The terms of the pact are confidential, the Sunnyvale, Calif. company said. The legal action began in 2007 between Sun Microsystems, which was bought by Oracle, and NetApp. Oracle and NetApp agreed to seek to have the lawsuits dismissed without prejudice.
BMW August unit sales up 12.5%
(5:31 AM ET) LONDON (MarketWatch) -- German car maker BMW /quotes/comstock/11e!fbmw (DE:BMW 45.60, +0.71, +1.58%) said it delivered 103,239 automobiles worldwide in August, representing a 12.5% increase from a year earlier as sales in China grew rapidly. The company said sales of BMW brand vehicles rose 16.3% to 88,0007, more than offsetting a 6.7% fall in Mini sales to 14,986. Mini sales had been expected to fall because a new range of models is being introduced from mid September. "Asia -- and China in particular -- was the most powerful force driving our sales growth once again in August," said Ian Robertson, the management board member responsible for sales and marketing. Total BMW and Mini sales in China so far this year are more than 106,000 -- more than the car maker sold in the country for the whole of 2009.
Morrison profit down 7.5%, comparable sales rise
(2:42 AM ET) LONDON (MarketWatch) -- Morrison Supermarkets /quotes/comstock/23s!a:mrw (UK:MRW 289.90, -2.60, -0.89%) said Thursday that its fiscal first-half net profit slipped 7.5% to 286 million pounds ($442.8 million) as revenue rose 9.1% to 8.14 billion pounds. Excluding a one-off gain a year earlier, the group said underlying pretax profit was up 14% at 410 million pounds, broadly matching expectations, as it also lifted its interim dividend by 14% to 1.23 pence a share. Comparable sales in the period were up 0.9%. "Our first half performance has been solid, in a tight market. At a time when value is a priority for everyone we have continued our run of market beating sales growth, attracting more customers to Morrisons than ever before," said Chairman Ian Gibson. The supermarket chain said it expects low market growth to continue in the second half of the year, with further pressure on consumers.
Home Retail sees profit at low end of expectations
(2:33 AM ET) LONDON (MarketWatch) -- Home Retail Group /quotes/comstock/23s!e:home (UK:HOME 213.70, -7.70, -3.48%) said Thursday that it expects benchmark pretax profit for the first half of the year to fall by between 20% and 25%. The general merchandise and home improvement retailer said that for the full year it is expecting benchmark pretax profit of 250 million pounds ($387 million) to 275 million pounds, which it said is "in line with the bottom half of the current analyst range." In the first half of the year, the group said comparable sales at its Argos stores fell 6.5% and comparable sales at its Homebase chain slipped 0.8%.

Kia to recall 35,000 cars in U.S., report says
(9:00 PM ET) SYDNEY (MarketWatch) -- South Korean automaker Kia Motors Corp. /quotes/comstock/11i!kimtf (KIMTF 0.00, 0.00, 0.00%) said Friday that it will recall 35,000 vehicles in the U.S. due to defective wiring, according to a Yonhap news report. The auto maker reportedly said that defective interior lighting wiring could cause fires. The move covers about 24,000 Soul hatchback wagons and 11,000 Sorento sport utility vehicles made between last September and June this year, the report said. Kia Motors is nearly 40%-owned by Hyundai Motor Co. /quotes/comstock/11i!hymt.f (HYMTF 20.50, 0.00, 0.00%) . Shares of Kia traded down 0.8% in Friday morning action, compared to a 0.3% gain in the benchmark Kospi index. Shares of Hyundai Motor rose 0.4%.
H&R Block reports $131 mln quarterly net loss
(4:19 PM ET) SAN FRANCISCO (MarketWatch) -- H&R Block Inc. /quotes/comstock/13*!hrb/quotes/nls/hrb (HRB 13.49, +0.92, +7.32%) reported a fiscal first-quarter net loss of $131 million, or 41 cents a share, late Thursday. That compares to a net loss of $133.6 million, or 40 cents a share, in the same period a year earlier. The net loss from continuing operations in the latest period was $114.8 million, or 36 cents a share. That excludes severance costs of 4 cents a share, the tax preparation company said. Revenue in the latest quarter was $274.5 million, down by $1 million from a year earlier. H&R Block was expected to lose 41 cents a share, according to the average estimate of analysts in a FactSet survey. Analysts were expecting sales of $268.5 million on average, according to FactSet. H&R Block shares rose 3.4% to $13 in after-hours trading on Thursday.
Take-Two swings to profit for third quarter
(4:01 PM ET) SAN FRANCISCO (MarketWatch) -- Take-Two Interactive Software Inc. reported a surprise profit for the July quarter on Tuesday thanks to strong demand for "Red Dead Redemption" and other video game titles. For the third fiscal quarter ended July 31, Take-Two reported net income of $5.9 million, or 7 cents a share, compared with a net loss of $56.5 million, or 73 cents a share, for the same period last year. On a non-GAAP basis, the company said it earned $26 million, or 28 cents a share. That figure excludes certain stock-based compensation items as well as charges related to discontinued operations. Sales jumped more than 273% to $354.1 million. Analysts were expecting a loss of 9 cents a share on a non-GAAP basis on sales of $294.7 million, according to consensus estimates from Thomson Reuters.
Burger King to be acquired for $4 billion
(9:28 AM ET) NEW YORK (MarketWatch) -- Burger King Holdings Inc. /quotes/comstock/13*!bkc/quotes/nls/bkc (BKC 23.53, -0.06, -0.25%) said Thursday it will be bought by private equity firm 3G Capital for $24 a share, or $4 billion, including the assumption of debt. The deal values the fast food company at a premium over its closing price of $18.86 a share on Wednesday. The deal comes after days of reports that the company would go private.
TJX Cos. same-store sales rise

Nordstrom same-store sales beat estimates

Norstrom said same-store sales at full-line stores rose 7.8%, ahead of analyst estimates of 7.7%. Same-store sales at rack stores fell 4.2%, behind consensus predictions of a 2.3% fall.
Gap's same-store sales remain flat in August

Del Monte fiscal Q1 profit inches higher
(8:13 AM ET) NEW YORK (MarketWatch) -- Del Monte Foods Co. /quotes/comstock/13*!dlm/quotes/nls/dlm (DLM 12.83, -0.33, -2.51%) said on Thursday that its fiscal first quarter profit rose a bit, to $59.4 million, or 29 cents a share, from $58.6 million, or 29 cents a share a year ago. Net sales for the period slipped to $804.6 million, from $813.7 million. Analysts polled by FactSet Research had expected the company to earn 27 cents a share on revenue of $830 million.

Limited same-store sales rise 10%

TD Bank profit up 29% as impairments fall

The group said total revenue for the quarter increased 2% to C$4.74 billion, while provisions for credit losses shrank to C$339 million from C$557 million a year earlier. Adjusted earnings for the quarter fell to C$1.43 a share from C$1.47 a share. Analysts polled by FactSet Research had been expecting earnings of C$1.44 a share. The company said its Canadian personal and commercial banking unit posted record results for the third consecutive quarter. "Wholesale banking earnings continued to normalize, performing in line with expectations despite tougher markets in the quarter," the group said.
Vimpelcom's second-quarter profit drops 52%
(6:53 AM ET) FRANKFURT (MarketWatch) -- Russian telecommunications firm Vimpelcom Ltd. /quotes/comstock/13*!vip/quotes/nls/vip (VIP 14.94, -0.26, -1.71%) said Thursday its second-quarter net profit dropped to $334.7 million, or 28 cents a share, from $700.5 million, or 69 cents a share, in the same period a year ago. Analysts polled by Dow Jones Newswires expected net profit of $376 million. Revenue rose 23% to $2.64 billion from $2.15 billion, exceeding expectations of $2.60 billion. "Revenues increased substantially as a result of both Kyivstar consolidation and strong organic growth across all key segments of our business," VimpelCom Chief Executive Alexander Izosimov said in a statement. "The mobile segment in Russia delivered its highest ever quarterly ruble revenues."
Stage Stores comparable sales up 0.5%

Wet Seal August same-store sales up 1.1%

Profit margins improved despite "a very challenging and promotional retail environment," Chief Executive Ed Thomas said in a Thursday statement. Inventories at Wet Seal and Arden B stores "continue to be well-positioned as we move into the fall season."
Costco August same-store sales up 7%

Net sales climbed 9.3% to $5.9 billion from $5.4 billion. A survey of analysts by Thomson Reuters produced a consensus estimate of same-store sales up 4.2%. The August sales reflected increases of 6% in the U.S. and 11% internationally, Costco said in a Thursday statement. Excluding gasoline, total same-store sales for August rose 5%, compared with the Thomson Reuters estimate of 3.6%. For fiscal 2010 ended Aug. 29, same-store sales rose 7% overall, reflecting rises 4% in the U.S. and 19% internationally. Net sales for the year rose 9.2% to $76.3 billion from $69.9 billion. Both fiscal years included 52 weeks.

Evraz cautious over economy as loss narrows
(2:53 AM ET) LONDON (MarketWatch) -- Russian steelmaker Evraz Group /quotes/comstock/23u!e:evr (UK:EVR 26.15, -0.60, -2.24%) said Thursday that its first-half net loss narrowed to $267 million from $987 million a year earlier as revenue for the period grew 39% to $6.26 billion. Adjusted earnings before interest, taxes, depreciation and amortization were $1.15 billion. Analysts polled by Dow Jones Newswires had expected Ebitda of $1.2 billion on revenue of $6.46 billion. The company said a measured recovery in the first half of the year allowed it to fully utilize capacity, while prices rose for the first four months of the period, before undergoing a correction in May and July. The group said that, excluding non-cash and one-off transaction, it would have made a net profit of $284 million. "The wider global economy and, in turn, the steel industry, continue to face challenges and despite positive price and volume dynamics, the pattern and resilience of the global economic recovery remain questionable," the company said.
DSG International comparable sales rise 3%
(2:39 AM ET) LONDON (MarketWatch) -- U.K. electronics retailer DSG International /quotes/comstock/23s!e:dsgi (UK:DSGI 26.06, +0.87, +3.45%) said Thursday that comparable sales in the 12 weeks to July 24 rose 3%, helped by strong sales of TVs in the lead up to the soccer World Cup. The company, which plans to change its name to Dixons Retail, said it also received a boost from demand for Apple Inc.'s /quotes/comstock/15*!aapl/quotes/nls/aapl (AAPL 255.20, +3.03, +1.20%) iPad and that overall trading was in line with expectations. "The store transformation programme is making rapid progress and continues to improve the shopping trip for customers. Our international businesses have also performed well against competitors in varied market conditions," said CEO John Browett. He added that the group remains cautious about the economic outlook.
Pernod Ricard '10 net up 1.2%, sales off 1.7%

For the year ended June 30, the producer of Chivas Regal Scotch, Beefeater gin and Mumm's Champagne, among many other brands, earned 978 million euros versus 966 million in the year earlier. Sales slipped to 7.08 billion euros from 7.2 billion. Organic sales, usually excluding acquisitions, rose 2%. Profit from recurring operations fell 2.8% to 1.8 billion euros; on an organic basis, recurring-operations profit rose 4%. Gross profit as a percentage of sales was 59.6% against 58.4% in fiscal 2009. Pernod Ricard declared a final dividend of 0.73 euro a share, bringing the total payout for the year to 1.34 euros a share.
Wimm-Bill-Dann net off 32%; dairy margins trimmed

Net was $35.9 million against $52.3 million in the year-earlier quarter. Revenue reached $639.8 million from $554.6 million. The company sold more products in dairy, beverages and baby food and pricing across all segments was "favorable," Chief Executive Tony Maher said in a late Wednesday statement. Demand is "back to levels we have not seen since before the global economic crisis," he said. But challenges in purchasing raw milk trimmed profit margins in the dairy segment, he said. Groupwide gross margin narrowed to 31.8% in the quarter from 35.2% a year earlier.
