Under what circumstances is a company entitled to a hearing?
A listed company that has received a delisting determination letter from NASDAQ may appeal that determination by requesting a hearing. A company that has been denied initial listing may also appeal the denial by requesting a hearing. When NASDAQ determines to delist a company due to its failure to meet continued listing standards, NASDAQ will send a delisting determination letter, which will include the basis for the delisting and instructions on requesting a hearing to appeal the delisting. The company has seven calendar days from the date of the determination letter to request a hearing. Failure to request a hearing within seven calendar days will result in the suspension and delisting of the company's securities under the terms of the delisting determination letter. When should the company request a hearing? Will our securities be delisted before we attend a hearing?
The company must request a hearing within seven calendar days of the date of NASDAQ's delisting determination letter. In most cases, a request for a hearing will "stay" the delisting pending a decision by the Hearing Panel in most cases - meaning no delisting action will be taken until the company has had its hearing and the Hearing Panel has issued a written decision. However, if the company's deficiencies include the failure to timely file a periodic report, the hearing request will stay the delisting only for a period of 15 calendar days from the date the request is due. This 15 day automatic stay generally expires before a hearing is scheduled. A "late filer" may, however, request that the 15-day stay be extended until the hearing takes place and a decision is issued. This request for an extension should accompany the request for a hearing, and should explain why the company believes an extension is appropriate. (Updated: June 24, 2011)
Are there fees associated with a hearing?
Yes. The fee for an oral hearing is $5,000. The fee for a written hearing is $4,000. NASDAQ requests that the hearings fee be paid concurrently with the hearings request by wire transfer according to the instructions on the payment form sent with the delisting determination letter. If you do not have access to wire transfer, you may pay by check, payable to The NASDAQ Stock Market LLC. Checks should be sent by courier/overnight service to the address contained in the delisting determination letter.

Cuban, no offense buddy, but I think it's time you understand that the warrants are EXPIRED. I know you had hopes of using the money towards a very good cause and I feel for you, but the writing is on the wall, warrants are expired, therefore deemed worthless. Sorry buddy. On to the next play...

Thanks Ernie...learned something new here, only lost a few bucks but it did seem to be in somewhat limbo until this morning even though it was stated they would be worthless, was actually just wanting one more day hoping the other true "long" holders/insiders had a final dump day, too bad lots of people lost a ton of money that were paying .50+ a share over the last year and a half... no worries here as I am smarter for it which is a win still.

Hopefully peeps didn't put a ton of $$$ not this. I lost a couple hundred. Small risk for a potential huge reward. It is what it is. I'm sincerely sorry to anyone who lost big here.
