Pass narrow medical marijuana bill then call it a day

There were all sorts of goodies hidden in the spending bill Congress approved last week. Lawmakers are being chided for adding provisions that have nothing to do with keeping the government running — rather they use such occasions to pay debts to constituents — the people who give them megabucks for their election campaigns.
The system is flawed, lawmakers can add these little tidbits without much notice. Even the lawmakers didn’t know all of the sweeteners that helped the CROmnibus bill to pass, but it is what it is.
One such measure tossed into the mix was a provision that ended the federal government’s prohibition of medical marijuana. It takes the feds out of the game and gives the authority to regulate medicinal marijuana to the states, of which 32 and the District of Columbia have already approved.
Hopefully, Georgia will be taking the step to legalize medicinal cannabis with the provisions included in Rep. Allen Peake’s bill, HB 1, in the next session. The federal clause may require some rewriting, but it is a positive step for those who want to help people suffering debilitating seizures, particularly children.
Last year’s efforts were derailed by politics and that factor has not disappeared, but this time the challenge may be from those who believe the state’s marijuana laws should be scrapped. We are not willing to go that far. States that have given the OK for unfettered use of the drug are still works in progress.
Lawmakers should not let the issue get confused with other efforts and maintain the narrow provisions included in HB 1 and call it a day.

How marijuana will fare on election day

The DC Cannabis Campaign made last minute preparations on Monday for a vote that could make possessing and growing marijuana plants legal in the nation’s capital. (Reuters)
Tomorrow, voters in four states will decide how the next chapter of marijuana reform will be written. If several of the measures pass, it will likely build momentum for a growing public consensus on legalization. On the other hand, if all or most of the measures fail, legalization proponents may need to take a step back and reassess their strategies for legalization efforts already planned for a number of states in 2016.
It took a certain amount of audacity to put marijuana on the ballot in 2014 to begin with. Support for marijuana legalization is heavily concentrated among younger and more liberal voters, while midterm electorates are by definition older and more conservative than those in presidential years. There's some evidence that marijuana ballot measures bring younger voters to the ballot booth: exit polls show that in Colorado and Washington, young voters made up a larger share of the electorate in 2012 (when marijuana was on the ballot) than in 2008.
On the other hand, an analysis by FiveThirtyEight earlier this year used Current Population Survey data to explore a number of different elections where marijuana was on the ballot and found that differences in young voter turnout were negligible. So it's unclear whether this year's ballot measures will bring more young voters to the polls.
Here's a rundown of where each of the four ballot measures stand.
D.C. - full legalization
Likelihood of passage: high
D.C. voters will choose whether to allow adults 21 and over to legally possess up to two ounces of marijuana, and grow up to six plants. Polling has shown consistently high support for the measure - at this point, it would be a major surprise if it didn't pass.
The drama will come after the vote. The D.C. council is expected to put in place a framework to allow the legal sale of marijuana, following Colorado and Washington's lead. The council held a hearing on the issue last week. Councilman David Grosso has already drafted a bill that would tax recreational sales at 15 percent and put regulation in the hands of the city's alcohol regulators.
Looming over it all is the specter of congressional interference. Maryland Representative Andy Harris tried - unsuccessfully - to block the implementation of the city's decriminalization measure earlier this year. He's already said that he will "consider using all resources available to a member of Congress" to stop any full legalization efforts. Given the current state of gridlock in Congress and the lengthy to-do list facing the lame duck session when members return, it's unclear how much luck he'd have.
Legal weed in the nation's capital would be a huge symbolic victory for marijuana reformers. And a showdown with Congress over implementation could be a political minefield for opponents of legalization and their allies on the Hill. Reformers would be all too happy to characterize their opponents as thwarting the will of the people, and a recent YouGov poll suggests they'd have an easy time doing so: a majority of Americans say Congress should not interfere with legalization efforts in DC.
Oregon - full legalization
Likelihood of passage: probable
When voters in Colorado and Washington passed marijuana legalization bills in 2012, true-blue Oregon was the odd man out: its Measure 80 failed at the polls. News outlets called the bill "wacky," noting that the bill itself contained references to George Washington and cited the "herb-bearing seed" of the Book of Genesis.
As my colleague Emily Badger wrote last month, legalization proponents are taking a wholly different approach this time around. They're calling their current bill "the most regulated and strict marijuana measure ever voted upon in Oregon," and are strongly emphasizing regulation and taxation as part of legalization. They're selling it as the marijuana legalization initiative for people who don't want to smoke marijuana - and who don't want their kids to, either.
Most polls show the measure ahead. The latest SurveyUSA poll has it passing with 52 percent support.
Alaska - full legalization
Likelihood of passage: too close to call
Alaska voters will also decide whether to fully legalize marijuana tomorrow. Alaska's situation is unique because the personal possession of up to four ounces of marijuana has been protected under the state's constitutional right to privacy since 1975. This puts more headwind in front of legalization efforts, since a certain number of voters who would otherwise support a legalization bill might decide that the current protections are sufficient.
Alaska already has one of the highest marijuana use rates in the U.S. These users could turn Alaskan weed into a $107 million industry if legalization passes and puts a $50 tax on marijuana at the wholesale level. But polls show an incredibly close contest, with small nuances in how the questions are worded yielding very different responses. At this point its anyone's game.
Florida - medical marijuana
Likelihood of passage: ¯\_(?)_/¯
In June, Florida governor Rick Scott signed a bill that would allow a non-psychoactive strain of cannabis known as "Charlotte's Web" to be used to treat patients with epilepsy. Voters are now deciding whether to approve a fairly wide-reaching medical marijuana measure that would allow doctors to recommend marijuana for any "conditions for which a physician believes that the medical use of marijuana would likely outweigh the potential health risks for a patient."
As a constitutional amendment, the measure requires 60 percent support to pass. Polls have been all over the map on this one, with different surveys showing 20 percentage point differences within just a few days of each other. While Floridians overwhelmingly approve of medical marijuana in theory, it's safe to say that they're conflicted about the merits of this particular bill.
Florida's campaign is also the most expensive marijuana ballot measure this year. Casino magnate Sheldon Adelson has poured $5 million of his own money into the opposition campaign, fueling it almost single-handedly. On the other hand supporters have raised about $8 million, roughly half of it from attorney John Morgan.
While the fate of the other marijuana initiatives rests largely in the hands of young voters, Florida's seniors may be the lynchpin here. Given the volatility of the polls it's very difficult to predict how things will play out, but the 60 percent supermajority requirement represents a high bar for supporters of the measure.

On Tuesday, voters in several states will decide the fate of marijuana legalization measures that could generate hundreds of millions of dollars in new revenues for the cannabis industry.
The three key battlegrounds to watch: Alaska and Oregon – which could become the next recreational marijuana markets – and Florida, which could become the first southern state to legalize medical cannabis.
Voters in Washington DC will also decide whether to legalize adult possession and use as well as home grows. Additionally, there several other local cannabis-related initiatives on ballots in a handful of other states, including Colorado, Maine and Michigan. (Note: Marijuana Business Daily will provide live election updates here starting Tuesday afternoon.)
In Florida, Oregon and Alaska, all three campaigns started out on what looked like fairly solid footing, according to early poll numbers. But as the campaign season wore on and opponents of the three ballot measures ramped up anti-legalization advertising, support began to wane. It’s conceivable that all three could fail – which would be a huge setback for the marijuana movement.
The DC initiative is the only one of the four that looks like it could pass with ease, but the business impact would be minimal – relegated primarily to companies that sell home cultivation equipment – because the sale of cannabis would not be allowed.
Here’s a primer and the latest polling data on the most prominent ballot issues:
Alaska: Ballot Measure 2
Medical marijuana is already legal in Alaska, but dispensaries are still banned. Ballot Measure 2 would alter state statutes to legalize recreational marijuana for those 21 and older, similar to Amendment 64 in Colorado and Initiative 502 in Washington State.
The measure would allow adults to possess up to one ounce of marijuana and up to six plants. It would also pave the way for retail stores, which could generate between $45 million to $55 million in annual sales initially, according to Marijuana Business Media’s estimates.
Regulations for the industry would begin with the Alcoholic Beverage Control Board, but the measure allows the state Legislature to establish a board to oversee cannabis cultivation and sales.
There have been few polls out of Alaska, compared to Oregon and Florida, and recent surveys tell a conflicting tale. Early numbers showed support nearing 50% range, and activists believed they could build on that base to broaden support.

But in early October, a pair of polls were released with opposite findings: one showed Ballot Measure 2 with only 43% support, and the other pegged support at 57%. Both polls found 4% undecided, and both had 4-point margins of error.
Opponents to the measure have raised a meager $108,000, while the Marijuana Policy Project and the Drug Policy Alliance have pumped almost $850,000 into the campaign.
The Alaskan measure got some unorthodox attention in September, when an Anchorage television reporter quit on-air during a live broadcast after revealing she’s the owner of a cannabis club.
Florida: Amendment 2
Florida has been one of the toughest campaigns to keep a handle on, due to crazily fluctuating poll numbers in recent months. Amendment 2 would amend the state constitution to legalize medical marijuana. Florida’s health department would establish regulations for MMJ dispensaries, cultivation sites and infused products manufacturers as well as issue ID cards to both patients and caregivers.
Annual sales would likely total in the hundreds of millions of dollars given Florida’s large population and the high number of seniors in the state.
Despite early polling numbers that showed support for medical marijuana at an amazing 88%, the Amendment 2 campaign has been struggling to keep support above 60%. That’s the threshold for a change to the Florida state constitution, and multiple polls in recent months have found support well below that mark.
Two of the most recent found support at 59% and 50%, respectively, so again, it’s hard to make any kind of judgment call on whether Amendment 2 will pass.
Casino mogul Sheldon Adelson has pumped millions of dollars in cash into opposing the measure, helping the anti-cannabis campaign Drug Free Florida air TV ads that Amendment 2 backers say are misleading voters. People United for Medical Marijuana, the group behind the Amendment 2 campaign, went so far as to send a cease-and-desist letter to Florida TV stations over one ad.
John Morgan, an Orlando trial attorney, has largely bankrolled the Amendment 2 campaign on his own, but backers have also seen a huge influx of campaign donations from cannabis entrepreneurs all over the country who are interested in tapping the Florida market.
Oregon: Measure 91
This is another race that appears too close to call before Election Day.
Measure 91 would alter state statutes to legalize recreational marijuana sales in Oregon for those 21 and older, similar to the Colorado and Washington legalization initiatives.
The measure would pave the way for retail stores and other businesses, and it would permit individuals to possess up to eight ounces of marijuana and up to four plants. The Oregon Liquor Control Commission would establish regulations for the industry.
Annual sales could come in around $225 million to $275 million, according to Marijuana Business Media’s initial ballpark estimates.
The latest polling numbers in Oregon effectively rate Measure 91 as a toss-up, with 44% supporting the initiative, 46% opposing it and 9% uncertain.
The contest has been one-sided on the money end: supporters, including New Approach Oregon and two other groups, have raised more than $7.5 million for their campaign, while opponents have only come up with a little over $168,000, most from the Oregon State Sheriffs’ Association.
But even the law enforcement community in Oregon is divided on the issue. Recently, a coalition of 30 former cops, sheriffs, prosecutors and judges all put their names on a letter in support of Measure 91, arguing that marijuana prohibition has failed.
If 91 passes on Tuesday, Oregon could become the “new gold standard” in the recreational market, according to the head of the Drug Policy Alliance. The measure was written as one of the most cannabusiness-friendly laws in the nation, when stacked against Colorado and Washington.
And Portland, the largest city in Oregon, could see an influx in customers from the north, since tax rates on recreational marijuana remain sky-high in Washington.
Washington DC: Initiative 71
Of all four legalization measures, Initiative 71 has the best chance of passing, according to the few polls that have been conducted in the capital. The measure would legalize adult possession of up to two ounces of marijuana and allow those 21 and over to grow up to six marijuana plants for personal use. Though marijuana paraphernalia sales would also be legalized, and individuals would be allowed to share what they grow, sale of marijuana would remain prohibited.
However, the DC Council is also considering a separate measure that would legalize recreational marijuana sales, so Initiative 71 could eventually help create a viable market with roughly $130 million in sales by one estimate.
The most recent voter survey on Initiative 71, released in September, found that a whopping 65% of residents support the measure, while only 33% oppose it.
But while the initiative may cruise to victory at the ballot box, marijuana’s future in DC remains uncertain, because Congress could essentially veto the law. And according to The Washington Post, “The DC Council is talking about waiting months, or even a year, before taking the next step and passing a scheme to allow sales, taxes and regulation.”
So questions abound regarding the fate of cannabis in America’s capital.

Establishment of the regulations allows TRTC to move forward with a commercial cannabis growing facility in the area. As a matter of fact, since TRTC formed a Nevada team headed by connected Rebecca Gasca, I would be surprised if they didn't have some influence in writing them.
It's basically set up to limit the market to a few large, well controlled facilities. So those like TRTC with ins are set up to succeed in what you got to think is going to be the largest medical marijuana market in the country, Las Vegas.

The proposed facility is approximately 35,000 Sq ft and will contain both cultivation and production at the same location. The team is working towards completing their state application while at the same time working aggressively towards submitting an application to the City of Las Vegas to operate a medical Cannabis dispensary. The company intends to give further updates about their efforts throughout Nevada as they progress through the process, reach certain milestones and enter new applications.
Peterson envisions a 30,000 square-feet to 50,000 square-feet cultivation plant, for which the company budgeted $3 million. A production facility could cost about $1 million, he said, while a retail store could cost between $500,000 and $700,0000, plus another $100,000 for security.
The company picked out real estate for a dispensary near Desert Inn Road and Decatur Boulevard, in order to be close to the local population and a short distance from the Strip and downtown Las Vegas.
Here’s how Peterson breaks down the figures: a 50,000 square foot cultivation facility, with a staggered growth schedule, could produce 50 to 75 pounds of marijuana a week.
In other markets where marijuana is legal, the plant sells for $2,500 to $3,000 per pound at wholesale. That’s upward of $225,000 per week for a cultivation facility.

Municipal Approval for Lexaria-Enertopia Joint Venture in Burlington, Ontario
Jul 14, 2014 (Newsfile Corp via COMTEX) -- Lexaria Corp. (OTCQB: LXRP) (CSE: LXX) (the "Company" or "Lexaria") is pleased to announce that the production of Medical Marihuana in compliance with Health Canada MMPR regulations has received final Municipal zoning approval for the Lexaria/Enertopia joint venture. Previously announced only as being located in the Greater Toronto Area, now that Municipal approval has been obtained Lexaria is happy to announce the facility location as Burlington, Ontario.
The evaluation procedures of the City of Burlington were followed, including presentations made to city officials and opportunities for public feedback and input. Lexaria is pleased that the City of Burlington showed community leadership and vision in implementing a thoughtful series of rules for the cultivation of medical marijuana in accordance with Federal Health Canada regulations.

Now that the City of Burlington has passed a bylaw permitting medical marijuana production facilities, Lexaria expects that the joint venture license application to Health Canada will be submitted soon.
The bylaw approving the medical marijuana facility zoning was passed by Burlington officials on June 9th, and the period of time when appeals were allowed to be heard expired on July 9, 2014. Notice of passing of the Bylaw was provided on July 10, and at this time the bylaw is in existence.
The Lexaria/Enertopia joint venture, as previously reported, is for a building of approx 30,000 sq ft for first phase design, with a right of first refusal obtained for approx another 45,000 sq ft. Since the original announcement of this facility on April 10, 2014, a great deal of progress has been made regarding the state of the art design concepts expected to be implemented.
The joint venture has engaged David Hyde & Associates for security design and implementation. David Hyde & Associates is a full service security management and business risk consulting and training practice that offers independent, high quality advisory services underpinned by real-world security and risk management experience. David Hyde & Associates, widely acknowledged as one of Canada's leading security experts, has previously been a security consultant to another existing company that has already received their license under the MMPR program.

A total of 880,000 restricted common shares will be issued to a number of persons in accordance with previously entered agreements, upon reaching the municipal approval milestone.
