II. Advisory Sentencing Guidelines Calculation
Sentencing begins with a properly calculated advisory sentencing guidelines range. Gall v. United States, 552 U.S. 38, 49 (2007). The government agrees with the Presentence Investigation Report (PSR) prepared by the United States Probation Office.
In the PSR, the Probation Office determined that the defendant is an offense level 41, criminal history category I. As a result, the defendant’s advisory guidelines sentence is 324 to 405 months incarceration.
III. Section 3553(a) Factors Call For Guidelines Sentence
In imposing sentence in this matter, the Court should consider the need for the sentence to reflect the seriousness of the offense, to promote respect for the law and to provide just punishment for the offense. 18 U.S.C. § 3553(a)(2)(A). Pursuant to 18 U.S.C. § 3553(a)(2)(B), the Court should also consider the imperative that the sentence in this case clearly and strongly deter others from violating the securities and tax laws of the United States.
For years, Turek engaged in a massive fraud in which he swindled more than 8,500 people out of $18 million. The defendant’s misconduct had a devastating effect on his victims, some of whom lost their life savings because of the defendant’s scheme. Gene Guhne lost more than $500,000 from purchasing Plasticon stock in reliance on Turek’s false statements. Turek also cheated Mr. Guhne personally by selling $50,000 of stock to him, taking Mr. Guhne’s money, but not delivering the stock certificate for several months until after the stock was worthless. Steve Zaccarelli invested in Plasticon stock the money that he had saved from working two jobs for several years. He lost it all. Frank Meleshko, a disabled retiree, lost a sizeable portion of his retirement savings by investing in Plasticon stock. Chris Wildfoerster met with Turek in person and spoke to him several times on the telephone. Turek repeated the lies he made in the press releases by telling Mr. Wildfoerster that the company was profitable and owned patents worth millions of dollars. At Turek’s recommendation, Mr. Wildfoerster purchased Plasticon stock and lost more than $100,000. These individuals and thousands of other investors all relied on the false statements that Turek made to swindle them into buying stock that his nominees were selling. The defendant stole not only the victims’ money but also violated their trust, particularly those whom the defendant personally conned out of their funds. Finally, the defendant’s crime has the grave consequence for the economy of undermining confidence by all investors in the public securities markets.
While the sentence recommended by the guidelines is quite lengthy, it accurately accounts for the defendant’s position of trust as an officer of a public company, the immensity of the fraud in which the defendant engaged and the ruinous harm the defendant caused thousands of people. Accordingly, the government requests that the Court impose a sentence consistent with the advisory guidelines range in this case.
IV. Conclusion
For the reasons stated above, the government requests that the Court sentence the defendant to 324 months in prison.

I. Summary of the Case
On June 22, 2012, following a two-week trial, a jury convicted Turek of all thirteen counts of the indictment: eight counts of securities fraud and five counts of filing false tax returns.
The evidence at trial showed that Turek was the president, chief executive officer and director of Plasticon International, Inc. From 2004 to 2006, Turek caused Plasticon to issue billions of shares of stock to himself pursuant to false and backdated promissory notes. The promissory notes falsely claimed that Plasticon owed Turek more than $8 million as a result of loans he had made to the company. Turek frequently directed his secretary, Judy Paynter, to backdate by several years promissory notes payable to him.
To evade SEC rules limiting the sale of stock by an officer or director, Turek feigned giving his Plasticon stock to various nominees including his children and his deceased aunt. Turek then caused the nominees to sell the stock into the market. As a result of these sales, Turek received more than $11.4 million personally and through LexReal Co, LLC, a shell company that he owned and controlled.
To create investor demand for the stock that his nominees were selling, Turek issued press releases falsely stating that Plasticon was profitable and that it owned patents worth millions of dollars. Turek also falsely stated in an interview broadcast on the internet that he invested millions of dollars into Plasticon and that he had been working for nothing for three and a half years. Finally, Turek made false statements in Plasticon’s SEC filings in which he falsely stated that he had loaned the company millions of dollars when he had not. As a result of Turek’s false statements, more than 8,500 investors purchased Plasticon stock and lost more than $18 million.
Turek filed false tax returns for himself for the years 2003 through 2007. During three of those years, he reported no more than $36 in total income. For the entire five years, Turek failed to report more than $12 million in income on his tax returns.

Former recycled plastics product executive James Norman Turek has been convicted on eight counts of securities fraud and five counts of tax fraud for defrauding some 8,500 investors nationwide out of $18 million.
The 66-year-old former president and CEO of now-defunct Plasticon International Inc. was convicted June 22 after a two-week trial in U.S. District Court in Lexington, Ky.
Turek is scheduled for sentencing Sept. 27. He faces a maximum prison sentence of 20 years on each count of securities fraud and three years on each count of tax fraud.
According to an announcement from the U.S. District Attorney’s office in Lexington, the tax division of the Department of Justice, the Federal Bureau of Investigation and the criminal investigation division of the Internal Revenue Service, Turek lured about 8,500 investors between 2004 and 2006 by falsely claiming — in statements to investors and in press releases — that Plasticon owned valuable patents, and that the company was profitable.
According to the federal government, the Lexington, Ky., firm had few sales, and Turek knew it was losing millions of dollars.
The evidence further showed that Turek had issued roughly 5 billion shares of company stock to himself and backdated promissory notes that claimed he had donated millions to the company — when he had not.
To circumvent SEC rules governing the sale of stock by a control person, he transferred the stock into the names of friends and family members, including his deceased aunt, before selling the stock to unsuspecting investors, the indictment said.
Turek was president, CEO and sole director of Plasticon from 1994-2007, giving him complete control over its affairs until October 2007, when a bankruptcy court-appointed trustee took control.
Plasticon filed for bankruptcy May 16, 2007, less than 18 months after it acquired injection molder and thermoformer Pro-Mold Inc. of St. Louis. The SEC suspended its stock trading four months later and revoked its securities registration two months after that.
According to the government’s news release, Turek filed false tax returns for the years 2003 through 2007, for “failing to report approximately $12 million that he stole from Plasticon.”
A federal grand jury had indicted Turek on charges of securities fraud and filing false income tax returns in March — about 21/2 years after the Securities and Exchange Commission had filed charges against him in the same court for misappropriating company funds for personal use.
SEC had charged that Turek had taken at least $2.8 million of the $8.2 million to $11.2 million in funds that Plasticon had raised from at least 30 investors — capital that the firm said would be used to buy equipment and acquire other companies. Those funds were raised in an unregistered, multistate securities offering between January 2005 and April 2007, according to SEC.
Those charges were settled Feb. 11, 2009, when Turek agreed to a judgment finding him liable for disgorgement of $2.6 million plus $557,836 in interest. The court waived payment and did not order Turek to pay a civil penalty, based on a statement of financial condition he filed with the court.

A federal jury found the former president of a Lexington-based company guilty Friday on all counts of defrauding thousands of investors nationwide of $18 million.
The jury convicted James Norman Turek, 66, of Lexington on eight counts of securities fraud and five counts of tax fraud.
After the verdicts were returned, U.S. District Chief Judge Jennifer B. Coffman found that Turek was a flight risk, and he was taken into custody by a U.S. marshal. Coffman scheduled sentencing for Sept. 27.
Turek faces a maximum prison sentence of 20 years on each count of securities fraud and three years on each count of tax fraud. However, Coffman must consider sentencing guidelines and the applicable statutes before imposing the sentence.
The trial was prosecuted by Department of Justice's trial attorney Kenneth C. Vert and Assistant U.S. Attorney John Patrick Grant. Asked whether any investors will get any money back, U.S. Attorney Kerry B. Harvey said it is "too early to know that."
"Certainly, we will make every effort, using the tools available to us, to try to get restitution for the victims," Harvey said. "We're closer to the beginning of that process than the end."
Defense attorney Elizabeth Hughes of Lexington had no comment.
A 2011 indictment alleged that Turek engaged in a securities-fraud scheme from 2004 to 2006 in which he promoted Plasticon International Inc. stock by releasing false and misleading information about the company. Plasticon was a penny stock company and made recycled plastic products but had few sales, according to a release from the U.S. attorney's office.
According to the evidence, from 2004 to 2006, Turek lured about 8,500 investors to buy Plasticon stock by falsely claiming that Plasticon was profitable when he knew that the company was losing millions of dollars.
In statements to investors and in press releases, Turek also falsely claimed that the company owned valuable patents.
The evidence showed that Turek told investors that he was working for nothing when he was stealing millions of dollars from Plasticon. Turek stole the money by issuing billions of shares of company stock to himself.
Turek, who was president of Plasticon from about 1994 to 2007, claimed on false and backdated documents that he had previously lent money to the company. In order to execute the scheme, Turek transferred the stock to the names of friends and relatives, including his deceased aunt, before selling the stock to unsuspecting investors.
The evidence also showed that Turek filed false tax returns from 2003 to 2007 by failing to report about $12 million that he stole from Plasticon.
The trial began June 11. The jury deliberated for about 90 minutes Thursday and for nearly three hours Friday before returning the verdicts.
Harvey said securities and tax fraud cases are "very complicated."
"These cases require a team effort and hundreds of hours poring over thousands of documents, and a lot of good old-fashioned police work coupled with very sophisticated financial analysis," Harvey said.

I sat after my testimony and listened for an hour to the FBI's testimony and exhibits. He ran quite the scheme. 10K's had fraudulent statements concerning listed promissary notes and shares issued to himself against those fraudulent promissary notes. On and on it went! Thanks scion for keeping us informed over the years. The neyseyers were 110% correct! I was told there were approx. 8000 shareholders over a period of years. Some individuals lost $100's of thousands. It's very sad but at least justice was served! The FBI and prosecuting team did an excellent job on a case that looked to be very laborious. I saw carts with boxes of documents and binders full of exhibits. I am anxious to hear the sentencing! GLTA!

I went to court today to testify.I saw Turek for the first time he is a short fat bald guy.He looked like a bum lol.I got the sense that the defense is going to paint him as a victim of the company failure too and not the cause for the failure.

Yes, it is time for jimbo and crew to pay their overdue dues. many old longs like myself have been contacted by DOJ.
Howe, Murphy, Turek, his son, Holland, Big Apple all of them need to be put on the stand to testify.
I lost a lot of money based on Turek's lies and deceit. I won't get any money back unless we find his off shore accounts but until then 20 years of his life will have to do.
Shame on me I should have known when I asked him who was selling his products and he couldn't answer the question other then he and his son.
My life goes on hopefully his does too but in jail.
Spoke to the agent this morning. Very kind guy which is great but it won't get any of our money back. Discussed my investments and other details concerning me and my investment. We won't get any money back since there are no assets but it's good to know that Turek won't just ride his fat azz off into the sunset. What an A-Hole.
