Also, it was noted in the decision, that "return service" was not present. In other words, there was no proof that the court date had even been presented to the petitioner. Since the court couldn't be sure that the petitioner even KNEW about when and where the motion was to be heard, they had to dismiss WITHOUT PREJUDICE.
Hence, this was NOT a decision by the court to NOT award the custodianship, it was simply a decision that a decision could not be made AT THIS TIME. lol!

"Without Prejudice" means the motion can simply be refiled and the process begun again. It means the petitioner was not ruled against and that the case was simply not able to proceed because he/she was not present.
