnership, BO, etc.
To this end, I sold my entire position. It’s going to take a few months to get this sorted.
I did, however, pick up another 9 March ‘19 call options w/$2.50 strike.
In total, I’ve got 421 contracts and a countdown at 204 days (roughly 6 1/2 months) for CRMD get it sorted.
From an investment perspective, it’s a simple formula: they either get it done or they don’t. As you can see, I’m hedging the former.
Good luck and I’ll be cheering from the sidelines until they call in the big guns or I quietly weep over my St. Patrick’s Day pint.
