Maybe the Ilegal Mezcal trademark case is dragging because Nixon doesn't have ANY more money to pour into any trademark cases, and is just letting the Ilegal Mezcal one ride forever.

originally incorporated 10 May 2019, but it looks to me as though it went inactive in 2020.
There was a tiny bit of possible 'forward activity' according to opencorporates.com, but that was only a change of status:
"Between 2021-04-30 and 2022-02-23 Change of status from 'Franchise Tax Board (Ftb) Suspended/Forfeited' to 'Ftb Suspended'"
I presume being only 'Ftb Suspended' is less onerous than "(Ftb) Suspended/Forfeited", but have no idea why that change was made, nor what it means (towards becoming active again).

I wonder how long the trademark court will wait before getting sufficiently annoyed so that it forces the parties to continue -- that is, deny any additional motion to suspend.
It's possible they could settle, but my guess is that Illegal Burger has the upper hand, and at this point -- unless the court forces the trial to move forward -- can afford to do nothing and let Ilegal Mezcal string itself along with motions to suspend for negotiations. Given how long the string of such motions is, it doesn't look to me like any negotiations are happening.
Looking at the Illegal Burger locations map just now, they have not added any new locations. As was briefly discussed in this forum before, they have closed one location (the Capitol Hill one -- my guess is that the location finally wasn't 'upscale enough' for them to attract enough customers, and the nearby Wendy's beat them out on price for those wanting a quick burger to go).
Closing note: there is still an active Illegal Burger Capitol Hill, LLC corporation.

In reading the trademark trial info it states that both parties can-are negotiating to find an agreement. This would indicate that the news and settlement can come at any time. I also am looking at the locations of restaurants and have they added a location or two? Enjoy the day.

You could be right, but it's likely that Illegal Brands IP will NEVER agree to giving up their graphical logo. The next move is really up to Ilegal Mezcal to respond to the response by Illegal Brands IP, so -- in my opinion -- it would be a poor argument on their part to claim they 'need more time' because they brought the action in the first place.
Often, trademark infringement suits against 'little guys' are won because the little guy doesn't have the money to fight the case.
I'll bet Illegal Brands IP has enough money and thinks it has a solid case, and I'll bet that Ilegal Mezcal was surprised that Illegal Brands IP didn't just roll over and surrender.
The case is actually about something more minor than the use of the word "Illegal", since Illegal Brands IP already owns the trademark for names "Illegal Burger" and "Illegal Brands."
The case is about Ilegal Mezcal's objection to the graphical representation (or logo) of the words "Illegal Brands" (white letters on black background, with "Illegal" in large font size over the word "Brands" in smaller font) on WCVC's CBD water.
They claim that visually there would be confusion due to the alleged visual similarity between that graphical logo and the "Ilegal Mezcal" logo on its labels and clothing.
I didn't see that "Ilegal Mezcal" was even a registered trademark by name, and neither was the logo a registered trademark for its graphical logo, so I can only presume that the company is claiming an established 'prior use' defense.
Illegal Brands IP did file one response that basically said Ilegal Mezcal didn't have a case for a number of reasons (which I think included not having actually trademarked what they are claiming they own, plus the sufficient dissimilarity between the two logos AND products that no one would be confused).
That Ilegal Mezcal -- the Plaintiff, or "P" -- is filing all of the motions to suspend for negotiations suggests to me that they know they don't have a case, and hope that Illegal Brands IP will simply tire of being bothered and capitulate, or maybe that Illegal Brands will cut some sort of deal with them.
Both companies must be wasting a lot of money dragging this out as legal stuff is never cheap.
Correct me if I am wrong but it can also be the parties not reaching an agreement or simply needing more time?
The Trademark Court must be so backed up that it doesn't care about rinky-dink cases like this being closed in a timely manner.

Like everything else it happens when we dont expect it and suddenly.
No update on trademark case yet (per east coast closing time).
Will keep watching, but so far most of the case-action dates have seen filings before or on the date that continued the series of suspensions for negotiations.
It sure would be great if something different happened, wouldn't it?
