You have to spoon feed these commissioners and judges regarding licensing in the wireless sector. I will bet you that not one company exists in the sector that has predominantly licensed their patent portfolios on a piecemeal basis. The habit and custom has been to license the entire portfolio on a worldwide basis for the particular "g" or operational system. Although the French expert claimed that each patent claim must be licensed singularly, the ETSI representatives stated that this was not their intent. In fact, they stated that joining the standards group would not effect the commercial licensing customs in place at the time of formation. This is pure smoke and mirrors, but it will continue unless the company and their lawyers educate the decision makers. Since the standards are designed to operate worldwide, it is only logical that the license coverage be worldwide. Some early licenses exempted units sold in the home country of the manufacturer, but even those went away. The reason the entire portfolio is included is for convenience. It would be far too cumbersome to execute a separate license for each patent claim involved in a product.
