$RIGH –Full Use of Trade Mark “Budgenius” ~ Loose Restriction on issued symbol "®"

The facts: RIGH was issued a trademark for Budgenuis, but did not renew in 2013. According to the USTPO, BG Medical Technologies has full use of that TM indefinitely, but “loosely” restricted on the use of the “registered” mark:
