I think it's total BS that World's might not succeed because of Alice 101 which was not even in place when World's submitted their original patent. One could argue if it was, World's patent filing would have included more detail in order to meet such requirements / thresholds. So the question I have for these judges is... So if World's didn't invent the technology that allows for today's massive multiplayer online role-playing games, then who did?
Heard that. Goods news is these judges seem to have read briefs and are prepared. Truth (and prior rulings / reversals) is on World's side here. Fingers (and toes) crossed that justice prevails today.
From previous post:
Here is a post from January 2018. All the cafc Judge talk happened at end of 2017 up until March 2018 if want to go back and look up all the info.
Well now actually Dyk, Mayer, Prost are the 3 to really avoid, Wallach is bad if paired with those.
Newman, Chen, Stoll and O'Malley are really good ones to have. Wallach tends to be good if paired with those.
Judges: Moore, Chen, Hughes
Sounds like a winning combo to me! :)
GLTA
Will we know judge panel today or tomorrow (day of appeal hearing)?
Thanks, not sure why I had March 4th on the brain, just anxious I guess to see whether justice prevails or I have another tax write-off this year :) Keeping the faith, good long to all longs.
Does anyone know whether Friday's appeal is just handing over paperwork or do both parties get to present their case, and if so, can the public listen in? Thanks in advance.
Haven't posted in quite a while, but I've read every post since the Casper 101 debacle (hope she loses her key to her crypto flash drive). Still have about 30% of my position, which I'll likely add to depending outcome of this Friday's appeal hearing. Thanks again for all your insights and good luck this week. I've been invested in WDDD ~6-7 years and at this point I'd say there's about 35-40% chance of success here (IMO).
Looks like they're shooting for a Mar/Apr appeals hearing date. Hopefully a date will get locked in and something will be announced shortly.
So is the remaining appeals process roughly as follows:
1) date for appeals hearing gets established
2) both sides get to explain their respective writeups
3) panel of judges make / announce their decision???
Thanks.
Anyone???
Now that World's has submitted their rebuttal, does anyone know next steps and timing for a decision? Thanks.
MRMD is doing very well and finally posting strong revenue and EBITDA numbers over last two quarters. Stock's up 88.40% year to date and about climb out from the penny stock ranks with Friday's $0.95 close on strong volume. Great turn around story (hopefully like World's post appeal).
Great post! Likely not a penny stock after next week. Is starting to break out again and folks are beginning to take notice after MRMD's second consecutive quarter with strong revenue growth and positive EBITDA. Will likely establish a new resistance level somewhere between $1.20 - $1.30 over the next 2-3 weeks.
Agree. Best hidden gem MJ MSO stock out there at present. Once we clear $1.00 volumes and pps should continue at pace and could see $2-3 range by 3Q. This stock continues to get greater visibility every day.
1Q21 financials are very solid and in line with full year guidance towards meeting or exceeding its full year targets of $100M in revenue and $33M total EBITDA. RSI approaching 70 and volumes up. Could be the breakthrough day many have been waiting for for this under the radar MSO.
I was reading MRMD's 10-Q that came out today pre their 1Q21 earnings to be announced tomorrow, and the attached below was included in the "notes" section. I'm posting it as many here have wondered whether or not World's still owns any MRMD shares.
Terminated Employment Agreement
An employment agreement which commenced in 2012 with Thomas Kidrin, the former CEO of the Company, which provided Mr. Kidrin with salary, car allowances, stock options, life insurance, and other employee benefits, was terminated by the Company in 2017. At March 31, 2021 and December 31, 2020, the Company maintained an accrual of approximately $1,043,000 for any amounts that may be owed under this agreement, although the Company contends that such agreement is not valid and no amount is due.
In July 2019, Mr. Kidrin, also a former director of the Company, filed a complaint in the Massachusetts Superior Court, which alleges the Company failed to pay all wages owed to him and breached the employment agreement, and requests multiple damages, attorney fees, costs, and interest. The Company has moved to dismiss certain counts of the complaint and has asserted counterclaims against Mr. Kidrin alleging breach of contract, breach of fiduciary duty, money had and received, and unjust enrichment. The Company believes that the allegations in the complaint are without merit and intends to vigorously defend this matter and prosecute its counterclaims.
While the Company’s motion to dismiss was pending, the parties reached a settlement in principle and the court has issued a nisi order of dismissal. The parties have not yet competed the settlement agreement. If the parties are for any reason unable to do so, then the Company will continue vigorously to defend this matter and prosecute its counterclaims
Hopefully Linden court approval of settlement and/or press announcement comes today. I believe the financial strength of Linden settlement will depend on timing of when final agreement and signatures occurred (pre or post 101 decision). I struggle with why Linden would still agree to sign post 101, so if settlement was reached and signed pre 101, then the question for me is whether Linden has any recourse to back out of the deal (looks like no thus far). If it was executed post 101, then I applaud World's legal team on their strategy to accomplish.
Agree. Financials in 1 week, which should be positive and hopefully signal MRMD is on track to exceed their annual projections put forth last month. On another quarter of strong financials, I fully expect stock to push through $0.90 which has been key resistance level as of late.
I like that as a possibility but only if Linden already settled, otherwise I'm not seeing why MS would entertain at this point. That said, I was surprised by the "stay". Hopefully the Linden settlement question gets answered Monday.
Great news! They're likely itching to prove that their full year revenue and EBITDA guidance projections were conservative and not a fluke. I don't see any reason why this wouldn't be their best quarter yet, now that they're running on all cylinders. Will be nice to see them get back over a dollar pps soon.
What I'm having a difficult time getting my head around is why a patent can be invalidated (wouldn't the 101 process/test have been applied to obtain the patents in the first place)? I can understand an argument that a different process or methodology was used, which supports why one's technology doesn't conflict with an existing patent, but it almost sounds like Casper's saying that World's 1995 patents are no longer patents at all.
Too much still up in the air to totally cut losses on Monday with MSFT, Linden and World's appeal strategy still open. I assume most will trim to a point on Monday based on their average pps cost basis and then hold for further news on the aforementioned items. I expecting teens on Monday, but wouldn't be surprised if we see single digits. GLTA
I agree with you regarding Susman indicator. My guess is they will ride out these open cases to conclusion and not take on anything new until these are fully resolved. I'm not sure how timing stacks up here, but folks were wondering why now with MSFT, so I'm curious if 101 decision was already in limbo and had Susman and Thom concerned, which is why they possible decided to open MSFT in Texas (again, not sure on timing but would make sense in hindsight if timing lines up).
I'm in the same boat, selling under $.05 is like losing it all anyway, so might as well just wait it out another 10 years :) Regarding Linden, I believe it was a 30-day court stay vs extension. Perhaps Linden always wished to settle but until World's sensed something was up with Casper, World's then agree to settle to force Casper's hand on 101. Would be great if the Linden settlement was signed and just not announced (that would make for an interesting Monday) but I'm not holding my breath. I do hold out hope with Microsoft in patent friendly Texas as I believe this is why they went there in the first place to avoid another Activision scenario. Yes this does smell funny, but hopefully justice will prevail and Casper will lose her bitcoin password in time.
22 days into the "30 day stay" jointly requested by Linden and Worlds. Hopefully we'll see something today or tomorrow as May 10th is approaching fast and I don't see World's agreeing to extend (shows too much weakness).
IMO - I believe the Linden settlement will include cash plus some form of forward licensing revenue perhaps for an undisclosed period of time (if allowed). If it does happen to be cash only, I think it will be North of $10M. Hopefully we'll all know soon...
Sounds like it's time to load up on more LEVI stock as 501's are about to make a come back!
Does this most recent Microsoft PACER document/schedule find mean that the Microsoft IPR issue has been resolved or is that still an open issue/concern?
Hey buylosellhi, not sure if you're still invested in or following WDDD but World's and Linden Labs have just reach a settlement agreement in principle to be announced on or before May 10th.
I will, but likely closer to the May 10th date referenced, which will signal to me that settlement talks have not broken down and that the agreement in principle will be solidified and announced publicly (hopefully with some level of transparency).
yes, thanks.
Agree. Chart fundamentals still look great with consolidation and $0.70 resistance levels having been established and holding nicely. Patience to longs the breakout will come soon.
MRMD typically announces their upcoming earnings calls a week in advance, so I would expect that announcement to come through by mid next week at the very latest. Hopefully we won't need to wait that long and we'll see something before Friday.
For those interested in facts vs speculation, World's has posted its Narrowing of Claims court document submission. If someone with PACER access wouldn't mind posting that would be appreciated. Thanks in advance.
Agree and positive sign as it relates to upcoming earnings as I'm sure Hadron got a good look under MRMD's hood prior to agreeing to this new SPA.
To the extent Worlds still owns shares of MRMD, yesterday after hours they announced the following related to securing new financing.
NORWOOD, Mass., March 2, 2021 /CNW/ - MariMed, Inc. (OTCQX: MRMD) (the "Company" or "MariMed"), a leading multi-state cannabis operator focused on health and wellness, today announced the closing of a $46 million financing facility with Hadron Healthcare Fund ("Hadron") pursuant to the terms of a Securities Purchase Agreement ("SPA").Today's initial funding of $23 million, will be used to repay substantially all of the Company's long-term debt other than mortgage-backed loans as well as to upgrade and expand MariMed's owned and managed cannabis facilities. The balance of the committed funds will be available for MariMed to continue executing on its strategic plan and complete the consolidation of other state cannabis businesses into MariMed.
I can't recall who mentioned this prior, but wasn't Friday or today an important milestone date regarding World's filing against Microsoft?
Hey buylosellhi, As a fellow MRMD investor (and former WDDD investor) was curious whether you've also heard of or are investing in CHOOM out of Canada. I see them as similar to MRMD in the states, with around the same number of retail sites up and running, high growth potential and strong management teams.
