ChanBond Avoids Institution of Six Cisco IPR Petitions

ChanBond sued several cable company defendants alleging patent infringement of three wideband signal distribution system patents in the District of Delaware in 2015. The defendants included Atlantic Broadband Group, Bright House Networks, Cable One, Cablevision, Cequel Communications, Charter Communications, Comcast Communications, Cox Communications, Mediacom Communications, RCN Telecom Services, Time Warner Cable, WaveDivision Holdings, and Wideopen West Finance (District of Delaware case nos. 15-cv-842 to -854). Non-party Cisco filed eight IPR petitions against the three ChanBond patents in September 2016, and a stay was ordered on March 3, 2017 pending the PTAB’s decisions to institute IPR.
Cisco’s IPR petitions had mixed results. The day the stay was ordered the PTAB instituted inter partes review of claims 1,2, 5, 6, 19, 20, 23 and 29 from US Patent 7,941,822 (IPR2016-01744), but denied institution of claims 13 and 14 in a second IPR petition of the ‘822 patent (IPR2016-01746). (Note: RPX filed an IPR petition on claims 1-31 of the ‘822 which was instituted for trial and oral arguments were held in January 2017. A final written decision has not been issued by the PTAB yet. See IPR2016-00234.)
On March 29, 2017, six IPR petitions for US Patent Nos. 8,341,679 and 8,984,565 were denied institution. The denial was based on a difference in opinion about the broadest reasonable interpretation for the term “RF channel,” which affected every claim Cisco sought to have reviewed. (For brevity, only the documents relating to IPR2016-01898 will be referenced in the following discussion, since the other 5 IPR petitions were denied on substantially identical grounds in the remaining five proceedings: IPR2016-01899, -01900, -01889, -01890, and -01891).
Cisco took the position that “RF channel” encompasses not only radio transmissions in different frequency bands, but also radio transmissions that can be in the same frequency band that use a code multiplex to encode the transmission into different “channels.” Cisco proposed a construction for “RF channel” that “includes ‘an RF path for transmitting electric signals.'” (Petition at 13, citing the ‘679 patent at 6:62-65.) Cisco’s prior art was also directed to Code Division Multiple Access (CDMA) systems which rely on spread spectrum (“a wideband channel,” as stated in Ex. 1002, ¶ 58) as opposed to different transmission bands.

ChanBond filed Preliminary Responses that rejected such a broad interpretation of “RF channel,” asserting “the invention is directed to using multiple separate RF channels to transport a data stream — a specific type of frequency-division multiple access (FDMA).” (Prelim. Resp. at pp. 6, 14-24.) ChanBond asserted that Cisco’s CDMA prior art “is the polar opposite of [its specific FDMA] invention.” (Prelim. Resp. at p. 7.)
Patent
The PTAB rejected Cisco’s assertion that multiple channels are multiplexed on the same frequency bands, and that code channels or CDMA channels could be an RF channel within the meaning of the ‘679 patent. The panel cited an inconsistent statement by Cisco’s expert which described a FDMA and CDMA hybrid system using Walsh codes: “[t]he mutual orthogonality of Walsh codes allows one particular coded channel to be isolated and decoded from all other coded channels, even though they are all broadcasting on the same RF channel.” (italics added by the panel). The panel reasoned that this statement referred to a particular frequency band as an “RF channel” and to divisions within the RF channel as “coded channels,” and therefore gave no weight to the expert’s testimony regarding the meaning of “RF channel.”
The PTAB concluded that the term “RF channel” as used in the ‘679 patent “does not include code channels – for example data streams created by CDMA– but instead refers only to frequency bands, such as those created by FDMA.” (Final Written Decision of IPR2016-01898, p. 13.) All six of the IPR petitions of the ‘679 and ‘565 patents were denied based on the claim construction issue and because Cisco’s grounds were based CDMA prior art.
It appears that the one year window after service to file IPRs has passed, so it will be interesting to see if a request for rehearing is filed by Cisco to challenge the panel’s decision. It is not clear if the interpretations proffered by the panel will somehow pose issues for ChanBond to enforce its patents as planned, but it has at least avoided further review of the ‘679 and ‘565 patents for now.

Law360, New York (March 30, 2017, 5:59 PM EDT) -- The Patent Trial and Appeal Board has denied six petitions for inter partes review launched by Cisco Systems Inc., shooting down the company’s bid to invalidate two high-speed networking patents held by ChanBond LLC.
In declining to review the two relevant patents, the PTAB said Wednesday that Cisco failed to show that the patents are likely invalid after ChanBond asserted the patents against a group of telecom companies.
ChanBond has been active in asserting the patents against major cable companies including Charter Communications Inc., Time Warner Cable Inc., Comcast Corp. and others, court records show.
In response, Cisco filed six separate IPR challenges with the Patent Trial and Appeal Board in September 2016. Now, the PTAB says Cisco has not proved that it can be successful in invalidating the challenged claims.
Both of the challenged patents cover a “system and method for distribution of digital signals onto, and off of, a wideband signal distribution system,” according to case documents.
Andrea Pacelli, an attorney with Mishcon de Reya New York LLP who represented ChanBond, told Law360 on Thursday that the board’s decision focused on two elements: claims construction regarding the term “RF channel” and analysis of potential prior art references that Cisco had put forth.
The board found that the term “RF channel” should be given the "broadest reasonable interpretation." As such, it does not include “code channels” such as data streams and only applies to frequency bands. The PTAB also said that asserted prior art references can’t be combined to reach the patents at issue.
“We agree with patent owner that petitioner does not show adequately that any of the cited portions of the prior art references teach modulating digital information into at least two separate RF channels as required by each of the challenged claims,” the board said.
Robert Whitman, lead attorney for ChanBond, said in a Thursday statement that the company was pleased that the PTAB agreed with ChanBond "on virtually all issues."
“The board’s decision confirms the strength of ChanBond’s patents,” he said.
Counsel for Cisco declined to comment Thursday.
The patents-in-suit are U.S. Patent Nos. 8,341,679 and 8,894,565.

As per usual, big money likes to short a stock with "legs" prior to earnings announcement, get a lower PPS , so they can buy more! Very common among experienced traders where you have anticipated a good earnings report forthcoming.

Forgot to add consensus numbers. 8 analysts have a average of .53 eps to report on 5/17, however, "whisper numbers" have a beat of .59 eps!

Just looked at 21 top rated analysts recommendations. 13 have a "strong buy",..6 have a "buy", and 2 have a "hold". EOY price target of 40. But who knows, however, no "sell" at all. NOT making a buy recommendation here, so ALWAYS do your own DD and make your own decision.
Am holding shares Myself, and will give it time to earnings and beyond assuming a good eps report forthcoming.

Cisco has plans to stop you in your tracks — if you’re illegally watching a pirated stream, that is. The San Jose-based company recently introduced a new technology known as Streaming Piracy Prevention, which”utilizes technology to locate illegal redistribution of content on the open internet and closed pirate networks.” And apparently, it’ll help Cisco deny access to illegal live streams, even if you’re in the middle of watching it.
Streaming Piracy Prevention, or SPP, works using a “forensic watermark,” which “identifies the subscriptions/sessions used to source the content, and shuts down the source through the video security system — all in real-time,” Cisco wrote in a blog post announcement earlier this week. And because the technology is completely automated, Cisco ensures “a timely response to incidents of piracy.” That means there’s no need for third parties to interfere, and that there’s now “an unmatched level of cross-device retransmission prevention and allowing service providers to take back control of their channels, to maximize their revenue.” Great news for service providers, potentially bad news for you (if you’ve a penchant for watching free TV).
With a 13% increase in the securities sector, it would be totally logical for Cisco to gobble up a security based company. Cisco Announces $320 Million Deal for Israeli Chip Maker

Cisco Systems Inc. said it had agreed to buy Leaba Semiconductor for $320 million, an Israeli company that designs networking chips.
The deal extends a recent spate of mid-sized deals by the networking giant, which has historically used acquisitions to build some of its biggest businesses. On Tuesday, Cisco announced a $260 million deal to buy CliQr Technologies, a startup that helps companies manage software internally or on external cloud services.
Cisco, based in San Jose, Calif., relies on a combination of internally developed chips and those purchased from external vendors for its routing and switching gear.
Leaba, a closely held company based near Tel Aviv, hadn't disclosed details of its product plans. But Cisco said it expects the startup's chip technology to contribute to advances in its hardware.
"By combining Leaba's semiconductor expertise with the Cisco engineering team, we will accelerate our plans for Cisco's next generation product portfolio and bring new capabilities to the market faster," wrote Rob Salvagno, Cisco's vice president of corporate development, in a blog post.
Leaba's founders previously started Dune Networks, a communications-chip designer bought by Broadcom Corp. in 2009 for $178 million. Their latest company was backed by several venture funds, including Bessemer Venture Partners, and Israel-based Pitango Venture Capital.
The Leaba team will report into Cisco's Core Hardware Group, led by Senior Vice President Ravi Cherukuri, Mr. Salvagno said.
