dont let the green volume bars worry you, everything on ihub before last aug, is green. it did that when they made some changes. drove me crazy.

Hey, is anyone out there? I'm a bagholder from a few years back - costs more in commissions to sell what I have is worth. And yet someone keeps trading. Up to .0013 today. Can't find a thing about what's going on or even what happened to Consumers Choice and the whole thing. If anyone has a any clue I'd be interested in knowing. TIA Just curious.

A derivative suit is a civil lawsuit filed by shareholders on behalf of a corporation. In these suits, shareholders are looking to enforce corporate rights against directors or other insiders.
Derivative lawsuits differ from class action lawsuits, in which a large group of plaintiffs -- either shareholders or other entities -- bring a suit in their own right.
In the class action arena, the law specifically favors having institutions serve as lead plaintiffs. But there is no law that governs who should be a lead plaintiff in a derivative suit, in part because derivative suits are governed by state law.
And, unlike in class action lawsuits, plaintiffs are not forced to wait 60 days before filing an action.
Before filing a Derivative claim there are certain criteria that have to be met. Also note that in a Derivative suit the recovered monies go back into the company and not back to the claimant. I would suggest consulting a corporate SEC savvy attorney before initiating any actions.
fontaine101, The SEC probably won't be of any help because this isn't "big" enough for them. I have been down this road before and have filed a derivative action against one of the same persons that is/was involved with this company, (Earl Ingarfield - Bell Investments), who was the CEO of Avid Sportswear and Golf Corporation (AVSG). The suit is still pending. IMO, if you feel that you've been wronged, contact the SEC. Their website has an online complaint form you can fill out. If enough of us keep reporting troubles with these companies, maybe they'll take action. Good luck.
Put all the PR's together and send package to SEC and the state attorney general. Then I'd try to get a local and hungry young attorney who is willing to go after the individual promoters who pushed the company. Somebody got the money. Going after the company is probably a waste of time. Go after the scammers, trace the assets, bring an equitable action that incorporates breach of fiduciary duty to shareholders, accounting, taking unfair advantage of corporate opportunity, trace and reach and apply assets taken from corporate entity, etc.
The form could be either a class action against them or a shareholders' derivative action but avoid the firms that just do "cookie cutter," stuff. You need someone who will trace the assets to the scammers and try to reach and apply them. It's more work than the cookie cutter firms want to do.
How could I sue this company....I trully believe that they put false info in order to recieve orders. They acted as if they were going to be a promising company mentoning that they could possibly make up the 70 million range in a small number of years! I took about a 98% loss on this and I really feel ripped off! If anyone has any info please let me know?

got it - I bought a few shares so no big deal - just want to make sure I understand - same people PR'd a business plan here, got people to buy, and then put the business plan into another entity?
If so, it's a lawsuit or SEC violation in the wings. But, of course, who's going to push it? Would have to be someone with a big position in this crap.
