It's bad news for Purdue Pharma but good news for generics makers such as Teva Pharmaceutical Industries ($TEVA). A federal appeals court affirmed a lower court's decision to toss out some Purdue patents for its top-selling pain drug OxyContin, further opening the door to cheap knockoff versions of the blockbuster med.

The bankrupt Purdue Pharma lost its legal effort to use patent laws to block an Indian drugmaker from launching a generic version of OxyContin when a federal judge in Delaware decided on Tuesday that some of the patents covering the drug's newer "abuse-deterrent" features could be found in decade-old academic articles and patent paperwork.
Now, we all know the Indian drug maker is an off shoot of Accord, and that facility got hit last year with a huge
warning letter and was almost shut down, or not allowed to send drugs to the USA till they clean up their act.
So, if that's where Accord want's to make their Generic OxyContin, they are DOA, witch makes Elite first to file.

As far as I know, nobody is allowed to make a Generic Oxycontin,
they may make a similar drug like oxycodone hydrochloride, or such, but they are not allowed to market it as
Generic OxyContin
now, last I heard KNOA is supposed to be making Oxycontin for Purdue,
that is, Purdue is still making the drug, and it's the oddest thing,
the proceeds of the sales under the new name is supposed to go to paying the millions and millions
in lawsuits,
so take that for what it's worth, lol
