What I'm trying to say is that to enter these forums saying "this is garbage", "i'm bearish", etc... is the easiest way to be Mr. Right. It's like me saying that this year's winner of spanish football (soccer) league is going to be Real Madrid or F.C. Barcelona (they win almost all of them).
To enter a stock and have minor gains, has merit.
But the real achievement here, what brings real credit, is to pick hugely undervalued stocks bashed by everyone and to make XXXXX% profit, being cold and smart enough to wait for the right time to sell.
Of course, perhaps DCTH is not the right stock to pick (who knows), but if someone shows me success picking rightly, he/she deserves real credit. People saying "this is hell" are only telling what everyone actually know or should know.

The guy laughed at me when I took a 12% profit the other day. It was great money to me in penny stock land. Your aforementioned statements are on the money.
What I've learnt about stocks in general, and especially regarding penny stocks, Nasdaq, OTC..., is that it's all about pure speculation and share price hasn't nothing to do with fair value / reasonable capitalization. Furthermore; speculative movements can last a very short time; even only seconds. So forget about million outstanding shares out there, fundamentals, trials, and whatever. This can go straight to dollars or to sub pennies suddenly and for absolutely NO reason.
Why pessimistic statements are often right? No mystery at all; myself could go to all of OTC (or even Nasdaq) forums, make pessimistic statements about all companies, and be no less than 80% right overall. This is a very risky market for a reason: It is full of companies with huge financial and regulatory troubles.
How do you know this?

Where specifically in the leak out agreement gives them the ability to sell these shares when they are expressly prohibited from selling for 15 trading days?
Everybody should be on board with starting this week, sell down of 123 million shares the remaining legacy of convertible. First 15 million was announced as first stage. We are now in the dark trying to interpret the playing out of this process. We all expect maxm to be active tomorrow.

Where is this 123M number coming from? Shares cannot be sold until January 19th, I believe.
That's pure speculation of course, partly based on the belief that at current pace 6 million shares per day ie end of January to sell 123 million. 3 cents even maybe, but maybe 50 plus percent chance of 15 to 20 bagger from that price, I will likely be buying with conviction.
For what she's done to folks she shouldn't be paid at all ever again , in fact should pay back some to folks that he/she stole

With the amount of shares needing to be issued and the "premium" the noteholders got (50% ROS at .03 sales)...I expect this to break the .044 and hit .03.
On that day though we could trade 100M shares and clear 30-40M.
I think this stock has to dig in and work its way through its usual challenges without the benefit for months to come of anything dramatically good. People rightly are not going to embrace the idea of a buyout. My guess is management sees things that way as well and they have in mind their best strategy, this is just a place where one needs to breakout the analysis tools every day as investors.
We all have cooled on hitting 10 cents or better, now it serves as a challenge.

Why this agreement structure and why now?
I assume the note holder had to agree to this structure? They basically are getting 120M shares for $2.2M owed -- so around 2 cents a share for conversation sake. So they obviously didn't need to do it --- so I'm assuming they are confident that they could get a premium for their shares by taking them all now.
The company clearly was OK giving out a discount to get rid of the note...for what reason?
To me it is either they have new long term funding lined up where they maybe wanted certain collateral on the patents and/or acquisition...and/or maybe they truly just like screwing the commons :)
I'm not a day trader so I approach this that sometime in Q1 there will be 230M shares O/S (Excl warrants) and at $0.04 a share it's market cap is $9M.
Still feels cheap to me....
And no one talks about Europe sales growth, the elimination of interest expense, etc.
I'm a buyer in the $0.03-$0.04 range...won't chase though - no way do I see this getting past $0.05 now in the next few weeks with the dilution ahead.

The fact that the IDMC...whom are requested by the FDA to look at the safety data for the treated patients in the trial already did their look and "Recommended to continue without modification" says to me that Positive Phase 3 results are around the corner.
Fact is, that it is the job of the Independent Safety Monitoring Board/Committee to recommend termination of the trials if they see any issues that could cause harm to the patients. Those beyond normal expected and/or accepted side effects.
No significant events says to me that the Efficacy and Pharmacokinetics of the trial vs. standard of care will be a slam dunk seeing as hundreds of procedures have already been conducted in Europe! More than 100 at a single hospital. Approved care in EU will soon be an approved care by the FDA!

The noteholders will run out of shares, it is not the same death-spiral financing that the shorts here would have you believe. They were promised 112,000,000 shares, and that is it. What price they chose to execute at is entirely up to the holders of those notes. Should they chose to sell at .05 or .02? who knows? I however know that I would chose the higher PPS to sell, but a profit is a profit, so let them sell, and I will buy!

I'd be a buyer down there too.
Athenex will be buying DCTH by end of 2nd Qtr. of 2018. No debt, millions in tax losses and nearing end and approval by FDA. Long term shareholders won't share takeover because of 3 reverses in 8 years, but current shareholders from .50 to lows of .04 will do great.
The problem is not seen as efficacy for the small OM market, the question is whether delcath is currently seen as commercially attractive. the company will be lucky to ever achieve $100 million revenue unless it can finish a robust ICC trial that may start soon
lack of adequate investor support has been true for about 2 years which contradicts that the phase 3 should be seen as a big deal, it is a cloudy picture on enrollment, but efficacy is extraordinarily key but currently the least of all delcath worries
