If I remember right they were mining cryptocurency for a while. They most likely have a good chunk of cryptounits, if you can call it that, to get this GOO crypto indexed to other cryptocurrency on these exchanges. I understand the game is doing very well with the beta testing, and I think the only hold up to the advertising and launching is this indexing issue. Just my two cents.

Considering the history of the company, I wouldn't be shocked if Glenn has close to 100 million shares ready to be purchased in private transactions in a matter of a few months.

I know. Might is a double edged sword.
This might put to rest the 10 million dollar or less settlement argument. If it were that little money Joe might have showed up with a bag of cash and the judge might have issued the order by now. They might be writing a pretty long list of assets and agreements and it might take a little to just make sure everything is in order.
I can't predict the future, it could go either way, settlement before the trial or a trial and verdict.
We can go on and on with this discussion. I don't think the damages will be dictated by the ability of the defendants to pay.
I don't think anybody expects them to pay the 280 millions all at once. They can pay a portion of it now and then they can make annual payments.
They probably wanted to make it official that the defendants said they had no money, and it might be a little harder to say now, oops we actually found some money under a rock
There might be new depositions from the defendants that might bring some new light to this whole thing and also the NBCU angle to the whole case.

It could be that both wanted to come to a settlement and NBCU didn't flinch. Now they may have to go to trial and some of the defendants might bring some new stuff to the table, just to save their little behind, and then NBCU might joint the party.

You mean that the same people that stole and hid money and assets were and are very transparent regarding their money and assets, and you want me to believe they won't find a decent amount of money to pay, that is after the evidence recovered from just one lost cell phone. I wonder what excuse they'll have if more money and assets would have been uncovered during the trial, and I also wonder how well received by the jury would be that the defendants are hiding evidence all the time until the last minute.
The point is the jury awarded based on evidence not on financial statements.

In this lawsuit nobody listed the income statements and nobody talked about J & J being able to pay, they awarded based on the evidence.
If this goes to trial and the defendants are found guilty and the jury awards CMGO a dollar or 100 millions or 500 millions, it doesn't matter they can pay or not. They will have to pay for the rest of their lives.
I know you might say just like the OJ civil trial, CMGO won't see a dime, the lawyers will come for their share, and that's another cherry on top of this cake; did they or didn't they transfer assets and/or money to relatives or friends. I think the IRS would be very interested in those transactions.

A RICO trial would bring a lot more light on the assets the defendants have or not have, unless of course they settle before the trial.

This case is just the other way around. Ron Goldman sued OJ after OJ was found not guilty, so OJ did anything possible to not pay a dime since every detail of the case was known to everybody. The problem here is that in case of a trial there are many things that have not come out in the open yet and the defendants want to keep it that way.
In a RICO case it's not about how much money they made and not even about how much money they'll ever make, it's about paying what will be decided in a court of law. If they have the money they pay, if not they'll make payments for the rest of their lives or until the amount has been paid off, witchever comes first.
I wasn't expecting NBCU to come straight out of the gate paying and also making it public. In this whole thing there has to be assets that were transferred and/or hidden not only from the eye of the CMGO shareholders but also from the eye of the IRS, and who knows what else was going to come out of a trial. When there's that many people involved there has to more to this story than the simple "Joe Wagner stole a bunch of chairs". I don't think anybody wants the real story to come out, and I think there will be a communal effort to pay some decent settlement money.
It's not just Joey. If you read the fillings there's a hell lot more people involved in this. There's going to be a collective effort to come up to that kind of money. That's what makes it more interesting.
I would also think of all the merger opportunities once the settlement is reached. I think there could be a handful of companies that could put that money to work.

The payout will be at least 5 to 10 per defendant. You do the rest of the math.
One other thing that some people forget is that nowadays there'sa that thing called GOFUNDME.COM; you sprinkle an article about this injustice and a resistance hashtag and you got yourself a ton of attention if not some big mouthed lawyer that wants a ton of attention and there it is a case featured on every network front page.
If I think more about it I would like to pass on a subscription to that website with court documents and read about this case on line just like any other regular Joe like me.
One thing I would like to add is that if found guilty on RICO they'll have to pay no ifs, ands, or whatevers.
I remember that, also I remember there's not only one defendant. The wolf of wall street guy is working on paying about 100 millions. I don't see a reason why all these defendants won't pay about 5 to 10 each for a nice out of court settlement. I don't think it's a high price for avoiding a trial where who knows what other kinds of assets might show their ugly head.
