No 8K out yet on it
Does exiting chapter 11 mean that they are no longer claiming bankruptcy? And that the original shares will be the ones used going forward still, if Sears is bought?
That’s the confusing part to me, can’t seem to find a straight answer.
TIA
I'm not smart but I think it has to do with the substantial amount of tax credits available to holdco, they are tied somehow to old structure. Then again maybe don't listen to me
Um can you link to the filing please? I can't get into my PACER account.
Market Makers hard at work manipulating, look at the volume and price over different time intervals, but from a daily (1 day frequency) candlestick charts for the last few days have had long legged doji type candles, they are very hard at work keeping the price within a narrow range getting many people shaken out from fear thinking it won't go higher, I'm holding, not a super large position, it's still up to the judge, but the possibilities look super promising!!! cheers
And apology accepted
They have exited Chapter 11 per today’s filings
Pardon me for not knowing I was posting “crap” as I was asking what I thought to be a legitimate question after reading on SEC.gov:
“When a company is involved in bankruptcy proceedings, the letter "Q" is added to the end of the company's stock ticker symbol. In most cases, when a company emerges from bankruptcy, the reorganization plan will cancel the existing equity stock and the old shares will be worthless...”
Hence my original question.
This is just a notice of edits to the sale proposal, they're in court today. Scroll down to Exhibit B past the outstanding contracts and you'll see the changes that have been made (red strikethroughs are for removal and blue underlines are amemdments), beginning at page 100 of this PDF.
LOL, A public company cannot just cancel its stock, please don’t post crap like that
I don’t understand. If these shares have a Q, AND Sears remains a viable business after all this ado, wouldn’t they just cancel these shares and issue new stock?
How/why are you predicting “Dollarland”?
...New to this type of gamble, very small position.
Thanks.
I have a montecristo 2 cigar and a good barleywine.
SP
Buying some Champagne tonight! I'll be ready to crack it open and celebrate this weekend! Dollar land coming soon!

A CNN news report states that the Hearing continues
today and will likely conclude with closing arguments
tomorrow morning.
Debtors are hoping for a ruling by Friday.
Short might want to re access their positions like today or tomorrow

Latest filing from today :) The heavy buying should happen soon
"Which way is the court leaning?
So far, the judge has appeared to be giving Sears every chance to save itself. At a January 18 hearing he said "it would be a very good thing" if there were a way to save the 45,000 jobs at Sears and Kmart."
"What do Sears' employees want?
Watching anxiously from the sidelines are Sears' 45,000 employees. A group of past and current Sears employees sent a letter to Drain on Tuesday asking that he accept Lampert's bid."

DOCKET # 2430 - Order is 76 Pages of 180

.575. Comon guys we are so close to breaking past .60. Buy for gold
Thanks Linda. So the trial is not over yet. Thanks for the clarification.
CORRECTION:
The Debtors’ Attorneys drafted a 180 Page
Revised Order - which outlines the Sale Agreement -
and filed it with the Court today.
It is this draft Order that the Debtors would
like Judge Drain to sign and which Order
approves the Sales Agreement (APA).
Never seen WABR before as an MM. 10,000 @ .565 on the bid.
Good Morning Crew...SHLD(Q) is looking good here...low volume and upticks before news...LOVING EVERY MINUTE OF IT!
SP
So this proposed order was prepared because the judge is ready to sign OR was this prepared before the trial began?
210,000 volume so let’s see how much more gets bought ~ sold in the next few hours
True it’s coming it’s coming
No - the Debtors filed a proposed Order
for Judge Drain to sign - if he approves of
the Sale. The excerpt is from the proposed
Order.
It saves the Court and the Judge time if
the Lawyers compose and file proposed Orders.
The Judges can make any changes they
want to the proposed Orders before signing.
As soon as the news is released on CNBC and FoxBusiness ......
So you are saying Judge Drain approved the sale of Sears to ESL? Is this not the news we were waiting for?
Final Order means that the Sale is approved
and cannot be changed within the Court. It
would have to be appealled to a higher court.
Oh they are still close behind us but not fir too long
That’s the first one we are needing to break through then it’s up up and up
High so far .58. Step by step onwards and upwards
“ after the esl bid is approved (hopefully) and the
transaction is closed, transform holdco (new sears)
will be off and running, which would include the
sale of the 100 dark stores which are part of the
425 store footprint. “
What do you mean by 100 dark stores?
The Debtors stated in one of the recently filed documents
that 400 of their stores are profitable.
Also where did you read that ESL will be selling
100 of the 425 Stores? I did not see that in the
APA - which would be a loss of another 10,000
jobs. That doesn’t make sense to me.
