Shocking laziness among some judges is forcing authorities to consider putting candidates on probation before being confirmed to the Bench, Chief Justice Godfrey Chidyausiku has said.
Opening the 2015 Legal Year, the Chief Justice exposed how some High Court judges are sleeping on the job, saying such a lethargic approach to work could force judicial authorities to tighten recruitment measures.
Currently, candidates who are shortlisted by the Judicial Service Commission after public interviews and subsequently endorsed by the President are immediately confirmed to the Bench.
Zimbabwe’s Constitution provides for a rigorous procedure before removing a judge from office in a bid to promote and protect independence of the Judiciary. Chief Justice Chidyausiku, however, said there could be need for a relook at the procedure.
“Constitutional provisions that protect judges from removal from office, while necessary to safeguard the independence of judges, should not be a cloak behind which to hide inefficiency and underperformance by judicial officers. In future, it may be necessary to appoint all judges on probation before confirming their appointments in accordance with the Constitution,” he said.
Chief Justice Godfrey Chidyausiku said conditions of service for judicial officers are still pathetic, but warned he will not tolerate officers seeking to use meagre remuneration as an excuse for poor performance.
He exposed how, despite similar conditions, some judges were playing truant while others slaved to produce quality judgments. Justice Nicholas Mathonsi was named as the High Court’s best performer with an “impressive” 72 judgments. Other top performers named by Chief Justice Chidyausiku are Justices Moyo, Chigumba and Matanda–Moyo and Charles Hungwe.
“His industry is revealed in its true dimensions if it is compared to the output of the least performing four judges, who had 2, 3, 6 and 11 judgments respectively for the whole year. The four of them wrote and delivered 33 judgments in all for the year 2014, less than half what Justice Mathonsi handed down,” said Chief Justice Chidyausiku, in reference to Justice Mathonsi adding: “The four Justices and Justice Mathonsi operate in the same environment and are subject to the same limited and unattractive conditions of service. As head of the Judiciary I will accept no explanation that will seek to justify such low output as compared to what is possible within the same constraints.”
“The message that I wish to convey in simple terms is this: The reality of the situation in Zimbabwe is that resources are limited. This is likely to remain so for a while. We should not simply throw up our hands into the air in despair. We should make the best of the unfortunate situation, namely to use the limited resources at our disposal to make our lives as Zimbabweans better.
“The magistrates have shown us the way by reducing their backlog from 49 000 to 2 000. They have demonstrated what can be achieved despite limited resources. All it takes is a change of attitude towards work and an application of one’s self to the best of one’s ability,” said Chief Justice Chidyausiku.
“Allow me to express my disquiet over the conditions of service of all judicial officers. Our magistrates and judges and all those who support them need to be adequately remunerated. This is not only desirable but the Constitution provides for that.
“I am on record as saying that a judicial officer who is not appropriately housed and has no reliable transport to and from court is most vulnerable and liable to be compromised. I am still of the same view and plead with the powers that be to assist us to curb corruption in the justice delivery chain by improving on the conditions of service for all judges, magistrates, the police, prisons officers and prosecutors alike,” he said.
“While I believe that judicial officers are entitled to decent conditions of service and must demand these as of right, I equally believe that judicial officers must earn their conditions of service,” said Chief Justice Chidyausiku.

Zimbabwe’s three higher courts are saddled with a 14 576 case backlog from the 2014 legal year, most such cases being from the High Court where some judges were criticised for laziness by Chief Justice Godfrey Chidyausiku on Monday.
The High Court’s civil and criminal divisions for both Harare and Bulawayo brought forward 14 270 cases — including appeals from the magistrates courts — into 2015.
The Supreme Court’s backlog is at 187 cases, while the Constitutional Court has the least pending cases at 119.
The three courts had a combined 35 695 cases brought before them last year.
While officially opening the 2015 legal year on Monday, Chief Justice Chidyausiku said some of the High Court judges were so lazy that they managed to write only two judgments for the whole of 2014, compared to others who wrote as many as 72.
Chief Justice Chidyausiku named only five High Court judges as top performers for the 2014 legal year.
He said such poor performance called for new judges to be put on probation before being confirmed, as a way of improving the quality of the justice delivery system.
Chief Justice Chidyausiku could not hide his disappointment while disclosing that another judge only wrote three judgments, while two others wrote six and 11 judgments, respectively the whole of last year and this left him with mixed feelings about the general performance of the judges.
He commended Constitutional Court and Supreme Court judges and magistrates for being on top of the situation and managing the increasing cases filed last year despite being understaffed.
Magistrates courts entered 2014 with a backlog of 49 000 cases, but managed to reduce it by the end of the year to only 2 000 without getting additional staff.
The Law Society of Zimbabwe said in a statement yesterday that while welcoming Chief Justice Chidyausiku’s censuring of the under performing judges, they expected him to spell out specific action to be taken against them.
“The Chief Justice is lauded for openly denouncing neglect of duties particularly by some senior members of the judiciary,” said the LSZ.
“However, the LSZ would have been happier if the Chief Justice’s speech had come stronger on how such neglect or failure to perform as reasonably expected will be dealt with.
“The LSZ calls upon the Chief Justice to go beyond merely denouncing such conduct. He ought to come up with concrete measures to deal with errant judges, particularly in the light of the Judicial Code of Conduct which prescribes time frames for finalising matters. This is crucial as it will address the issue of public confidence in the system.”
The LSZ also said it was important that Chief Justice Chidyausiku was “truthful and candid” in his speech.
“The Chief Justice gave praise where it was due, but was equally scathing in his attack on non-performers whom he felt had no excuse for their non-performance,” said the LSZ.
“As a stakeholder in the justice delivery system, the LSZ believes that such an approach is progressive as it correctly informs on appropriate strategies to be adopted.”
Lawyers who spoke to The Herald yesterday expressed concern over the backlog saying it was a clear case of “justice delayed, was justice denied.”
Prominent lawyer Mr Terrence Hussein said backlogs undermine the confidence the public has in the legal system.
“People have faith in the court systems and that faith comes from the fact that the person expects that when he throws himself at the mercy of the court, the court will expeditiously deliver justice,” he said.
“Due to backlog, the public loses confidence and resorts to other methods of resolving their disputes.”
Mr Hussein said the courts should have enough resources to enable the judges to discharge their duties.
“The more resources the courts will have at their disposal, the better equipped they are to discharge their obligation to the public,” he said.
Another lawyer Ms Belinda Rupapa said it was unfortunate that some judgments were taking too long to be delivered and would come after the litigants are dead.
“Due to backlogs, sometimes the subject matter would have been overtaken by events, for example cases involving the Zimdollar era, hence justice must be seen to be done,” she said.
Mr Jonathan Samukange, another Harare lawyer, said some parties were bound to lose interest in their cases due to the backlog.
But he said it was not only judges responsible for the backlog as some of his learned colleagues were also to blame.
“It is not correct that backlog is caused by judges or magistrates only,” he said. “Lawyers also contribute when they go and ask for postponements of their cases against the interest of their clients.
“Today (yesterday) I was at the High Court and in the court I was in, four matters were set down but of the four, three were postponed at the request of the lawyers and the judge actually questioned them on how he would write his judgments if they kept on postponing the matters.”
Other lawyers said there was need to adequately staff the courts to avoid judges and magistrates being overloaded with cases.
They said there was also need to adequately remunerate the court presiding officials to attract those who are highly qualified and retain those with experience.

A third of lawyers practising in Zimbabwe are being investigated by the Law Society of Zimbabwe for various cases of fraud and corruption they committed last year. There were 1 240 registered lawyers last year, but almost 400 of them are under investigation, casting a pall on the profession for which honesty is a cardinal rule.
Last year, a number of lawyers were hauled to court on allegations of corruption and fraud.
Several were convicted.
Some law firms were closed for cheating the public.
LSZ president Mr Lloyd Mhishi said in a statement that most of the lawyers were being investigated for stealing from trust accounts.
Veteran lawyers yesterday said the statistics were shocking.
“This tells about the quality of lawyers,” said Mr Terrence Hussein of Hussein and Ranchhod.
“For too long the training has been based on achieving quantity at the expense of quality. It is not sufficient to simply have a degree, it must be completed with an appropriate time of practical exposure.”
Said Law lecturer Professor Lovemore Madhuku: “It is good that people make complaints, but these reports do not yield to the guilty part of lawyers. It shows that society has become alert.”
Mr Mhishi said complaints against lawyers included failure to effectively account for trust funds.
“I wish to emphasise the importance of maintaining proper books of accounts and that the trust account is sacrosanct,” he said.
“There are a high number of complaints on legal practitioners who accept instructions for small collections, successfully collect and end up billing much more than what they would have collected.
“Unfair labour practices at law firms continue to make a significant number of complaints. Members are reminded that failure to pay salaries and wages to staff members is an act of unprofessional conduct.”
Mr Mhishi said non-compliance with the prescribed tariff remained prevalent, especially in conveyancing.
He said LSZ had directed its secretariat to perform random spot checks on the basis of the Deeds Office’s register to check on compliance with the tariff.
“We have also witnessed lawyers being sued and having office furniture attached,” said Mr Mhishi. “This brings the name of the profession into disrepute and it is a prima facie act of misconduct.
“It is also a manifestation of insolvency and the fitness of one to continue to be in the register of legal practitioners is called into question.
“Quite a number of lawyers seem to be living beyond their means. Some members have accumulated personal debts which appear to be too high and they have failed to pay back. Some creditors have indicated that they will be applying for sequestration.”
Last year, Harare lawyer Simbarashe Tsaurai (30) was convicted of raiding a legal firm’s trust fund and stealing $35 000 deposited by clients and sentenced to one-and-a-half years in prison, while Bulawayo lawyer Masimba Munjanja was slapped with a five-year jail term for stealing his client’s R30 000.
Another Harare lawyer Taurai Simbarashe was arrested on forgery and theft of trust property charges involving an undisclosed amount of cash.
In Redcliff, Tapera Sengweni was arrested on three counts of stock theft and one count of abusing trust funds.
He was also accused of stealing $12 794 from Nicholas Masuku of Mbizo in Kwekwe.
Prominent Bulawayo lawyer Sindiso Mazibisa was accused of swindling a South Africa-based businessman, Titus Ncube, who wanted to buy shares in the attorney’s mining entity worth $350 000.
Recently, prominent Harare lawyer Edson Tapiwa Mudambanuki appeared in court after fleecing a client in a $250 000 property deal, but he compensated his client when the matter was set for trial, leading to the withdrawal of the criminal charges against him.
During the same year, LSZ de-registered four lawyers and closed three law firms for failing to uphold ethics and operating in premises that were deemed to bring the name of the legal profession into disrepute.
