Wis.Stats s. 100.30, The Unfair Sales Act and Wis. Adm. Code CH. ATCP 105, Sales Below Cost
Commonly referred to as the "Minimum Markup Law," is a general trade practice regulation prohibiting sales below cost. The law considers the practice of selling below cost to attract patronage a form of deceptive advertising which diverts business from retailers who maintain a fair pricing policy, ultimately resulting in lessened competition and market disruption. The law provides the following:
General merchandise other than alcoholic beverages, cigarettes and other tobacco products may not be sold at less than cost by either wholesalers or retailers. “Cost” is defined as invoice cost or replacement cost whichever is lower, less all trade discounts, plus any excise taxes and any cost incurred for transportation and any other charges not otherwise included in the invoice cost or replacement cost of the merchandise.
Alcohol or tobacco products may not be sold at less than cost by either wholesalers or retailers. The definition of “cost” includes a presumptive 3% markup by wholesalers and presumptive 6% markup by retailers. Cost for wholesalers who operate retail outlets or retailers who purchase directly from the manufacturer includes a 9.18% markup (3% plus 6% compounded).
S. 100.30, Wis. Stats treats motor vehicle fuel separately. For retail sales of motor vehicle fuel, the definition of “cost” relies on the “average posted terminal price” and includes a 9.18% markup over this amount. Although there have been multiple lawsuits challenging the validity of the law, including the most recent one filed by Flying J, the law as described above is the current law..
Violations of the law may result in a special order issued by the department or a court ordered civil forfeiture of $50 to $500 for the first violation and $200 to $2500 for each subsequent violation. Sellers of motor vehicle fuel and/or tobacco products may file a private cause of action to seek damages if they are injured by a competitor's price.
Exceptions to the law are made to allow for matching a competitor's price, clearance and final liquidation sales, sales of damaged merchandise and perishables, contracted governmental institution sales and for merchandise sold to charitable or relief agencies.
The Unfair Sales Act applies only to the sale of goods; services are not covered.
Fraudulent Representations

Regarding Motor Vehicle Fuel:
At each retail place of business, a price has to be posted in a conspicuous place, most accessible to the public at his or her place of business and on every pump.
Once a price has been posted it must remain in effect for at least 24 hours.
It is considered deceptive advertising to advertise a sale price for retail less than the price posted on each pump
Enforcement
Investigations into potential violations of the Unfair Sales Act and Fraudulent Representations are generally prompted by written complaints submitted by merchants or consumers. Staff reviews the complaints for applicability of the statute and prioritizes the investigations based on potential market injury. Investigations can consist of interviews with witnesses and review of financial documents, such as invoices, shipping manifests, and records of price changes.

The chart shows the 26% Fib retracement level is holding although not sure for how long.

They will have clear land to do so because the trees have already been removed due to the 500km road construction. Good News and might be completed ahead of schedule!

TravelCenters of America LLC (TA) second-quarter profit skyrocketed from a year earlier, as the gas station and roadside restaurant operator saw its bottom line lifted by a pop in fuel sales.
TravelCenters operates more than 200 sites and counts the trucking industry as its primary customer. The company has swung to the black in recent quarters, though it still posted a loss in its first quarter.
The company reported a profit of $21.7 million, or 99 cents a share, up from $1.2 million, or 7 cents a share, a year earlier. Two analysts polled by Thomson Reuters forecast per-share earnings of 77 cents.
Revenue climbed 39% to $2.1 billion, as total fuel revenues jumped 47%. Total non-fuel revenues were up 9.7%, helped by increased customer spending in TA's travel centers.
Total fuel gross margin per gallon was $0.162, up from $0.147 a year earlier.

. Customer Service In America Today
TA Travel Centers of America
Today twenty drivers were having the best time we have had on the road in years.
The TA here in New Braunfels Texas has the drivers TV lounge in the Shop front office.
We all were watching football and having the best time watching Dallas lose.
These twenty drivers have not laughed and had this much fun in years.
We probably were a little loud and it sounded like a sports bar a some point but we were having fun.
The shop only services Trucks and we twenty drivers represent more then a million dollars to TA a year. Each driver spends an average of sixty grand a year in fule and shop service.
I am the businessman always and I was just sitting there thinking how much I would love too have a million dollars business having fun in My shop and how much I would be there giving them popcorn and drinks since the shop has no snacks.
Well to my disbelief the shop service manger was insulted and did not like drivers having fun in his shop.
He went as far as to argue with a driver and treat him like a ten year that he was dad too.
As I sat there listening to this driver get chastised it made me think how much I watch customer service shrinking now in America all over this country.
This was so insulting too watch this poorly trained service manager treat drivers bad and several were thinking of getting hundreds of dollars of service including me.
That one moment of this poorly trained employee now has insulted over 1 million dollars in one five minute victory of him telling us to be quiet.
Now a days it is so unusual to see customers having fun but also having a great time together without an argument.
Needless to say I am now missing the Eagles game and hoping they lose now.

Please all that work with customers always remember one minute victories can cost your company millions and the million dollars in that room will not be back to spend money with that service shop as there are four other locations we can spend are money within thirty miles and thirty miles when you do 150 thousand a year is nothing.
please do not send your customers down the road as big or small we are all needed as a team to make a success.
