GENERAL TERMS OF SERVICE (TOS) OR TERMS OF USE (TOU)

By posting any information, statement, text, or image . . . on or through the Investor's Hub website ("iHub" or "Site"), you agree that you will not upload, share, post, or otherwise distribute or facilitate distribution of any content - including text, communications, software, images, sounds, data, or other information that:

A. Is unlawful, threatening, abusive, harassing, defamatory, vulgar,* hateful, deceptive, intentionally fraudulent, invasive of another's privacy, contains explicit or graphic descriptions or accounts of sexual acts . . . or otherwise violates [iHub] rules or policies;

B. Attacks, verbally or otherwise, any individual, person, user, member, poster, moderator, assistant moderator, administrator, or the website (collectively, "Person");

C. Victimizes, harasses, degrades . . . any Person or group of Persons on the basis of religion, gender, sexual orientation, race, ethnicity, ancestry, age, or disability;

D. Infringes on any patent, trademark, trade secret, copyright, [etc.];

E. Misappropriates the name, likeness, image, sound, or other physical attribute of another Person or falsely impersonates any other Person . . . ;

F. Constitutes unauthorized or unsolicited commercial e-mail, junk e-mail, bulk e-mail, chain letters, and/or repeated posts containing essentially the same information (aka "spamming," e.g., "to da moon," "this stock is ready to run," "breakout coming," "Monster DD," etc.);

G. Contains any unauthorized advertising or promotion of any product or service, any form of unauthorized solicitation, or any form of lottery or gambling;

H. Contains software viruses or any other computer code, files, or [other such programs];

I. Deletes, obscures or alters any attributions, legal notices or proprietary designations or labels on any content that you upload or post to any portion of the Site....*

POST DELETIONS

While administrators, moderators, and assistant moderators are in "manage mode," they see a message that says, "Click any message below to view, then remove or restore it." Clicking on a specific post will then provide the option to "remove" the post for violating iHub posting TOS, TOU, or rules stated elsewhere (e.g., User's/Moderators' Handbook). Clicking the button to remove a post will then provide the following options as Site-justified reasons for removal by administrators, moderators, or assistant moderators: (1) Personal Attack, (2) Duplicate Post, (3) Spam, (4) Off Topic, (5) Vulgarity, (6) Author Asked to Remove, (7) Violation of Privacy, and (8) Threat.

Duplicate Post – an accidental duplicate post by a single Member; this does not mean a similar message posted previously or the same content posted by a different Member.

Personal Attack – when someone attacks, criticizes, or makes any negative statement to or regarding one or more Persons (i.e., as opposed to addressed substantive content of that Person's message); the post does not have to be addressed to the "target" of the attack to be considered a Personal Attack. If it attacks a messenger rather than the message, it qualifies for deletion and iHub Administration expects moderators and assistant moderators to remove any such posts.

Off-Topic - by far the most common abuse of positing privileges, these posts consist of anything that is not about the topic of the board (including discussions of other stocks, companies, or general stock topics (as applicable, e.g., User Groups) in any given stock board); posts about or focusing on other Members or groups of Persons and their reasons for posting on the board (i.e. "XYZDownDaDrain" is just a basher, ignore him", "XYZToDaMoon is a pumper", "the paid promoters are loud today", "c'mon, where did all the cheerleaders go?"); the post does not have to be addressed to a specific person – if the post is about other iHub members, moderators, assistant moderators, administrators, then the post should be removed; posts with religious or political statements should be removed as "off topic;" these inevitably create an avalanche of replies that are off topic as well; posts about moderators, assistant moderators, and/or post deletions are also "off topic" (issues of this nature need to be discussed with a Moderator or Site Administrator via PM); and putting "ot" at the beginning of a post does not make it acceptable – it is still off topic and eligible for removal.

Spam - posting the same or similar content on more than two boards within a calendar day; posting the same or almost identical post more than twice within a calendar day i.e. "where's the PR?", "anyone seen the PR?", "thought there was going to be a pr today?", "geez, is the pr coming out today or not?"; sending the same or similar unsolicited PM to multiple recipients; posting content that is off-topic to the subject of a board (e.g., anything not directly related to the stock or topic of the board); posting statements that do not add value to the discussion (e.g., simply "LOL," "I agree," "Excellent Post," "Yes," etc.); posting excessively on one or more message board(s) (e.g., a half dozen unanswered posts on a single board in one day). Spam further includes posts that overlap both spam and off-topic restrictions containing content promoting other sites, stock-related or not (for example, if your board is about Ford Motor Company, a post or link about a home improvement company is not relevant to the discussion). Finally, spam includes posting "noise" or "promo" messages (e.g., "to da moon," "huge run coming," "this stock is set to spring," "Monster DD," "this stock is a POS", etc.) over and over without other, accompanying, substantive, and relevant content.

Vulgarity* – profanity of any kind is unacceptable on the Site, even when punctuation characters are used to "fill in the blanks" or letters are changed (e.g., f**k, azzh*le, etc.); the "PG-13 Rule" is a loose guideline regarding what is/isn't acceptable (i.e., the theory is that if society has deemed it appropriate for a 13-year-old to hear, it is unlikely that it will be offensive to the majority of Site readers); any (e.g., PG or above) form of vulgarity directed at another User is unacceptable (e.g., writing "you're a sh*thead", "you act like an a**", "you're a d*** liar," etc., does NOT help your case").

Author Asked to Remove – when a Member has specifically asked that a post be removed and has cited a valid reason for removal, such as accidentally revealing personal information; this is an occasional accommodation and is not to be used to "mask" the removal of bona fide TOS violations; if you are asked as a Moderator to remove more than two messages as Author Request, please send the User to discuss with Administration.

Violation of Privacy – posting of what the member believes to be any personally identifiable information (email, real name, phone, address, etc.) about another Site user or posting the contents of a private message; for example, if a Member posts that "XYZDownDaDrain is actually Bob Smith" (whether the information is accurate matters not) the Member was trying to disclose personal information; posting or referring to the contents of private messages without the author's prior consent is considered a violation of privacy and engaging in this act may result in suspension or termination from the site.

Threat – a Site members threatening any other Site member in any fashion, including but not limited to threats of defamation, abuse, wrongful use of this site to "get back at the other Member," violence, or physical harm against Person.

*"Vulgar" means offensive language (e.g., language that exceeds what the motion picture industry allows in a PG or - at the envelope - a PG-13 movie). See, e.g., Investors Hub User and Moderator Handbook (2011) at "Deletion of Posts."

NOTE THAT THE VIOLATION OF ANY OF THE ABOVE WILL LIKELY RESULT IN POST DELETIONS, BOARD BANS, SITE SUSPENSIONS, AND/OR SITE TERMINATIONS. THEREFORE, THINK BEFORE YOU POST.
