The American Civil Liberties Union of Colorado filed a petition Thursday with the Colorado Supreme Court, asking that it overturn the state appeals court ruling that found that Douglas County schools' voucher program did not violate the state constitution.
In a lawsuit against the Douglas County School District, the ACLU said the program, called the Choice Scholarship Program, violates the state constitution because the program allocates money to religious schools.
Most of the 23 schools that were accepted into the Douglas County program were religious in nature.
"Taxpayers in Colorado should not be compelled to subsidize religious education," said Mark Silverstein, legal director for the local chapter of the ACLU, in a written statement.
The school district issued a statement, saying it is confident its program will ultimately prevail. "The ruling from the Colorado Court of Appeals was very clear in declaring the Choice Scholarship Program constitutional and rejecting all statutory claims made by the plaintiffs. The ruling was a huge victory for the students and parents of Douglas County, and we are confident that the Court will once again reject the arguments made by the ACLU."
