Well, spree, if you are contending that you "got into" this stock based on fundamentals rather than the lawsuit/short story, might I recommend that you read up on valuation models.
Or are you contending that there is a short that will be revealed independent of the failed lawsuit?
Good luck with your fantasy price, but I doubt you'll ever see the stock trade over a dollar again. There is little intrinsic value in the company, and the oft-touted short squeeze will never happen. Indeed, as time goes on, the get-shorty story will be thoroughly discredited as a toutish strategy that was used to prop up numerous worthless penny trash stocks.
Bottom line, I did not get into this stock for that lawsuit and I am confident the price will be above 10 dollars a share in the near term, and then I will leave it up to you and everyone on raging bull as well, to figure out why that happened
Why do you either consistently misinterpret my comments or invent comments that I haven't posted? If all you know is GMXX's price, then you know so little that you really shouldn't offer any opinion about it.
JAG lost because they (as represented by their attorneys) could not convince the Court (given three attempts) that they could make a case against the numerous defendants. Have you read the dismissal? I suggest that you do before you mischaracterize it further.

It was only an important case to those of us who have been following the get-shorty phenomenon for years. It was important because JAG was positioned as a kind of flagship among the penny trash who have been claiming victim status, and because the 'greatness' of its counsel was so often touted on the boards.
In the larger framework of the marketplace and the world in general, it was but a failed attempt by a company with a broken business plan that trades on the pink sheets, and as such not really very newsworthy.
All I know is what GMXX's price was, and you can't have it both ways you tell us Jag lost the case because of the ineptitude of the lawyers, now you say it is because of the evidence, just because it was thrown out does not mean they are not out there, the company would not go through this process otherwise

It doesn't work that way, spree. The reason that JAG lost its case is the they were unable to produce evidence that there was violation of the law by the numerous defendants. It is the responsibility of the claimant to produce evidence in support of a claim.

Our opinions may differ. Indeed, they seem to be in 180 degree opposition, but that is no reason to start RB-style namecalling here. Matt makes it quite clear that it will not be tolerated.
Spree-do you really not understand the simple and well documented facts: virtually every identified case of price manipulation in penny stocks involves artificially inflating their price; no single case of organized, or even disorganized, widespread "naked shorting" has ever been brought to light. O'Quinn is now 0 for 4 in his ballyhood cases, none of which have survived past preliminary motions to dismiss.
Think of that: in four cases involving nine initial and amended complaints the O'Quinn team has not been able to plead sufficient facts to get the suit past the very low bar required to go to discovery.
In fact, as regards penny stocks, the basic economics of margin requirements and the daunting logistics of actually efecting a short sale make even legal shorting of these securities virtually non-existent.
The whole myth no doubt arose from the mind of a pump and dump artist who needed a way to convince the gullible that the reason for the plunge in value of their stock was not the fact that the company had no value, but rather the result of mysterious "naked shorters" driving the price down.
You, patch, and the other fanatic adherents of this unfounded myth would rather believe that there is a widespread conspiracy including the SEC, dozens of brokerage firms and investment bankers, and even the DTCC/NSCCC, when the simple fact is that every single one of the companies crying naked short is, to all intents and purposes, worthless, engaging in ongoing and massive share dilution, and incapable of ever being a profitable enterprise.
JAG is a perfect case in point. The company has plummeting revenues, has announced one LOI after claiming an "acquisition" of an equally money losing company in no way related to JAG's core business. Even those were never consummated, but they each were accompanied by significant share dilution through conversion of discount CD's.
And now we have JAG's registration of yet another 25 million discount CD shares.
Jag sells shares to pay expenses, including the very generous salary and "bonus" grants to its executives, who obvously are totally incompetent to run their business. The company's current market cap of over $10 million is absurd based on any valuation model. Even if it maintains its market cap after the new share issuance, you can expect significant share price declines based simply on the new round of dilution.
So why does shorting, naked or otherwise, need to be invoked to explain the plummeting share price and almost total lack of trading in a company whose services people are disinclined to buy.

GMXX didn't run on massive short covering at all, but rather it ran on an orchestrated pump with most of the outstanding shares from the initial private placement locked up to limit the float. Of course, the promoter ICI's shares weren't locked. The 'short covering' was a (ahem) cover story.
Indeed, the smart money--the promoters and those with private placement shares--more than likely sold short as the orchestrated spike peaked, covering later with their cheap shares. The terms of the lock-up and private placement were never disclosed publically, so we don't know if there was an anti-shorting provision. From the price action at the top of the spike, I'd wager that there was no such restriction.

The problem you have is gmxx went up to 20 on zero lawsuits and jagh is in a similar situation, you can no longer illegally short the stock, now when there is positive news the illegal shorts will have to cover, just because the lawywer did a bad job does not change the fact they are in existence, have fun on the way up bashers
Yep; there were lots of different agendas at work, all of them good for some cheap laughs.
The 'motions' have provided convenient excuses for a host of penny trash stocks who jumped on the GetShorty bandwagon. The idea was perpetuated by the likes of ICI and Investrend, who used the concept as a centerpiece for promotion. Investrend has been noticably quiet about the JAG dismissal.
Gotta remember Sedona; if O'Quinn etc can't get that one to trial they should tell their families they're going out to buy cigarettes & never come back. (Motions to dismiss have been filed; SDNA response due next week.)
I think all of this probably started with SDNA, in many respects. If you recall the original litigation, the financiers and apparently the brokers concerned (LT, Wellington, others) all gave in almost immediately once SDNA started to do discovery. A while later you get the SEC action against Thomas Badian, and later still the DoJ steps in.
All of the subsequent get shorty cases look like discovery fishing exercises hoping to find similar vulnerabilities, presumably with a view to forcing big settlements, against a background of whatever damaging publicity could be whipped up. If you get access to enough records probably you can find something damaging in any brokerage or IB.
Apart from anything else, this strategy foundered against the rock of the PSLRA & its mandatory discovery stays. You can't just go fishing; you need to assert a set of facts which are specific as to who, when what etc and which, if proven, have a strong chance of winning your case for you. O'Quinn were never able to do this well enough to get to discovery.
IMO they realized fairly quickly that the strategy wasn't going to work & have just been going through the motions for a while now.
It's clear that it's all over but the shouting, and that the final dismissal of the entire case is but a few formal gestures away. If JAG want to appeal, I expect that O'Quinn will make 'em put up a hefty retainer. Meanwhile, all the 'get shorty' nonsense can be put in a hefty container. LOL!
The ruling was pretty devestating, DD. I'd check out the status of the "financiers" but I just don't feel like doing the pacer stuff right now.
I suspect that they will be dismissed from the suit for the same reasons stipulated in the brokerage dismissal.

Attempts by the penny stock promotion community to create the impression of a national financial scandal brought about by "illegal naked shorting" of micro cap stocks trading on the NASDAQ OTC-BB service and the privately held Pink Sheets, Inc., were dealt another serious blow on September 3, 2004. On that date Presiding Judge Vanessa Gilmore, Southern District Court of Texas, granted a motion for dismissal filed by over seventy securities industry firms named in the case: Jag Media Holdings, et. al. v AG Edwards and Sons, Inc. et. al (CV 02-2867) Judge Gilmore noted in her lengthy order of dismissal that despite three attempts Jag Media's attorney John O'Quinn of Houston, Texas, had failed to provide minimum factual support of the suit's claims, and had failed to state a course of action. O'Quinn is a controversial trial lawyer who became national known because of his successful fraud prosecution of class action complaints against silicon breast implant manufacturers and against "Bib Tobacco," collecting tens of millions of contingency fund fees from the awards in those cases. O'Quinn, a controversial figure in Houston, entered the "illegal naked shorting" arena with much fan fare, hailed in penny stock press releases as famed trial attorney John O'Quinn. According to sources knowledgeable of his arrangements with penny stock companies he represented, O'Quinn initially agreed to take these cases on a contingency fee basis. The same source reports he subsequently required a $1 million retainer for new cases.
The pattern of O'Quinn's complaints was virtually identical in all cases file by him, or by firms affiliated with him. A small stock trading on the OTC-BB or Pink Sheets would name scores of brokerage firms, market making firms, and convertible debenture financiers of conspiring to "naked short" the hapless company's stock, driving its price into the ground. All filings were long on claims and short of factual support of the claims. The latest blow is his forth loss in similar claims in a row, and besides Jag Media, include dismissals of O'Quinn pleadings on behalf of Endovasc, GeneMaxx, and NuTex (now Datascension).Company promotional releases featuring his work in the remaining naked short suits refer to him as a "wealthy Texas attorney," Rather than as a "famed trial lawyer."
In some ways Jag Media was the poster child of the claims made of widespread "illegal naked shorting" that was driving down the share price of penny stocks. Jag's former CEO, Gary Valinoti had made numerous claims that his company-which has no significant assets or operations-and put his long suffering shareholders through three of what he termed "recapitalizations." These recapitalizations were, in fact, requirements that shareholders obtain and exchange paper stock certificates for a new issue of certificates. These exchanges could supposedly reveal the existence of "counterfeit" shares and cause a short squeeze, driving up the price of the stock as investors who had naked shorted the stock were forced to buy shares in the open market to cover their delivery commitments. The third recapitalizations, which also involved a move to certificate only trading, resulted in a prolonged period of almost total illiquidity, with shareholders awaiting delivery of their new shares being unable to trade. That prolonged illiquidity and yesterdays WSJ.com announcement of the ruling by Carol Remond has led to a 80% to 90% drop in Jag shareholder value. None of the claimed naked short position-Valinoti had once claimed that it was over five times the actual available shares of JAGH was ever revealed, and the final recapitalization has resulted in Jag Media being delisted from the OTC-BB services to the Pink Sheets.
To date Jag has made no public statement on the Judge's ruling, and InvestmentWire, which daily touts the latest "naked short" scandal in which hundreds of companies are "involved, did not report the story.

It's not "our" victory, wow. Certainly it is a victory for the plaintifs. And a crushing defeat for the mighty O'Quinn, who is now 0 for 4 or 0 for 5.
I guess he found it is much easier to indimidate Dow with the bad PR coming from sympathitic "victims" than it is to indimidate investment banks with reckless accusations about non existent conspiracies.

From the dismissal...
...there are multiple deficiencies within the Third Amended Complaint. Claims against Moving Defendants are subject to dismissal for failure to sarisfy Rule 9(b)'s and PSLRA's particularity requirements and failure to adequately plead scienter. Claims against Moving Defendants are further subject to dismissal for failure to plead specific misrepresentations or manipulative or deceptive acts by the defendants. Plaintiffs have had more than a year to state their claims, in addition they have had the benefit of thie Court's September 2003 Order as well as numerous motions to dismiss. The only conclusion this Court can come to by Plaintiffs' continued failure to meet the standards set forth in the Court's Order is the Plaintiffs do not have a viable claim against the Moving Defendants. Further, grounds for dismissal might well exist in Moving Defendants' arguments that the Court did not address. The extent of the deficiencies in the Third Amended Complaint is a strong indication that amendment would be futile.

US Judge Dismisses Jag Media's Fraud Case Vs Brokerages

NEW YORK -- U.S. District Judge Vanessa Gilmore last week dismissed Jag Media Holdings Inc.'s (JAGH) allegations of securities fraud and illegal short selling against dozens of brokerage firms and financial institutions.
Jag Media and Gary Valinoti, the company's former chief executive, sued over 100 brokerage firms, investment firms and financial institutions in July 2002, alleging that they entered into a civil conspiracy and concert of action to short sell Jag Media's stock. In the suit, originally filed in the Judicial District Court, Harris county in Texas and later removed to the U.S. District Court for the Southern District of Texas, Houston Division, Jag Media alleged that the financial institutions committed market manipulation and fraud and violated securities laws.
Judge Gilmore said in her order that she granted a motion to dismiss the case filed by 75 of the defendants because she found multiple deficiencies in Jag Media's third amended complaint. Gilmore found that Jag Media doesn't have a viable claim against those defendants.
More than 70 defendants had filed a motion to dismiss Jag Media's claim against them in November 2002, claiming that the company failed to state a claim, failed to allege any wrongdoing by any specific defendants and failed to properly claim fraud.
In September 2003, Judge Gilmore had found that Jag Media failed to establish that all or any of the defendants violated the securities exchange act. Gilmore said that Jag Media's second amended complaint lacked specifics and asked Jag Media to file an amended complaint.
Jag Media filed its third amended complaint in October 2003. The company alleged in that complaint that its case involves an initial scheme by three of the defendants - Mark Valentine, Thompson, Kernaghan & Co. and CALP II Limited Partnership - to defraud Jag Media into selling convertible preferred stock at less than fair market value. According to Jag Media, this initial scheme was followed by a second scheme in which brokers and market makers manipulated the company's shares for their own profit. Jag Media claimed that the financial firms used various trading tactics such as matched trades, washed trades, "painting the tape" and selling counterfeit, or non-existent shares.
(Jag Media alleged that brokerage firms illegally sold short its stock without first locating required shares to borrow. That process is known as naked short selling).
Jag Media, a provider of Internet-based equities research and financial information, alleged that this manipulative scheme forced the price of Jag Media stock lower, almost destroying the company in the process.
Judge Gilmore's ruling is a blow to Jag Media, a company that has been at the forefront of the claim by some small publicly traded companies that their stocks have been illegally sold short by brokerage firms and market makers. Jag Media recently completed a recapitalization of its stock, exchanging outstanding shares for new "certificate only" shares of common stock in an effort to make it harder for investors and brokerage firms to sell short its shares.
Jag Media wasn't immediately available to comment and it's unclear whether the company will appeal the judge's decision.
