Now that ICM was sued by GS CleanTech at the time the agreement between Pacific Ethanol and ICM Corn Oil Separation was concluded, we must assume both the board and NK have been extremely aware of what a contract in such a situation "also" should contain.
We as shareholders must assume, that the management of Pacific Ethanol has navigated in relation to the pending patent case between ICM & GS CleanTech, and thus do not have to worry about the case.
ICM `s Advanced Oil Separation System™ is a patented solution, and as long as the ICM patent exists, the Pacific Ethanol probably have no problems ... problem itself must lie with the ICM, which has sold, delivered and installed a patented solution for Pacific Ethanol.
the judge Will have to tell GERS, that Barney and Fred Flintstone also did corn oil separation, and Betty used it front-end and back-end when needed, to stay beauty and usefull.
