The ChromaDex-Elysium litigation is surely teaching us about the limits of the legal system. As an attorney, this troubles me immensely, because our legal system is one of the things that makes civic life possible. But clearly the procedural protections are subject to gaming, and we have twice seen -- once in New York and currently in Delaware -- judges who simply refuse to rule on motions.

I'm glad you're confident. I own shares in a young biotech that went through one of those horrible "shareholder suits". It was the old routine, an amateurish attack piece on the internet followed by a junkyard securities lawyer using it as the basis to immediately (ie, an hour later) "solicit" shareholders to file a class action, and of course using a professional nuisance shareholder to do so. Their hack lawsuit failed, but not after the judge let them amend their transparently baseless complaint several times, us spending millions of dollars in defense, and them not getting punished or reprimanded for plainly abusing the courts.
Justice would be these unethical lawyers be disbarred. Or am I getting something wrong?

Not coincidentally, judges are lawyers too. Its the police policing themselves. This is why the courts are not viewed perhaps as the bastion of justice that it should be.

It's almost like piracy. The incentives and laws aren't really fit to deal with pirates (or abusive lawyers) properly, so the problems perpetuate. The pirates (in this case these scamming securities lawyers) can operate between those lines and get away with it. I'm glad we didn't just give in; we fought them off. We should have made that abusive lawyer jump the plank, too, but the system failed us.

shares short figures from the last report on 12/31/2018 down 5%, so the rather larger percentage of the tribe of true nonbelievers appears to be slowly waning. We'll know more in a day or so as the new report is due out today.

With that share structure things could change in a hurry either way.

ChromaDex: The Bear Case

Probably nothing. The important litigation now is before the Patent Trial and Appeal Board (should be resolved this month), and in federal court in California (trial in July) and Delaware (just getting started). ChromaDex is asserting claims for patent infringement and trade secret theft that could result in significant damage awards. Elysium will be trying to invalidate or otherwise evade ChromaDex's patents, either of which could have a big impact depending on who wins.

The FDA matter is now gone, and the remaining false advertising and unfair business practices claims in New York seem relatively unimportant, but I might change my mind depending on what develops there.

In sum: If either side wins on the big claims, or if investors think that the litigation is going to go away entirely, that would be more likely to influence the share price.

Stay tuned for the PTAB determination later this month (if not delayed by the government closure). If Elysium loses there, again, too, then people might start to conclude that their claims are specious and the litigation is not likely to go their way.

Could be several things. Our EV is already well over $100MM. But it's great news nonetheless and if it results in our Niagen going into a lot of products it will mean big future revenues. Share price will follow.

The stock climbed %25 on heavy volume in a bear market right before the holidays, what more did you want. Tough times these days for stocks trying to hold gains. So many daily flippers trading in and out due to market gitters.

Ultimately this lawsuit needs to go away and revenues need to climb, just a matter of time. This announcement on the heels of 3 billionaires being invested in the stock is telling me good times are ahead. Chromadex is in a sweet spot.

Very shocking that it barely moved.

Thanks for the reply Milarepa. My father in law is retired P&G and still receives a "care" package every year at Christmas time with some new products in it to try. Obviously like you mentioned no new products with Niagen in it yet.

Also Im following a company with an Alzheimers drug that activates the Sigma 1 receptor which claims to restore "cellular homeostastis" ultimately allowing for Mitochondrial production. Everything I read has Mitochondria production at the center of it.

With Niagen's claim its just a matter of time until Niagen will be tried by 10's of millions of people. The degree of its efficacy I believe is tied to absorption abilities of individuals in the gut. If Chromadex really wanted to up its human trial game it would start with studying the gut.

That's a good point about Nestle. If they thought ChromaDex's IP was at risk, they could at LEAST have waited four weeks to hear what the PTAB says -- maybe save $4M. But probably instead they decided that the '807 patent isn't even before the PTAB, and ChromaDex's IP looks okay and/or Elysium's invalidity story doesn't sound great.

Alternately, Nestle might have decided that Elysium's strategy made legal sense -- just set up your own supply chain and patents-B-dammed -- but apparently they did not see it that way.

As for P&G, I think their deal was that they were entitled to an exclusive if they could figure out a way to make NR stable in a lotion, which is what P&G patented, but P&G had sole responsibility for solving that problem, which they apparently did not solve, and so NR for sun protection and skin-lightening will have to wait until someone solves that problem.
