CONNECTICUT HIRES MAJOR LAW FIRM TO DEFEND AGAINST BLOGGER LAWSUIT; DUMPS ITS OWN ATTORNEY GENERAL!

January 26, 2013 – (TRN http://www.TurnerRadioNetwork.com ) – Officials from the state of Connecticut appear to be so concerned over a false-arrest lawsuit filed against them by New Jersey radio host and blogger Hal Turner, they have dumped their own Attorney General’s Office and hired a major law firm to defend against the suit. Turner filed the $50 Million lawsuit last November alleging false arrest, unlawful imprisonment, malicious prosecution and other civil rights violations after winning acquittal in 2011 on charges filed against him by Connecticut officials back in 2009. The charges stemmed from a blog posting made by Turner which called Connecticut "tyrannical" and promised to release the home addresses of certain officials in that state.


On Friday, January 25, 2013, a Partner from the mega law firm McCarter & English, LLP filed his appearance in the case and asked the US District Court in New Jersey for an extension of time to answer Turner’s lawsuit. This represents a significant change from the state’s prior decision to utilize its own Attorney General’s Office, which assigned Assistant Attorney General Philip Miller to the case.

Even more significant is the timing of this change: The new law firm was hired on the final day Connecticut had to answer Turner’s lawsuit! The state had been served with the suit in November, 2012, and returned Waivers of Service signed by the Assistant Attorney General, agreeing to file an answer not later than January 25, 2013. Yet on the 25th, the state changed attorneys and now seeks more time to respond. They seem to be having trouble figuring out a way to explain why they arrested Turner for "inciting injury to persons or property" over a blog posting made from Turner's home in New Jersey, when Turner did nothing within the geographic jurisdiction of Connecticut and, more importantly, absolutely nothing happened within Connecticut as a result of the blog post.

Turner's lawsuit charges that Connecticut could not lawfully apply its Incitement law to his home in New Jersey and that the words he used were protected free speech pursuant to numerous US Supreme Court rulings. As such, Connecticut not only lacked jurisdiction over his home in New Jersey, they lacked probable cause to arrest him because his words were protected free speech and absolutely nothing happened as a result of his blog.

Connecticut may also be having trouble explaining why they issued a fraudulent "fugitive from justice" arrest warrant for Turner, when they knew, as a matter of absolute fact, Turner was not in Connecticut, had not been in Connecticut, committed no act within Connecticut and had not fled justice! As a result of that fraudulent fugitive warrant, Turner was jailed without bail for five days before a New jersey Judge ruled that Turner was not a fugitive and set Bail for him.

McCarter & English, LLP is a massive law firm, boasting almost 400 attorneys on staff, with gross revenues of more than $216 Million (2010). The firm is over 160 years old and is listed by “The American Lawyer” as the 117th largest law firm in the entire United States. It seems officials in Connecticut realize they have genuine financial exposure for what they did to Turner, and are now pulling out all the stops by hiring a huge law firm to try to avoid being held accountable.
