The problem we have is the Chapter 7 filling in the US. If we can avert that and have the company emerge from Chapter 11 maybe there's hope. Just my thought.

mogul1...If twisting the facts means calling a spade a spade then so be it. I refuse to let any one pull a wool over me eyes. Robert Swift is just a symptom of Dr. Pandey's lack of judgement in signing an agreement with Basu. If you invite a burglar into your home, you can't blame him for stealing your belongings.
I maintain my assertion that Dr. Pandey should be held accountable for setting in motion the destruction of Xechem International. As CEO of a publicly held company, he had a duty to create value and protect shareholders' interest yet he knowingly signed an agreement with a Hedge Fund that eventually destroyed the company then abandoned shareholders.
The fact that he was the CEO of XI while working on the diabetes drug makes it a conflict of interest relationship. That's why he should be investigated to determine whether XI funds, especially the Basu funds were diverted into the diabetes drug research since there were no Audited Financial Statements filed during this period.
My targets for an investigation are Ramesh Pandey and Robert Swift. If they can help avert Chapter 7, reorganize and do what's right by shareholders, we can all put this to rest.
"His" diabetes project should have been developed under Xechem International. He should be investigated to see where he got the money to develop his diabetes project from. Xechem International was stripped of everything, litigated and abandoned by him. Unless this company turns around, he should be jailed for fraud.

Good question Larry. I think we should start by asking Lane for direction since he has all the facts. He may know a firm that can help us. Let's get out an email to him
It's not too late to file a CAL. We believed Swift when he said he was going to restructure the company's debt and emerge from bankruptcy. We gave him a chance only to learn that he absconded with the company's IP and started his own company producing a copy of the company's drug without informing shareholders. He sold 5-HMF and pocketed the proceeds without telling shareholders about how the funds were spent. We also know that $7 million of private equity funds was received by Dr. Pandey and shareholders were not formally informed about how these funds were spent.
We are waiting for the outcome of the bk proceedings. If the verdict is not in our interest, we'll start a CAL.
We may have to file a class action lawsuit against AesRX, Cosmid, Swift, Burg and Pandey. This option is open. That's our Plan "B".
In what ways are XKEM shareholders going to benefit from this? Please explain.
