jeffree: Yes, Federal courts can and do issue injunctions in patent infringement case. Under prior CAFC guidance an injunction was relatively easy to obtain if there was patent infringement.. However, in the Supreme Court's ruling in the EBay v.MercExchange case, they disagreed with the CAFC guidance, and issued new guidance that made it more difficult to obtain an injunction.

What affects IDCC is the current argument that injunctions/ITC exclusionary orders should not be issued in the case of infringement of standard bodies FRAND patents.
