Here is more info why it tanked on earnings a few days ago:
LOCM Local.com: In-line Q3 results; about to enter a critical stage of its evolution - Merriman (5.08 )
Merriman notes CUTR reported in-line 3Q07 including $5.6 mln in rev, ($2.0 mln) in adjusted EBITDA and ($0.14) in adjusted EPS. After building out its infrastructure, search technology and site traffic to about 30 mln monthly visitors, firm believes LOCM is about to enter a critical stage of its evolution - the building of direct advertiser acquisition channels. The co will embark on a rapid ramp of telesales, likely outsourced, to acquire tens of thousands of local advertisers who will be listed in LOCM's search results. Based on the results of some of its peers, they believe that Local.com's strategy is very plausible, and even with very conservative assumptions, they arrive at very attractive growth and profitability projections exiting 2008.
Financial Guidance and Balance Sheet:
The company expects fourth quarter 2007 revenue of between $5.7 million and $5.9 million, the mid-range of which is a 3% increase over the third quarter 2007. We expect the mid-range of local search revenue to be approximately $5.4 million, an increase of 8% over the third quarter 2007. The company expects net loss for the fourth quarter 2007 to be between $2.4 million and $2.6 million, or $0.17 - $0.18 per share, which includes non-cash expenses of $0.9 million or $0.06 per share. The loss per share forecast assumes 14.2 million weighted average shares outstanding.
The non-cash expenses of $0.9 million consist of stock based expense of $328,000; and depreciation and amortization of $588,000.
On September 30, 2007, the Company had $18.1 million in cash and marketable securities and no debt.

PTSC did broke some serious resistences, now it is a buy on dips.
I've been watching LOCM and waiting (to fill the gap), tried to go short on it many days ago, but no shares to borrow, finally, that gap is filled yesterday.
I think it could bounce from higher $3s for at least 20%. I will put a bid right at yesterday's close, if it finishes in green today, we know it is bottomed. On the similar TA setting, it went from $4s to $8 in two months timeframe.
I bought a few other new pennies Friday, hope they're lottery ticks (IHGR 0.0002, NAWL 0.0003).
Should have checked the earnings schedule yesterday, knew NTWK always had good earnings and run up on earnings.

Same case (litigation). You may be thinking of the Patent Office review of the various patents. Requested by the current defendants and is "ongoing." USPO can take up to two years + (from what I understand). No way Judge Ward waits on that outcome. BTW, the recent MO of the USPO is to use much of the info from the Markman Ruling. Which by the way was highly favorable to TPL/PTSC.

What about the other case - the group who questioned the validity of PTSC's patent and the court accepted the case. The stock price took a dive on that news and has never bounced.

RE: PTSC ... speculation at this point.
1) The court case ... waiting on Judge Ward's ruling on ACP (attorney client privilege) -- TPL opposing. It's way overdue.
2) Meanwhile Philips licensed the MMP. Some evidence shows Toshiba and Philips tied together. Philips reported in a past Q (over a year ago, I think) they refused an offer to settle with TPL for 22 mil ... guesses are 20 mil would be a minimum, and that it could be substantially more "if" they suspect a big settlement by the J's is close.
3) A previous Pacer declared request for name change to the court case number (remove the defendants who have already settled from future DOC titles.
4) Yesterday Pacer revealed a retraction of the motion for name change ... why?
5) Yesterday Pacer reported motion for a 30 day stay of the case (apparently not yet signed by JW).
6) Last time in Toshiba case they settled after a 45 day stay of that case ... forgot with who ...
7) If JW rules in TPL/PTSC favor re: ACP (Higgins/Shaw) logic is TPL will file for Summary judgment based upon the previous Markman ruling which highly favored TPL/PTSC.
(There was to be mediation going on last month, but w/o the ACP motion answered it appears the mediation hit a wall or has been postponed until the ruling is made)
8) With the Holiday season fastly approaching, the lawyers won't want to be all tied up with case prep for the Trial scheduled for early January.
Bit's /n Pieces that some have put together speculating a settlement is in the works.

What are the causes of the move on PTSC today? It was a fast move from 0.41 to 0.49 with no news.
Bught some HKBV (0.007 to 0.0075), this is not a Chinese company, but I really like their numbers. Very few subpenny companies are making $491K in a quarter.

SDS broke the downtrend line, MACD is green:
QID - about to break the downtrend line, MACD is heading to green, nice bottom, possible the same type of formation like July-August:
Just like each year around this time, the market is going to tank starting this week until the end of Oct. Play carefully and be very selective.
I've put most of my $ into SDS (UltraShort S&P500 ProShares) and QID (Ultrashort UltraShort QQQ). I will play some hot running stocks or OTC/pink stocks once in a while, but would stay away from long big board stocks as much as I can.

GTEC broke some major supports, don't like the chart at this point, esp the past two candles. I sold the shares I bought yesterday at a loss at the open. Now I am waiting on the sideline, will wait until ABLE and BRGE finish their selling. Both MMs are dumping huge, don't want them to bite me again.
