the main things I care about are voiding of the nws with SPS cancellation ... and the real wild card ... allowing pending suits to proceed ... which i believe are the only real leverage against the warrants (assuming scotus does not address them)

Predictions about an early opinion missed the mark ... and apparently so have predictions of a pps run up beforehand ... thank goodness its a lot easier to predict the outcome ...

HERA said "may conserve" ... and (paraphrasing another poster's excerpt) "and the conservator may do what is in the best interest of the organization or agency (FHFA)" ... yes, such an interpretation would fly against common sense and endless precedent, but a bunch of en banc judges did just that
I suppose that is possible ... though I'm not sure why they would wade into any one particular issue ... as that might not solve any particular legal principle (for cause termination, anti-injunction, etc.) ... it might also cause unintended contradictions ... and I realize my scenario is worse case, but the en banc dissenters keep me up at night ...
the supremes ruled today that, even though previously harsh sentencing standards have been lowered dramatically for small drug possessions, those previously given long sentences cannot get their sentences reduced using current guidelines ... why? ... because that's not the way the law was written when they were convicted ... and congress needs to amend the laws used for such convictions before relief can be sought ... I still worry that we are going to hear something similar ... i.e., sorry, too bad too sad plaintiffs ... if you want relief, get congress to change HERA ... or file a suit challenging its constitutionally ... yeah, scotus might just use a bulldozer ... but it may be to deny us any relief ... lamberth told us HERA was the problem ... and no one listened

I have waited almost 13 years for justice ... I am anxious to learn if the rule of law really matters ... or if our own government is free to financially plunder its own citizens ... on a massive scale ... in broad daylight ... this was a set up from the day HERA was drafted ... and truly pathetic that so many en banc judges ruled for the thieves ...

I have read in detail all of the major rulings and most other filings/motions in between ... I have never found anything that convinces me that the gov't is right ... never ... yet here we are ... and that, tragically, is indisputable ... and, fwiw, I am one who believes that it is HERA that is the core problem ... with too many cases where judges have used insanely contorted logic to justify their rulings ... clearly the cship itself was a complete frame job with the concrete life preserver as an accomplice ... and when the victim started to regain consciousness, the death spiral assassin was sent in ... all done in broad daylight ... so far, this has had very little to do with long established precedent, the truth and, least of all, fairness ... and when the crimes are so extreme in their brazenness and scope then, yes, I do expect that decisions for the plaintiff should be unanimous ... but we clearly do not live in that world ... and I fear scotus will have a toaster returned to us after our house has been stolen ... many thanks for all of you extensive research and highly balanced posts ... and good luck to us all
just two reasons ... one, because en banc was not unamious ... and two, judge lamberth really did tell plaintiffs to look at HERA itself, not the FHFA (I'll never find the quote but I am 99.99% sure that's what he said) ... btw and just so you know, I agree that scotus SHOULD be unanimous in retroactively voiding the nws ... aside from the bs language in HERA, this has got to be the largest taking under the 5th ever
that could also be viewed as scotus supporting gov't overreach by allowing the gov't to exceed what should be common sense limits on gov't activities (i.e., like using gov't property AND private data for personal use) ... but since the policy didn't specifically preclude unauthorized personal use, its ok? ... hmmm, does HERA specifically exclude stealing from private companies? ... nope .... does HERA specifically make conservation of assets optional ... yep (the infamous "may") ... did scotus just lay the groundwork to reject the en banc decision and accept the nws? ...
maybe ... the odds could be low ... but doubt they are zero

totally agree with you ... but, sadly, this was the first time I thought he might be right ... didn't even one of the justices (Roberts?) lament that a full ruling in plaintiff's favor would be a heavy load for the gov't ... like stealing hundreds of billions from us was less of a concern?

while ROLG is just one opinion, I think he captures much of why we're sitting here at 2 and change ... SCOTUS might protect the gov't over the integrity of the rule of law ... and even the well being of its own citizens ... because, god forbid, it might be inconvenient for the gov't to fairly compensate the victims ... no wonder the US is ranked 20th in quality of life ... long live WS and the TBTF masters of the universe!

yeah, retail investors like Bill Ackman would never take a flyer on two unprofitable companies struggling to gain market share sitting on the cusp of scotus decisions that could totally change the trajectory ... what was I thinking? ... lol ... who the heck knows either way, but I do try to consider all possibilities

yes, the bull's thesis is not at all shared by the market which seems to remember that we got to scotus by the skin of our teeth ... and that scotus can issue too bad/too sad decisions whenever it wants ... and may be inclined to do so here in deference to the gov't ... just ask Richard Epstein, a brilliant attorney aligned with the plaintiff's and extremely confident a gross taking had occurred ... yet he has been proven wrong by the courts in all most every instance ... I do hope we get a favorable ruling ... but won't at all be surprised if we don't ...
Of course the cases are different ... the point was that the court felt retrospective relief was not necessary - even when human lives were at stake ... will be truly revealing if they think money is more important than a life ... ps I moved on from draw by numbers ... now in the advanced paint by numbers class ... but something is not right ... should I be using different colors? ... tia for any guidance
