Larry Robbins' hedge fund Glenview Capital has disclosed a position in KV Pharmaceutical (KVPHQ). The firm filed Forms 3, 4, and 13D with the SEC regarding shares. Per the filings, Glenview has disclosed a 13.6% ownership stake in KVPHQ with 6,661,983 shares.
The filings show that they acquired shares between July 24th and August 2nd at prices ranging between $.2943 and $.5899. In August 2012, the company filed petitions for relief under Chapter 11 of the US Bankruptcy Code.
This guy just spent nearly $3 MILLION of his own money in the past week on this company. CH11 was in 2012.

They were probably betting that the S.959 bill would be passed before the bankruptcy deadline... Now that it's clear that the bill won't be passed by then is probably the reason for the major sell off.

As promised, we said that we would "continue to monitor the story for positive or negative developments related to the bullish or short thesis" on K-V Pharmaceuticals (OOTC:KVPHQ). We've been informed by a third-party that the U.S. Senate may take their month-long recess at the end of today's work session.
After speaking with someone from the Majority Health Policy Office for the HELP (Health, Education, Labor, and Pensions) Committee, we've confirmed that the Senate is scheduled to break for recess at the end of the work day - 5:00 P.M - on Friday, August 2 (for all intents and purposes, August 5). The Senate's month-long summer recess was originally scheduled to begin on August 5, and extend through September 6. Furthermore, as of right now, the Senate is only scheduled to meet for nine days in the month of September.
In light of this news, we are concerned that it will not be able to pass Bill S.959 before the September 12, 2013 Chapter 11 deadline that we discussed in our report, "New Information Sheds Additional Light on K-V Pharmaceuticals Bankruptcy Story."
Holding onto K-V shares at this point proves to be a much riskier proposition than it was at the time of our article. At this point, the bullish thesis depends on an equity committee being formed in order to delay the Chapter 11 confirmation process. We have significantly pared back our long position and will consider going short if we determine that the bill will not get passed by the Senate before this weekend.
If K-V is able to resurface on the other side of the current Chapter 11 proposal, we will certainly revisit another bullish thesis. Ultimately, we do feel that Bill S.959 will pass.

Yeah I stayed away from this one today. Not sure what to make of it. I did read that BK is a possibility.
I just found this article - linked from the Penny Stock Blog site - definitely shady; however, PPS may have another up day tomorrow. I did not trade this one today and don't hold any right now.

meaning shares don't exist and are worthless...
I sold out wayyyyy back in the .20 area I think(I'm not sure) -
The run up was amazing to watch - I didn't feel comfortable buying ticker that has already been told it was being cancelled - but at the same time news reports of their sales staff hardballing doctors and hospitals to buy the KV product over their competition because the competition had problems(I don't remember exactly what the article said).
This could run to $100 a share - but on the day it exits BK it is ZERO. The risk/reward for me is too heavily risked to the possible reward................if you don't get greedy and stay 1 second longer than you should have and wind up with nothing but tax losses.
But yes it was a wild run and I'm sure those who perped it are long cashed out at this point and on to something new.

If these shares don't survive, this will go down as one of the more impressive pumps I've seen in a long time. I've watched this one on and off ever since it filed. I looked at the recent run with absolute incredulity from the sidelines. There was serious volume all the way up to .80. Still curious to see what happens here.
Current shares are being cancelled - that is why everything says "new common stock" or "new warrants".

I got trapped for over a year! Bought pre-chp11 and am very, very gr8fl to have bailed on that spike to 82. Got out at 73 and actually made a minuscule profit when I had written this one off as a loss in my mind but never sold. Happily surprised...

The shares are getting canceled. This filing indicates how they will have convertible notes and rights to the new shares. If you notice they only have a little over 600 common shares, which is hardly anything.

Where exactly in the filings does it say the common will be cancelled?
What judgement needs to be made in Bankruptcy court before the common is cancelled? Or is it simply up to management?
Can you give some examples of previous cancellations?
