NEW YORK — The maker of the painkiller Vioxx Merck has agreed to pay $4.85 billion to settle thousands of lawsuits in one of the largest civil cases ever, according to published reports Friday.
The drugmaker faced about 26,600 lawsuits representing 47,000 plaintiffs, and about 265 potential class action cases filed by people or family members who claimed the drug proved fatal or injured its users.
The agreement could still collapse, though lawyers with knowledge of the deal said that was unlikely, the New York Times reported. The deal becomes binding only if 85 percent of all plaintiffs agree to drop their cases.
Merck could put the uncertainty of millions of dollars in possible settlements that have plagued pharmaceutical company behind it, though it has been successful fighting cases individually.
Analysts predicted early on that liability could reach $50 billion, but after losing its first case in a $253 million verdict, Merck has won a string of civil cases in numerous states.
The company said last month it had added $70 million to its reserves for defending lawsuits over the blockbuster painkiller that it pulled from the market three years ago. As of Sept. 30, Merck had reserved a total of $1.92 billion for legal expenses and spent a total of $1.2 billion.
Payments would vary, depending on injuries and the length of time that Vioxx was used.
"We
ve been asked by the judge to talk to the plaintiffs and we are talking to them," Kent Jarrell, a spokesman for Merck, told the New York Times. "Right now, there is no finalized agreement."
Two attorneys told the paper, however, confirmed it independently, the Times reported.
Merck still faces a number of government investigations, both state and federal.
Stocky for starters ask her why the PPS is tanking. I was under the impression they were on the verge of significant financing but now I am gravely concerned.

Chris if there is any "fortune" to be made here it won't be from the spin-off of DNAG Pharma. It will be from our existing shares of DNAG. Yes we'll get some table scraps but that's it. The serious money (hopefully) will result in our existing shares rising based on how profitable DNAG Pharma is, how much of the profits they will shift back into the "parent company" (us) and how much profitable growth Forensics, CD-59 and Ancestry does.
Stocky yes you are right. I didn't know thought now that is true with their drug production as well. Just one more massive market for DnaPrint!!! And for the technology in general.
China Recalls Tainted Leukemia Drugs

BEIJING — Chinese authorities ordered the recall of tainted leukemia drugs blamed for leg pains and other problems, state media reported Sunday, the latest crisis to strike the country's embattled food and drug industries.
Most of the drugs involved — methotrexate and cytarabin hydrochloride — have been recovered and authorities have traced the remainder, the Xinhua News Agency said. The report did not say if any of the drugs had been exported.
Authorities have banned the sale and distribution of the drugs, produced by the Shanghai Hualian Pharmaceutical Co., it said.
China, a major global supplier, has been facing growing international pressure to improve the quality of its exports after dangerous toxins — from lead to an antifreeze ingredient — were found in goods including toys and toothpaste.
China has been eager to cast itself as a victim, too, of unsafe imports. Xinhua on Saturday announced that inspectors recently found residue of the banned stimulant ractopamine in frozen pig kidneys imported from the United States and frozen pork spareribs from Canada. The names of the exporting companies were not identified. Ractopamine is forbidden for use as veterinary medicine in China.
Xinhua said the 18.37 tons of frozen pork kidneys and 24 tons of frozen pork had been returned to importers exporters, said the General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ).
Ractopamine, a hormone that promotes the growth of lean meat in pigs and cattle, is banned by China and most other countries as a health hazard, although its use in stock animals is permitted in the U.S. and Canada. China has also recently banned imports of U.S. meat contaminated with salmonella, additives, and veterinary drugs.
Xinhua said the State Food and Drug Administration and Health Ministry banned the two leukemia drugs after several child leukemia patients who were taking them complained of leg pains and difficulty walking. Xinhua said some patients also complained of urine retention.
It said the Health Ministry and drug administration had traced the problems with the drugs to their being tainted with vincristine sulfate, an anticancer drug. Xinhua said factories manufacturing the drugs had been closed.
China has taken a series of steps to crackdown on tainted drugs and other unsafe products, in part due to concern over the reputation of its exports.
In the harshest action so far, the country's former top drug regulator was executed in July for taking millions of dollars in bribes to approve substandard medicines, including an antibiotic that killed at least 10 people.
Well ladies & gentleman I listened to the interview as well. Not much intricate detail given but you can't cram alot into a 30 minute interview - but we did get important basics. I was satisfied with what I heard. Need bridge financing AND get the ball rolling with the SEC on the spin-off. 90% of companies in this position would have closed their doors by now. I think they're really trying and will succeed - just been a rocky road. Godspeed to DNAPrint!! Hopefully that good news soon.

Brian1933 you're dead on. I would like to see what kind of progress DNAG has made in this field in just the past 6 months. I think that all the dollars required for the pharma research has dragged forensics down a bit. That's why I have some hope for this spin-off of pharma in to it's own unit. I think their forensice would skyrocket and of course the share price. As usual time will tell. But I will say one thing...DNAG is still here after 7 years and so are we. Most companies under these circumstances would and have gone belly-up by now.

Yes Brian1993 I think that DNAG's Forensice technology will go even further than it does now. Remember they were/are involved in numerous high profile criminal cases and their science was a critical factor. And with Bin Laden re-surfacing & illegal immigration it will be all the more important to know genetic/racial evidence.
Stocky I agree there with you. We haven't heard much on Forensics but I have got to assume that has gotten stronger.
So Stocky you believe that DNAG (parent) will still retain significant control of any CD-59 spin-off?? That would mean much of the profits would cycle back into DNAG (parent). I am still trying to figure out the exact function of DNAG (parent)but I believe that Ancestry/Forensice will be very profitable and could support a S/P in the $20-$30 range. I am just hoping they don't do anything to the DNAG (parent) share structure which is where most our all of all holdings will be. Your thoughts??

Iwant2be all I want is the "truth" whatever that is. I can't get all excited about another interview. The past ones have all been a re-hash of old/existing information. Who knows...maybe this one is different...but I'm not loosing anymore hair over it.

Stocky I really do appreciate your optimism but I must admit I never expected the PPS to fall this low after the R/S ahwile back. I did purchase close to an additional 30,000 shares last week @ .0066 but....we need some substantial news quickly.
Stockboy that was kind of my contention. "Spinoff" is taking the place of R/S. DNAGPharma is where the big time bucks will be and DNAG will have Ancestry & Forensics which may boost our remaining DNAG shares or may not. I don't know what else the "parent company" would do. Would they eventually dissovle it?? I'm getting very concerned that the S/P is STILL declining with their supposed involvement with M2GEN. DNAG MUST do something (financing) and fast or we're screwed.
