Samsung, LG, Interwoven Conclude Litigation over Vertical’s Patent Infringement Claims

Case Summary:
Vertical Computer Systems, a provider of Internet technologies filed a complaint against Interwoven over two of their patents covering systems and processes for generating websites. Samsung Electronics and LG Electronics were the other named defendants in the suit. The complaint alleged that defendants infringe two of Vertical's patents by manufacturing Interwoven TeamSite 2006 software, LG Ally smartphones and Samsung Galaxy products.
Both patents-in-suit: US6826744 and US7716629 are entitled "system and method for generating websites inan arbitrary object framework” and was legally issued by USPTO on Nov 30, 2004 and May 11, 2010, respectively. The patents are scheduled to expire by Oct 01, 2019. Vertical is the current assignee[ii] of the patents (source: MaxVal’s Assignment Database).
Cording to the complaint, Interwoven, LG and Samsung are liable to Vertical in an amount that adequately compensates the act of infringement, which by law cannot be less than a reasonable royalty and added that Vertical will be ”irreparably harmed” without the issuance of an injunction.
Interwoven was dismissed from the suit in Oct 2011 as result of Court granting the motion to transfer the case to District of California. LG and Vertical filed notice of stipulation where LG was dismissed with prejudice. The litigation was proceeding against Samsung until recently when both the parties moved for stipulation and court ordered all claims and counterclaims be dismissed with prejudice.
