To answer what I can to the best of my knowledge:

Two years ago, Core Wafer Systems had some number of copies of their software installed in fabs, probably most in Asia. It is unknown how many manufacturers are still using CWS software. There may also be an unknown number of pirated copies out in the world (something which dlc has alluded to more than once on this board).

Two years ago, Core Wafer also had only one real competitor; today a search for WLR will find several new ones, including Metawafer which is connected to (perhaps fully owned by) Louis Deancona and Cascade Microtech which recently acquired Aetrium's reliability test product business. Louis Deancona was to receive about 55% of WAFr post merger, except the merger was closed much later under an amendment that gave Roger Goetz just over 50% (shares which have since been revoked with a much smaller number reissued). Deancona vanished without a word from WaFR. Deancona worked for Agilent; Roger is an accountant who has since had his CPA revoked by the state of Minnesota. I've always wondered what Deancona got when he gave up his majority shares, but I expect none of us will ever know. Check out http://metawafer.com/

I don't expect uplisting; they've talked about it for the past two years. Listen to the July 26 conference call - current management didn't even file what they said then they were going to file. Nope, Form D's all the way.

No idea about funding - Teresa dangled something or other in front of us at the courthouse in November about pending financing, but, two months later, nothing's happened that the public knows about. I do wonder who would invest in a company with one now admittedly dead subsidiary and one seriously hobbled subsidiary (see below) and as much debt as WaFR has accumulated.

3) How long before the company can reasonably expect a full resolution to their ongoing lawsuit?

Resolved. Final Judgment of the Court can be viewed here

but here's the gist of it:

3. The scope of this injunction expressly prohibits all use, including installing, running, marketing, distributing, transferring, selling, licensing, pledging, or otherwise encumbering, giving, or lending the Software Property, its derivatives, or any interests therein in whole or in part until the final judgment, including interest, is paid in full.
