BMAS would know yes, but I would have to have a return phone call or email to verify. Regardless, per our last discussion, I'm not giving out dates anymore-- I try to be transparent and it just serves as ammo for the worst of the worst shareholder contrivances.
As for the 180 days-- I'm confident the MM will not put us in danger here--It's why they mentioned it in the first place. The MM confirmed that they would HAVE to send the package out before the next week or two; otherwise file for an extension and he confirmed that he did not see any need to file an extension as the package will be out well before then.
Post Production is a lot of different things-- It's sound, scoring, color correction, editing, vfx, titles, etc. etc. -- it's everything that turns the raw footage into the final product, with all the bells and whistles. So no, VFX and Post Production are not the same thing as VFX is simply one aspect of post-production. http://en.wikipedia.org/wiki/Post-production

Mark,
Maybe it would have been better to not have an time estimation here instead of saying they hope to by and then again they hope to.
Not using scare tactics but when there is disappointment time after time, People begin to lose their faith in what is being said. If Had a MM/lawyer working on my behalf and they fell short one time on their estimate, I wouldn’t put out another estimate (no matter what they said) until the deal actually gotten done and in this case the deal getting done is the form 211 to FINRA.
Regards,
Tim

I am waiting on their response. Tim you continue to fail to recognize who's hands the Form 211 is in. As a CEO, I felt it necessary to identify a market maker to file this on our behalf-- I have done that, and maintain consistent communication with the market maker. However, it is the Market Maker, and only the Market Maker, that can file a Form 211 on our behalf. So please tell me, how am I hurting the MM/Lawyer's reputation?????? Would you prefer I withdraw the initiative of filing a Form 211 altogether since you are not happy with the timeline here? I understand you are frustrated as all of us involved would like to see this done yesterday as opposed to tomorrow, but for you to email me with scare tactics does not help anyone involved in this situation, let alone yourself.
Best,

Please tell me you finally sent out that 211 sent out to FINRA. One can only hope so. If not you are hurting your reputation and or the MM/Lawyers reputation.

Subject: Re: FYI
It has not been sent-- I was told this am that they are Trying to get it finalized by Thursday or Friday this week...absolutely.
That said-- I don't see anything 'wrong' with a brokerage firm working hard to get this done for us as shareholders. Nor the attorney that did what I estimate to be thousands of dollars in legal work for them to supplement and service questions/requirements. There is nothing I can do about this 'getting old' for anyone involved. This is something that simply 'IS', and I would like to assume you'd rather see this approved, albeit taking a long time, than anything else. I know that's how I feel.
As for this statement: Why were you telling me you were so positive that MIKP would be off of the grey sheets and back on the pinks and someone else that you were cautiously optimistic?
Why?
Because it's how I feel. I still do. and I still am. I realize this is frustrating Tim, but my sentiment here hasn't changed-- this is no small feat and I work diligently EVERY day to grow the company and see this through--- but I am not in control of 3rd parties such as our MM or their ATTY. So, if you want my REASONING, it's because I have a Market Maker in our corner working diligently to get this done right and an attorney with years of experience in the field assisting them, and BOTH are relaying confidence in the matter and NEITHER are receiving fees or compensation for this, aside from whatever BMA is paying the outside attorney to fulfill this Form 211.
WOULD BE NICE, WOULDN'T IT!! But we aren't there yet--- don't shoot the messenger- because in this case, that's me---we are ALL....WAITING...FOR BMA...and I do so gratefully at this point because where would we be without their diligence????

Mark,
Where are we on the 211 submission? Has this or hasn’t this been sent yet? If it hasn’t what is wrong with your MM and lawyers? IMO this IS now getting old. Almost 4 months working on the 211 submission to FINRA.
Why were you telling me you were so positive that MIKP would be off of the grey sheets and back on the pinks and someone else that you were cautiously optimistic? Or am I being too picky on words?
Would be nice to get out of regurgitation land.
Tim

Agreed-- and with much respect, it's why we should only RELY on them as far as the language allows--- that's the issue everyone has in 'interpreting' my feedback to their own liking. That said, I'm laser focused on the business right now-- have some great stuff happening right now for us and I look forward to updating. Thanks again!

Tim-- all I can do is tell you what they tell me-- and I like to be accurate in my regurgitations---- they said "Mark, we will look to get the materials out to FINRA by the end of this week" on Tuesday am. So I hope that's the case and I politely push them as much as I can. thanks!
