So a positive EPS .. how much of it attributable to the new tax benefits? Overall, everything looks better, but perhaps I should read closer.

My own opinion, based on some insiders buying shares( last I checked several weeks ago) and human nature is that they not only dislike the share price plunge for obvious financial reasons, but because it is very embarrassing. Perhaps they're focusing more on that rather than other things they've done in the past. Industry embarrassment is likely embarrassing. They're no longer freshmen.
I started buying back based on those preliminary numbers. I've been gone a while. Hope you don't mind a few questions. Anyone think they may make a penny or more + next ER?

The first issue can be resolved with a little more time. Not so sure about the second issue.

That's what I had up until the last s3cond of after hours, but then I think someone dumped 4500 shares at market knocking it back to $1.13. Some places reflected this, others didn't. See what happens tomorrow.
Never saw closing price so inconsistent.TD has 1.13, another has 1.26 another 1.24. Perhaps irrelevant in the grand scheme of things, but it will matter if trying to get in again under 1.20 early tomorrow. I think there's a relentless and reckless short infesting the trading. Looks like someone dumped shares right at the last second of after hours to bust stops. I guess it's suppose to discourage early morning buyers. Probably a resident short with shares tucked away.
I obviously did a very small sample at one store, and the diet wasn't included in her scan. Additionally, it was towards the beginning of their role out=people just seeing it in there. I know of a small upscale grocery/boutique store in andover,ma where it sells 2 cases a week. I don't drink it, but I always figured it was geared towards above average income people because it's a mixer. Not necessarily for everyday walmart shoppers. Not sure about the demographic thing

I grabbed a 6 pack of the regular ginger beer and asked one of the managers how much they have been selling.she had a hand scanner. It averaged out to 4 six packs a week (case) for the previous 6 weeks.dont know how much diet was sold. I tried getting a few people on the stock twits board to do the same thing. Think what an average of say,1.5 cases a week from each walmart adds up to. It's a lot.

Is this volume FAR from being indicative of an OS count of 3 billion as most people who DON'T own shares suggest?
26 sports teams and they were paying the Mets $300,000 for a particular time span.
Let'[s assume this is one of the higher fees because of the big market, and the rest of the 25 teams average between $125,000 and $250,000 ...That's a lot of money.
I know some people will claim they sold shares to get this moeny, but most sane people know better.
Where did it say there's a "likely revocation" or that the SEC action will be anything more than what SEVERAL other company execs have experienced?
I think it's great that longs are taking comfort in the products, because they apparently sell..and you apparently believe it also, or you wouldn't be out here 14 hours a day trying to convince complete strangers otherwise.

I think management's assertion of the existence of a large NSS has been talked about at length and many longs have offered evidence to back them up...
One item helping to prove the existence of a large NSS is the continued presence of people like yourself, who have "no position" here or anywehere else.

What's the general consensus of people who actually own this stock regarding the current OS?
I know some people are insisting it's at 722 million because Pike seems to be basing on that figure, but isn;t it unlikely that it(OS) would NOT have changed since the last filing?
Mr Panther, can you point out another P&D that has come remotely close to doing the same things as SPNG as far as carrying on a charade, post Enron? Particularly one that is under investigation already where such a charade wouldn;t even matter?

This is perplexing..If this company was "all done" like many of the people who post out here suggest, why did they bother to get into another partnership?

Why so few shares traded for a company with supposedly 3 billion shares outstanding?
This seems quite unusual particularly since many of the same people who said there were 3 billion OS, are the same people who said this would be at .000001 by now..

When speaking of companies that exist or don;t exist, wasn't Sperenza, who Kaja Whitehouse admittedly said had "no connection" to the company, the individual who supplied these "non existent" contacts to Whitehouse?
Since some people consider her articles factual enough to build a civil suit and hurl other accusations, why haven;t these same people "explored" the following.
Why would the company supply their customer contact numbers to a tabloid? From what I understand, IT"S JUST NOT DONE.
Either the company had a "flim-flam" man supply the tabloid with this fake information, or they didn't. I doubt it and the company has already vehemently denied everything in the tabloid.
So if the company didn;t use the "flim-flam" man, who did?
It sounds more likely that one of the dozens of "nay-sayers" had the flim-flam man create the fake sites, then say the company hired the flim-flam man.
This is a far more likely scenario, particularly considering all the "man hours" the naysayers spend out here on message boards, creating blogs, on conference calls for longs(last night) ...all in the name of "saving people."
I think we'll see that Spernza was hired by shorts to create the fake sites..Then they were passed along to the Post in the name of the company.
Question regarding the civil suit...I find it unsual that the suit mentions "improperly forged opinion letters of counsel"
As this topic has been mentioned countless times by people claiming NOT to own the stock, and these same documents appeared to be created by an 8-year-old, might it be feasible to conclude that the basis of the lawsuit is a fabrication by individuals who have "no position?"
I would like the opinion of "longs," but since there doesn't appear to be any remaining on this board, opinions from people who spend countless hours out here after claiming they have "no position," and that they are here to "gloat," are always welcomed even though their opinions are based in lies.

Is the volume of the last few days more consistent with what longs have been saying?
Which is, the outstanding shares are around 500 million and the naked shorts artificially inflated the volume..
Seems like since the investigation became public, (except for panic selling Monday) the volume has been relatively LOW.
Does anyone think the naked shorts have been "rattled" by the investigation?

I did ask about the A/S shares of 3 billion. Here is what they answered: We would like to thank you as a shareholder of SPNGE.OB. To answer your question regarding the increase in the A/S. The increase is due to the previous announcement of the 1:100 R/S. When SPNGE "the company" proceeds with the R/S plans, the A/S will reflect the split
accordingly, so shareholders will not see the shares actually increasing as authorized. The O/S shares still stands the same as the end of the previous fiscal year according to our most recent information.
I asked them about the SEC investigation, and that's their answer. We appreciate clearing any doubts you might have as a SPNGE.OB shareholder. The company restated the facts regarding their business operations on 09/25/2009. We can't comment in details regarding the nature of the SEC filling, but since SPNGE.OB "the company" is a SEC reporting company, it is required to disclose any formal request it
might receive from the SEC on its behalf or on behalf of any of its business affiliates. The nature of the SEC filling is arising due to the company's previous accounting firm's troubles with the PCAOB. When the re-audited schedule 10-K will be released within few days, it will

There has been increasing speculation about a buyout, and a little chat about this going private..I don;t doubt either possibility.
My question is this...I KNOW a buyout would be the better scenario, but what kind of premium do shareholders usually get when something is taken private? Roughly the same? Lots less?
Like many of us have noted, they are the ones buying now.

Them not saying anything about cancelling it doesn;t necessarily mean anything. They might not update their plans until the last minute
