Form 10-Q for ACUNETX, INC. - 23-Aug-2010
Quarterly Report Summary
Item 2 - MANAGEMENT'S DISCUSSION AND ANAYLSIS OR PLAN OF OPERATION
Business Overview
AcuNetx has invested substantial funds in the last several years, developing and validating its products. We produce and market the Infrared/Video VNG System, both as a branded product for our major distributor and under the IntelliNetx brand internationally and through independent distributors. For 2010 and 2009, the VNG line of medical products, and Hawkeye traffic sobriety testing devices, together accounted for virtually all of our revenue. While the VNG products are being sold into a relatively mature market, the Hawkeye market is in the beginning of its product life cycle.
Recent research has indicated that additional markets may be suitable for our VNG lines, and we will continue to explore those opportunities with our distributors and partners. Several ongoing initiatives are important to our future success. In 2009, we made several important changes to realign our resources.
First, we have accelerated marketing and sales of the HawkEye eye observation and recording system, now leased from VisioNetx, and this should allow AcuNetx management to address this market and generate revenues from the product. We believe that we have approximately half of the current, limited market for non-portable devices, and that our planned minor technological advancements to the Hawkeye line, rendering the devices fully portable, will open up to us a multi-billion dollar market in which we currently have established penetration.
Second, we continue to pursue sales and marketing activities for our IntelliNetx division, to take advantage of the growing global opportunity for balance assessment and fall prevention in the elderly, which we believe has the potential to develop into a substantial new market. For example, we have for the first time established an in-house sales group to sell to the recently untouched California market in our home state.
We believe that the OrthoNetx product line still has significant potential value in the marketplace, either for development or acquisition.
Additionally, the company is exploring the sale of OrthoNetx to one of several potential buyers who have expressed interest.
Results of Operations
For the three months ended June 30, 2010 compared to the three months ended June 30, 2009
Revenues from sales of our products for the quarter ended June 30, 2010 were $157,042 compared to $208,174 for the corresponding period in 2009, a decrease of $51,132 or 32.6%. With the current economic climate and the uncertainty on health care reform as to how it affects Medicare reimbursements cutbacks have created a difficult market place. We have reduced our selling price as an incentive but as of June 30, 2010 still experiencing slower sales. Gross profit as a percentage of sales was 83% and 72% for the quarter ended June 30, 2010 and 2009, respectively.
Total operating expenses were $92,225 and $363,151, respectively for the quarter ended June 30, 2010 and 2009, a decrease of 293.8%. The decrease can be attributed to lower stock option expense and other cost measurements that company has been vigorously implementing.
For the six months ended June 30, 2010 compared to the six months ended June 30, 2009
Revenues from sales of our products for the six month ended June 30, 2010 were $401,279 compared to $500,292 for the corresponding period in 2009, a decrease of $99,013 or 24.7%. With the current economic climate and the uncertainty on health care reform as to how it affects Medicare reimbursements cutbacks have created a difficult market place. While the numbers of units remained the same at 27 units in the first six months of 2010 and 2009, this was achieved by reducing the selling price. Gross profit as a percentage of sales was 77% and 73% for the six month ended June 30, 2010 and 2009, respectively.
Total operating expenses were $315,951 and $634,900, respectively for the six month ended June 30, 2010 and 2009, a decrease of 100.9%. The decrease can be attributed to lower stock option expense and other cost measurements that company has been vigorously implementing.
Liquidity and Capital Resources
As of June 30, 2010, we had $18,721 in cash or cash equivalents and $63,125 in inventory. Conversely, there was $1,701,751 of current liabilities, which included accounts payable of $455,177. We also had accrued liabilities of $1,017,354, and notes payable of $379,220, with an accumulated deficit of $12,812,455. We have no plans for significant capital equipment expenditures for the foreseeable future.
Management understands the comments in the auditor's report relative to the Company as a going concern. We have taken a number of actions, to obtain financing, significantly reduce expenses and conserve cash. We have also hired an internal sales force, to complement the occasionally inconsistent, and in some cases non-existent, sales by the company's network of representatives. All activities will as the HawkEye product for law enforcement applications, which continue to serve as our source of revenue. These activities will include maintaining the excellent relationships already formed with our suppliers, distributors, and customers. Any future expenses not related to this core business will be examined in the light of our current liquidity position before approval. Management believes that the plan that has been implemented will allow continuing operations and improvements over time. Notwithstanding the foregoing, however, to the extent that additional funds are required to continue operations, there is no assurance that the Company could raise working capital or if any capital would be available to the Company at all.
Off-Balance Sheet Items
We have no off-balance sheet items as of June 30, 2010.

Additionally, the company is exploring the sale of OrthoNetx to one of several potential buyers who have expressed interest.
RESULTS OF OPERATIONS
YEAR ENDED DECEMBER 31, 2009 COMPARED TO YEAR ENDED DECEMBER 31, 2008.
Revenues from sales of products declined by $121,132, or 11.5%, from $1,054,330 in 2008, to $933,198 in 2009. 2009 was a difficult year for the physicians who purchase our VNG systems. Given this economy’s tight credit markets in 2009, a significant problem for our physician customers was the inability to qualify for leases, given the much higher standards directed by the lessors. We are finding that the credit markets for our doctors are easing slightly so far this year. Additionally, we have heard from many physicians that the uncertainty of changes in Medicare reimbursements represented by the then-pending Healthcare Legislation was of enough concern to delay the purchase of a VNG system. In 2009, 66 IntelliNetx and private label medical systems were sold, compared to 66 of the same systems sold in 2008.
Two major distributors accounted for approximately 54% of our sales revenues in 2009, and in 2008 accounted for 45%. HawkEye™ eye observation and recording law enforcement system sales provided an additional $47,251 revenue (7 units) in 2009 compared with an additional $90,000 of revenue (15 systems) in 2008. For several months, the Company was unable to take purchase orders due to a software engineering redesign requested by significant customer feedback.
Gross profit declined from $684,079 (65%) in 2008 to $666,812 (72%) in 2009. That decline was due to lower sales revenues but offset by higher gross profit margins. The 2008 net loss of $715,696 decreased by $398,934, or 55.7%, to $316,762 in 2009. The decrease was due primarily to the renegotiation of a marketing agreement with a major distributor, lower stock option expenses and a decrease in selling, general and administrative expenses, which decreased $124,171, or 10.6%, from $1,174,663 in 2008 to $1,050,492 in 2009.
Inventory turnover ratio in 2009 was approximately 3.2:1, compared to 3:1 in 2008. Inventory was down $32,807, or 33.1%, from $99,020 at December 31, 2008 to $66,213 on December 31, 2009. Year end net accounts receivable totaled $12,165 on December 31, 2009, a decrease of $67,002, or 84.6%, from $79,167 on December 31, 2008.

DWI The Danger Of Alcohol Impaired Driving - Mentions HawkEye by AcuNetx
by John Cavers
in Law (submitted 2010-01-31)
Do you make it a practice to get behind the wheel of your car under the influence of alcohol? Do you feel that you are just fine and dandy and can drive a straight line even after consuming alcohol? Read this article to be enlightened about the dangers to your self and to others when driving under the influence of alcohol.
Drunk driving causes in excess of 20,000 deaths every year, that’s how dangerous it is to drink and drive. In many states across America the blood alcohol content (BAC) limit is being reduced from .10 to 0.8 because the authorities have realized that drastic measures are required to curb DWI offences. When you drive with a BAC above the legal limit it becomes a traffic infraction and you can be jailed, fined, sentenced, have your license suspended and your vehicle confiscated. The police the world over have very little tolerance for Driving While Intoxicated (DWI) and it no longer nets you a simple slap on the wrist in most countries.
The statistics of fatalities caused by alcohol impaired drivers are frightening to say the least. Every year thousands of people lose their lives because of driving while intoxicated. Thousands more lose their lives through no fault of theirs but just by being in the wrong place at the wrong time. The cost to the country’s exchequer due to these fatalities is horrendous and governments and law enforcement refuse to sit back and watch it happen anymore. The law is coming down very heavily on people convicted of drunk driving and more so on people convicted of killing or injuring another human being while under the influence of alcohol. If you are convicted and sent to jail for a specific term, rest assured you will be made to serve out the entire sentence. Leniency has gone right out the window on drunk driving!
In the early days field sobriety tests were administered in the form of walking a straight line, heel to toe and standing on one leg. With the advent of chemical testing for blood alcohol content the rules just got tougher and anything over the legal limit means you are going to jail.
One of the more modern methods to prevent drunk driving has been the invention and installation of the ignition interlock device. The American Beverage Institute is highly in favor of this gadget being installed in all vehicles believing it will prevent chronic drunk drivers from driving while under the influence. The ignition interlock device is calibrated to disable the vehicle if the driver’s blood alcohol content is at 0.02% but as this is way below the legal limit of 0.08% many people who just have two drinks at a dinner or reception tend to get penalized.
Another ultra modern device called the ‘HawkEye’ from AcunetX uses infrared light to test eye movement of the offender during the field sobriety test. When the driver is administered the nystagmus test where he or she has to follow the moving finger of the officer, the HawEye will help spot jerky eye motions that are a sign of intoxication. Eye movement is recorded and transferred to a computer.
Companies with a sense of civic responsibility and law enforcement continue to devise new strategies to make the laws harder on the drunk driver, so anyone contemplating driving while intoxicated is well advised to get a ride with someone else or take the public transport home.

Patent Granted on GenerOs EX, A Medical Device That Helps Bones Grow
Note: This company, OrthoNetx, is owned by AcuNetx
PRWeb
December 17, 2009
Dr. Randolph C. Robinson, a leading cosmetic and reconstructive surgeon at Park Meadows Cosmetic Surgery in Lone Tree, Colorado, has been granted a U.S. patent for the GenerOs EX, an internal distraction osteogenesis device designed to help lengthen long bones in the arms and legs. The GenerOs EX is FDA-approved and can be used to help correct a wide range of limb deformities, as well as to provide cosmetic height enhancement.
Distraction osteogenesis is a surgical procedure that works with the body's own natural healing process to promote healthy bone growth. During the procedure, the affected bone is surgically cut into two segments, and the GenerOs EX device is affixed to the bone. The bone segments are gradually moved apart during the distraction phase, allowing new bone to form in the gap as the body heals. On average, the bone will grow at a rate of one millimeter per day, or about an inch per month. After the desired length is achieved, the bone will consolidate and strengthen.
According to Dr. Robinson, "Growing bones may sound like magic, but surgeons have been using the principles of osteogenesis since the early 1900s. Until recently, however, the process required the use of awkward external frames and screws to fixate the limb while the bone grew, subjecting patients to a high risk of infection, significant scarring, pain, and the need to remain off their feet for months at a time. The GenerOs EX is a real advancement in distraction osteogenesis. Because the GenerOs EX uses a completely internal fixation system to support the growing bone, patients can continue walking while healing, with less risk for infection or other complications. That means a smoother, more comfortable recovery for patients."
The GenerOs EX can be used to help correct congenital limb deformities, repair bone deficiencies caused by injury, and even lengthen bones in order to increase a patient's height for cosmetic reasons. "Differences in leg length are fairly common, with one in every thousand people suffering from congenital deficiencies that are too significant to correct by wearing internal shoe lifts," Dr. Robinson says. "Limb length inequalities can also develop as a result of injury, bone disease, or infection. Whatever the cause, these imbalances can affect gait and lead to future problems with back, hip and joint pain."
In addition to inventing the GenerOs EX limb lengthener for long bones, Dr. Robinson also holds patents on two other internal osteogenesis distraction devices. The GenerOs SB small bone generator promotes bone growth in the small bones of the hands, wrists, feet, ankles and pediatric forearms, while the GenerOs CF craniofacial bone generator can help repair deficiencies and deformities in the skull, face and jaws. All three devices are manufactured by OrthoNetx, Inc., which is located in Torrance, CA.

The first quarter of 2009 represents the combined results of AcuNetx, Inc. and its subsidiaries, OrthoNetx Inc. and VisioNetx Inc.
Revenues during the first quarter of 2009 totaled $292,118, compared to $219,588 for the corresponding period in 2008. System unit shipments dropped to 21 units, including 19 Video-Nystagmography (VNG) systems and 2 Hawkeye Field sobriety

Total operating expenses decreased from $476,528 in the first quarter of 2008, to $271,749 in the first quarter of 2009. Lean cost management reduced our operating loss to a near-breakeven $54,163 for the current period, compared to an operating loss of $387,002 for the same period in the previous year.
The Company focused on two major issues during the first quarter of 2009, trimming expenses and increasing the productivity of sales representatives.
Initial success in both of these tasks has begun to result in significant increases in operating efficiency. The Company's financial resources were directed to bolster the marketing and sales activities of its revenue producing IntelliNetx division. To that end, the Company has both added an internal sales
force, and continued to add manufacturer's representatives as commission-based sellers. Other global opportunities are being evaluated for distribution, as are value-added products and services to supplement the IntelliNetx product line.
With regard to the subsidiary, VisioNetx, Inc., the Company is actively seeking a Chief Executive Officer capable of operating this complex business and an individual who has the ability to attract capital to finance what we believe to be a significant opportunity.
In relation to the wholly-owned subsidiary, OrthoNetx, Inc., the company continues its discussions with interested parties to secure either a distribution partner or other business relationship.
The Company is distributing VNG products under the IntelliNetx brand through a number of new channels, including its new in-house sales force commencing operations. These sales should result in an improvement to the bottom line as the company has negotiated a more favorable commission structure with these
channels. The company is working with all of its marketing channels to formulate a consistent message to highlight its product and company strengths.

RESULTS OF OPERATIONS
THREE MONTHS ENDED MARCH 31, 2008 COMPARED TO THREE MONTHS ENDED MARCH 31, 2007
The first quarters of 2008 and 2007 represent the combined results of AcuNetx, Inc. and its subsidiaries, OrthoNetx Inc. and VisioNetx Inc. One significant aspect in the Company's year-to-year comparison is a change in revenue recognition with regard to one of the company's key distributors. In the first quarter of 2007, the Company sold its products directly to end customers and paid the distributor sales commissions based on sales to these customers. Since July of 2007, the Company sells its products directly to this distributor at wholesale prices. This change results in lower revenues for the same unit volume of sales, along with lower gross profits, as costs do not change.
Correspondingly, a decrease in commission expense occurs as the distributor is no longer receiving commissions.
Revenues during the first quarter of 2008 were $219,588 compared to $1,123,946 for the corresponding period in 2007. System unit shipments decreased to 11 units in the first quarter from 32 units in the prior year as a result of two significant factors: (i) the overall uncertainty with the domestic economy, and
(ii) the lack of adequate funds to market the company's products. Gross profit, as a percentage of sales, decreased from 79.6% to 40.7%. Total operating expenses decreased by $702,318, from $1,178,846 in the first quarter of 2007 to $476,528 in the first quarter of 2008. Selling, general and administrative expenses decreased from $1,039,407, in the first quarter of 2007, to $328,998 in the first quarter of 2008. Net loss increased from $289,555($0.005 per share) in the first quarter of 2007 to $405,439 ($0.006 per share) in the first quarter of 2008. Management believes that the Company's efforts to raise marketing capital and the introduction of its Screener product should bring the company back on track as in previous quarters.
In regards to the Company's subsidiaries, VisioNetx, Inc. is in discussions with funding sources to secure the investment necessary to implement its business plan, and OrthoNetx inventory is being delivered to Robinson MedSurg, LLC per the distribution agreement between the companies.
The Company is distributing VNG products under the IntelliNetx brand through a number of new channels. These sales should result in an improvement to the bottom line as the company has negotiated a more favorable margin structure with these channels. The company is working with all of its marketing channels to formulate a consistent message to highlight its product and company strengths.
Eye Recording Device Detects DUI Suspects
Web Exclusive: What Are Your Rights During A Police Traffic Stop?
Reporting
Brandi Hitt
SACRAMENTO (CBS13) ― Ever wonder what officers are looking for during a sobriety test? Is it possible to tell if you're drunk just by looking at your eyes?
The answer is yes, and new technology has been created to record it all.
It's a test that's performed all the time on suspected drunk drivers: Follow an officer's finger only using their eyes.
"We look at eyes," said Ron Waldorf. "Abnormal eyes stick out."
In fact, the eyes of a drunk driver can now be recorded using a new device, called "HawkEye," created by California company AcunetX. Ron Waldorf is the CEO.
"They still do the finger test, because I can still see your eyes," said Ron. The device records what officers see as evidence for criminal proceedings.
Using infrared lights, HawkEye transfers the images to a laptop computer. There's even a wireless microphone attached. Authorities have said for years that alcohol impairment makes the eyes jerk.
"Some drugs affect how your eyes move, others affect how your pupils react," said Ron. "Some drugs do both."
Retired L.A.P.D. Sergeant Dick Studdard has used HawkEye in field trials, and let us try it for ourselves.
"Follow the tip of the pen," he told me. "Both eyes are moving together and they're following the source."
How did I do? "You passed," Studdard said. A breathalyzer test had the same results.
Next, photographer Peter Roney drove us to lunch, where I had a few cocktails. We went back to AcunetX for the second test.
The breathalyzer tests weren't surprising. It came back .14, well over the legal limit to drive.
The HawkEye test results also changed. "I'm seeing a little jerking of the eye," said Studdard.
What does that tell him? "There's some impairment there," he said.
You can see it on the video: On the top are my eyes without alcohol, and below are my eyes while I was impaired.
To an expert, there's a noticeable difference. "The eye signs will be the same whether the person has no tolerance or high tolerance to alcohol," said Studdard.
That's why the California Highway Patrol has been using this device for three years, training cadets at the CHP Academy in West Sacramento.
"It's an excellent tool," said Officer Herbert. "It allows us to show exactly what we're looking for and what we're trying to describe. They can see it themselves."
But the CHP only uses HawkEye for training, not as a tool for arrests. The CHP told us it's not being considered for field use at all.
"It does take a little bit of time for the courts are going to allow us to use brand new technology," said prosecutor Deana Hays. With piles of cases, she says technology-backed evidence definitely helps get convictions, but new technology faces hurdles.
"You also have a judge, who's the gatekeeper, and is probably going to be hesitant about allowing that technology in until they have court opinions that say it's appropriate," said Hays.
So far, no HawkEye-recorded evidence has ever been used for prosecution in court. All drunk drivers arrested in field trials have pleaded guilty.
"I have no reason to believe these 'pictures' are going to be that influential on anybody," said Sacramento defense attorney Jeffrey Kravitz. He says breathalyzers and blood tests already get convictions for drunk driving.
If the HawkEye were used in drug cases, he says a doctor would have to testify about what the images mean medically.
"The video only captures the eye movement of the defendant," Kravitz said. "It does not capture what the officer is doing. In order to properly do the field sobriety test, you have to make sure the officer was conducting the test properly."
But the idea of recording eyes is gaining steam. The cities of Orange, Laguna Hills and Bakersfield have purchased HawkEye for training, along with several other agencies across the nation.
A handful -- including Bakersfield -- have even started using it at checkpoints. AcunetX hopes that's just the beginning.
"Eventually, it'll be out of the squad car, self-contained, battery-powered, with flash memory," said Ron. "They'll use it and store it in a car."
The next time you're stopped at a DUI checkpoint, if you can recite the alphabet, walk a straight line, and touch your nose with ease, just know there's one thing officers look for that you can't control, whether it's recorded or not.
"The eyes have it," said Studdard.
HawkEye video could wind up in court soon. Authorities in Cleveland told me a prosecutor was at one of their recent DUI checkpoints where HawkEye was being used, waiting for someone to get busted so he could use the "eye tape" in court.
Nobody they stopped that night was drunk.
You can view videos of what eyes look like when suspects are under the use of various illicit drugs in the video player to the right at the top of the page. You can also view a local attorney explaining what your rights are at a traffic stop.

HGN and the Hawkeye
by Charles Rowland
on Fri 02 May 2008 11:15 AM EDT
AcuNetx Inc., (OTCBB: ANTX), a California company, has developed a device that follows the movements of the eye. The HawkEye System will be employed by law enforcement as an aid in the Horizontal Gaze Nystagmus (i.e. the eye test) Standardized Field Sobriety Testing. The company hopes to have the devise used by Drug Recognition Experts and DUI cops. As regular readers of this blog will recall, drivers who are impaired with Canabis alone will not exhibit HGN (nor VNG) but will likely show LACK of CONVERGENCE and DILATED pupil size. The company has not announced any research on their web site, but any consolidation of the HGN is welcome news. Obviously, the next generation of DUI cases will involve the use of marijuana. Ohio does not employ DRE trained experts for marijuana DUIs (yet?). For more on HawkEye visit the company web site at, http://www.acunetx.com/.

New Device "HawkEye" Checks Eyes to Detect DUI
AcunetX develops device to check for intoxication.
AcunetX, a California firm, has developed a device that will aid police in determining if a motorist is driving under the influence. The ‘HawkEye’ uses infrared light to test the movement of the eye during a field sobriety test. The results are transferred to a computer.
The technology adds documentation to the horizontal gaze nystagmus test, which requires a motorist suspected of drunk driving to follow an officer’s finger. The officer is looking for jerky motion in the eye which could be a sign of impairment.
Currently the California Highway Patrol has been using the HawkEye only as a training tool, not in the field. A few local police departments have begun trying the device at sobriety checkpoints. The HawkEye still faces the challenge of being accepted as a source of evidence in a DUI trial. The courts typically need time to consider the accuracy and dependability of any new technology.
DUI defense attorneys say the HawkEye only records eye movement, and it does not reflect whether the officer is conducting the test correctly. There also continue to be medical conditions that cause natural jerkiness in eye movement, meaning the new technology must be used in conjunction with another test for driving while intoxicated, such as a breathalyzer.
If you have been arrested for drunk driving you will need to hire a DUI attorney.

Hawkeye Field Sobriety Test
By Steve Spalding May 2nd, 2008
DUI
A California company, Acunetx, has developed a tool to help Police Officers track down DUIs.
It’s called Hawkeye and it is functionally an infrared recording device. The principal is that when you are under the influence, one of the tell tale signs is involuntary eye movement. This feature is independent of alcohol tolerance and so is widely used by police to help judge whether someone is intoxicated.
Hawkeye makes it easier for officers to see and more importantly record this behavior for use as evidence.
That’s the idea at least.
Hawkeye Was An Avenger
As it stands, the device is only being used in police station for training purposes and at a select few checkpoints. It has never been taken into courts. Like many new technologies, since there isn’t a strong precedence for its use — many judges would not admit Hawkeye’s recordings.
The major disadvantage of this technology and another reason why it’s still on the shelf is context. Hawkeye recordings do nothing to show how the sobriety tests were conducted. If the officer failed to give a correct examination, it could wildly skew the results — invalidating the data. Also, in some ways it’s technology for it’s own sake as Hawkeye is not a replacement for traditional blood and a breathalyser tests.
A few Counties in California are testing Hawkeye’s effectiveness in the field.
Unfortunately for them, they still haven’t had an opportunity to bring it to court because everyone they test it on keeps pleading guilty.

Eye or Nystagmus Test can be Taped under new technologoy California DUI criminal defense attorney news

Stopped for a California DUI? What are officers looking for during a California DUI sobriety test? Is it possible to tell if you're California DUI - drunk just by looking at your eyes?
The answer is maybe, and new California DUI technology has been created to record it all for California DUI officers.
It is a new version of an old test that is performed all the time - sometimes wrong - on suspected California DUI - drunk drivers: Follow an officer's finger only using their eyes.
California DUI cops look at eyes; California DUI cops suspect abnormal eyes stick out.
The eyes of a California DUI - drunk driver can now be recorded using a new device, called "HawkEye," created by California company AcunetX. Ron Waldorf is the CEO.
California DUI officers still do the finger test, because it can still see your eyes, hear California DUI lawyers. The device records what California DUI officers see as evidence for criminal proceedings.
Using infrared lights, HawkEye transfers the images to a laptop computer. There's even a wireless microphone attached. California DUI authorities have claimed for years that alcohol impairment makes the eyes jerk.
Some drugs may affect how your eyes move, others may affect how your pupils react; some drugs do both.
Nystagmus test: Follow the tip of the pen. Both eyes are moving together and they're following the source.
The best way would be test sober and then later when impaired. You could then see it on the video: On the top are eyes without alcohol, and below are eyes while impaired.
The California Highway Patrol has been using this California DUI device for three years, training cadets at the CHP Academy in West Sacramento. "It's an excellent training tool," say California DUI cops. "It allows us to show exactly what we're looking for and what we're trying to describe. They can see it themselves (during their California DUI training)."
But the CHP only uses HawkEye for training, not as a tool for California DUI arrests. The CHP says it's not being considered for California DUI field use at all.
It does take a little bit of time for the courts are going to allow us to use brand new technology, say California DUI attorney prosecutors. With piles of California DUI cases, she says technology-backed evidence definitely helps get California DUI convictions, but new technology faces hurdles.
You have a judge who is the Gatekeeper of evidence, and who is probably going to be hesitant about allowing that technology in until they have court opinions that say it's appropriate, California DUI lawyers maintain.
So far, no HawkEye-recorded evidence has ever been used for prosecution in California DUI court. All California DUI - drunk drivers arrested in field trials have pleaded guilty. California DUI breathalyzers and California DUI blood tests already get convictions for California DUI - drunk driving.
If the HawkEye were used in drug cases, a doctor would have to testify about what the images mean medically.
The video only captures the eye movement of the defendant. It does not capture what the officer is doing. In order to properly do the California DUI field sobriety test, you have to make sure the California DUI officer was conducting the California DUI test properly, California DUI attorneys suspect.
But the idea of recording eyes is gaining steam. The cities of Orange, Laguna Hills and Bakersfield have purchased HawkEye for California DUI training, along with several other agencies across the nation.
A handful -- including Bakersfield -- have even started using it at California DUI checkpoints.
AcunetX believes that is just the beginning: eventually, it will be out of the squad car, self-contained, battery-powered, with flash memory. They will use it and store it in a patrol car.
If you are stopped at a California DUI checkpoint, if you can recite the alphabet, walk a straight line, and touch your nose with ease, etc., just know there's one thing officers look for that you can't control, whether it's recorded or not: One's eyes.
HawkEye video could wind up in California DUI court soon. A official in Cleveland who was at one of their recent DUI checkpoints where HawkEye was being used, waited for someone to get busted so he could use this eye tape in court. California DUI attorneys are not clear whether such evidence is reliable, trustworthy, accurate and admissible.

Meet HawkEye, the sobriety-determining handheld
CrunchGear
by Matt Hickey
April 30th, 2008
Because police don’t have enough ways to ruin my weekend, a company called AcuNetx (I spelled that right) has developed a device called the HawkEye, a non-invasive device that scans the eyes of drivers to tell their intoxication levels.
It’s not meant for field stops so much as checkpoints, which are illegal in many states, and requires a laptop and hand-held device to operate. It detects movements of the pupils as they react to certain stimuli to determine sobriety levels.
The HawkEye itself can’t exactly determine the BOC, something needed as evidence, but will give probable cause for a full field test.
You teetotalers have nothing to fear, but those of us with lives are keeping a wary on the fun-killing Big Brother. Personally, I find it offensive that they would attempt to interfere with my goal of endorsing life, liberty, and the pursuit of happy hour.

AcuNetx’s HawkEye to be Spotlighted on Evening News
TORRANCE, Calif.--(BUSINESS WIRE)--AcuNetx, Inc. (OTCBB:ANTX), announced today its HawkEye eye observation and recording system employed by law enforcement to establish probable cause for detaining motorists suspected of driving under the influence (DUI) will be the subject of a feature story on CBS 13 Television (Sacramento) to be aired tonight on the station’s 10PM newscast. It will post on their website immediately thereafter.
CBS 13 Anchor, Brandi Hitt, visited AcuNetx to interview the company’s President & CEO, Ron Waldorf, the co-inventor of HawkEye which recently received two U.S. Patents. Also, participating in the interview was Sgt. Richard Studdard (LAPD-retired). Sgt Studdard, a consultant to AcuNetx, is credited with being a pioneer of the Drug Recognition Expert (DRE) Program, which has proven to be an effective means of detecting, apprehending, and properly adjudicating impaired drivers.
Ms. Hitt is the subject of a real-life evaluation of HawkEye as part of the news feature. The comparison of her eye signs before and after a social lunch is a very compelling part of the story. Sacramento is home to the California Highway Patrol which, in conjunction with the International Association of Chiefs of Police, is using HawkEye to acquire videos for the national DRE Manual.

Alaska Drug Recognition Evaluator Says HawkEye is Beneficial
04/08
Alaska Drug Evaluation and Classification (DEC) Program
IACP approved the Alaska DRE program for inclusion in the DEC program in 2004. In 2008, the program has grown to a total of 29 DREs supported by 10 agencies. Last week troopers in Ankorage conducted a school for DRE officers. They used HawkEye to train officers in drug recognition.
In 2006, Alaska DREs performed 154 enforcement evaluations with the following results:
http://www.acunetx.com/hawkeye/news.php?extend.36
Alaska DRE's use HGN to test for Impaired Drivers
Horizontal Gaze Nystagmus (HGN) refers to an involuntary jerking occurring as the eyes gaze toward the side. In addition to being involuntary the person experiencing the nystagmus is unaware that the jerking is happening. Involuntary jerking of the eyes becomes readily noticeable when a person is impaired. As a person's blood alcohol concentration increases, the eyes will begin to jerk sooner as they move to the side. Especially when used in combination with the divided attention tests, it will help police officers correctly identify suspects who are impaired. In administering the HGN test, the officer has the suspect follow the motion of a small stimulus with the eyes only. The stimulus may be the tip of a pen or penlight, an eraser on a pencil or your finger tip, whichever contrasts with the background.

HawkEye Eye Sobriety Detector is a Frat Boy's Worst Nightmare
The tried and true driving field sobriety test may be getting a much deserved update with the HawkEye detection kit that utilizes the eyes to detect inebriation. It is capable of detecting more than just alcohol, including drugs -- light and heavy. Dick Studdard, a man with a very unfortunate name was the mastermind behind the HawkEye. It is a surprisingly simple concept despite the studdard-iness of Dick's idea. Regardless of its ability, I highly doubt it will be capable of penetrating the eyes of the grim reaper himself, Nick Nolte when he goes on a drunken driving spree.
The HawkEye works by magnifying and recording the eye behavior. This can correctly judge the pupil size. With standard field sobriety tests it is on the officer to make a judgement call on the pupil size, but the HawkEye is capable of doing it automatically and even recording the data for future use (YouTube or court evidence), if needed. Rainbow Babies & Childrens Hospital DUI Task Force
03/10/08
Recently, the DUI Task Force from Rainbow Babies & Children’s Hospital held a training class for law enforcement officers and supervisors.
They demonstrated HawkEye™ during the class to show how eye signs can reveal drunk and drugged impaired drivers in Cayuga County.
Chrystal Gullett is the contact person at Rainbow Babies & Children's Hospital,
Of the 34 fatalities on Ohio roadways during the holiday season last year (Dec. 23 to Jan. 2), more than half were killed in impaired driving crashes. Drunken drivers are over-represented in fatal crashes: while only 6 percent of motor vehicle crashes in Cuyahoga County during 2006 were alcohol-related, more than 1 in every 3 traffic crash deaths was alcohol-related.
The Cuyahoga County Law Enforcement Task Force is a multi-jurisdictional coalition of 45 law enforcement agencies throughout the county that work together collaboratively to make our roadways safer by combating impaired and aggressive driving. The Task Force is led by the Rainbow Babies & Children's Hospital Injury Prevention Center, which also serves as lead agency for the Greater Cleveland Safe Kids/Safe Communities Coalition.
The Ohio Department of Public Safety identified Cuyahoga County as one of Ohio’s top 10 problem areas for alcohol-related crashes. Representatives of Rainbow Babies & Children’s Hospital proposed a DUI Task Force for Cuyahoga County that would develop and test a model program consisting of frequent low-cost, low staffing-level checkpoints with coordinated special DUI patrols and an innovative publicity campaign.

AcuNetx Files for Patent Protection on Breakthrough Polygraph Technology
TORRANCE, Calif.--(BUSINESS WIRE)--AcuNetx, Inc. (OTCBB:ANTX) announced today that it has retained the international law firm of Patton Boggs (www.pattonboggs.com) to file for worldwide patent protection on a unique technology it has developed for polygraph applications - AcuNetx’s Physiological Detection of Deception (PDD) System.
With significant pilot data from an earlier study done under contract from the Department of Defense Polygraph Institute, now known as Defense Academy for Credibility Assessment (www.dodpi.army.mil), and with the AcuNetx PDD System having been recently selected for another university research project, the company will now pursue other avenues of research & development, as well as commercial ventures, for its PDD System.
The technology represents an entirely new approach to detecting truthfulness and relies on eye responses which are proving to be an objective measure of deception. AcuNetx believes that the techniques underlying the PDD system are novel and will eventually prevail as admissible evidence in courts of law.
“I have a special interest in the PDD system,” says Ron Waldorf, CEO and co-inventor with Barbara Mauch, the company’s Sr. V.P. of Technology. “The experience we have gained as a result of our research into eye responses, research that has led to the development of FDA approved computer-based systems for analyzing eye movements related to medical applications (www.intellinetx.com), evolving into products for identifying motorists driving ‘Under the Influence’ (www.acunetx.com/hawkeye) and impaired workers (www.visionetx.com), has permitted us to develop a powerful new tool for the law enforcement community and homeland security agencies. The PDD could revolutionize the way in which we detect deception. Frankly, I feel very positive that we can develop – scientifically and commercially – a product that can have a profound effect on the criminal justice system.”

Federally Funded Project Uses AcuNetx Impairment Systems to Evaluate Methods for Improving Boater Safety
9:30 AM EST February 25, 2008
TORRANCE, Calif.--(BUSINESS WIRE)--
AcuNetx, Inc. (OTCBB:ANTX) announced today that its HawkEye(TM) and IntelliPlate systems have been used by the highly regarded research center, The Southern California Research Institute (SCRI, www.scri.org), in a study intended to establish the basis for framing a national standard for testing boaters suspected of being 'Under the Influence.' SCRI is the entity that validated the Standardized Field Sobriety Test used on roadways all over the country. The project is funded by the United States Coast Guard.
"The idea is to be able to detect impaired boaters, and to deter drinking and boating and to prevent injuries and deaths," researcher Dary Fiorentini of SCRI said. "As it is right now, there is no nationwide field sobriety standard for 'on the water' impairment." But the California researchers said that needs to change.
"I saw a culture in which drinking is part of boating," Fiorentini said. The researchers hope their study convinces everyone, particularly boaters, that just because you're operating a boat doesn't mean you won't harm anyone. The researchers say operating a boat while drunk is even more dangerous than driving a car while drunk.
Currently, the Missouri State Water Patrol is the only water patrol agency in the country that breathalyses boaters while they're on the boat. See KOMU, Missouri TV's coverage of this project at http://acunetx.com/hawkeye.
"I am pleased that SCRI was able to utilize our HawkEye(TM) and IntelliPlate systems and we look forward to the opportunity of expanding the commercial potential of these products to meet applications where impairment determination is vital to human safety," said Ron Waldorf, CEO of AcuNetx.

Users Report Potentially Serious Cannabis-Related Problems
01/30/08
Center for Substance Abuse Research (CESAR) reports that nearly one in ten first-year college students at a mid-Atlantic university have a cannabis use disorder. Even in the absence of a disorder, users appear to be at risk for potentially serious cannabis-related problems. Students who had used cannabis five or more times in the past year reported problems related to their cannabis use, such as concentration problems (40.1%), regularly putting themselves in physical danger (24.3%), and driving after using marijuana (18.6%).
The HawkEye™ System can help keep these impaired drivers off the road. Drivers who are impaired with Canabis alone will not exhibit HGN (nor VNG) but will likely show LACK of CONVERGENCE and DILATED pupil size. They will also have high pulse and blood pressure. These signs cannot be suppressed by practising. Show video from HawkEye™ taken at the SFST to a DRE to assess whether a driver with these eye signs is impaired.

AcuNetx Beefs Up Balance Project; Signs Letter of Intent with Developer of BioMotion Technology
TORRANCE, Calif.--(BUSINESS WIRE)--AcuNetx, Inc. (OTCBB:ANTX) announced today that it has signed a Letter of Intent with Applied Technology Holdings (ATH, www.appliedtechnologyholdings.com) of Laguna Beach, California, to market ATH’s proprietary BioMotion Sensors to healthcare professionals who deal with or focus on balance- and fall-related issues. The sensors will be incorporated into a turn-key package and sold through IntelliNetx, an AcuNetx operating unit.
“ATH’s proprietary sensor technology is an ideal complement to the products we have assembled. It permits us to provide our customers with the very best balance program available…anywhere,” said Ron Waldorf, CEO of AcuNetx. “ATH’s sensors represent a simple, low-cost approach to evaluating a patient’s walking patterns. Equally important, they will give us a clear competitive advantage as the company’s ‘Balance Project’ evolves into a full-service, turn-key program.”
A staggering $19 billion a year is spent on imbalance. It is one of the most common complaints of patients and is the cause of 14,000 deaths of people over 65 years of age annually (Note: The number of people 65 years of age or older is projected to double in the next twenty years). According to government data, a reduction of hip fractures and/or hip replacements by a mere 5% would result in a savings of $1 billion a year to Medicare, Medicaid and private insurers.
The importance of this health issue has not been lost on Congress. Indeed, it is being addressed by the Safety of Seniors Act of 2007 (http://www.govtrack.us/congress/bill.xpd?bill=s110-845) sponsored by Sen. Enzi (WY) and Co-Sponsored by Senators Hatch (UT), Kennedy (MA), Kohl (WI) and Mikulski (MD). The bill recently passed the Senate on a unanimous vote, and is now in the House of Representative’s Committee on Energy and Commerce.
Commenting on the deal, Patrick Dunn, President of Applied Technology Holdings, Medical Technology Group remarked: “We are excited about the impact that ATH’s BioMotion technology will have on AcuNetx’s optimization of balance assessment and rehabilitation. By working together, we are helping to create treatment and therapy that will address a very critical need for this significant healthcare dilemma.”
