Damn, more bad news - in Australia what they call Innovation patent is the same as the USPTO provisional patent!

"NOTE: This Innovation Patent cannot be enforced unless and until it has been examined by the Commissioner of Patents and a Certificate of Examination has been issued. See sections 120(1A) and 129A of the Patents Act 1990, set out on the reverse of this document."

The Australian "patent" doesn't have a patent examiner assigned to the psoriasis cream.

The answer is yes - Venture Capitalist provide funding to public companies. SMH!

My guess is that you have never been involved in Mezzanine financing with a VC - I have on several occasions.

Equity financing - such as a Equity Purchase Agreement or Stock Purchase Agreement can certainly include venture capital.
