The interesting thing in the mediation is that the BOARD OF WMI are now listed as defendants and must have their attorney appear at mediation. It may be that they and WMI might get different attornies. There may be conflicts in the respective defenses. The board members might push to get the thing settled as there are some dangerous allegations in the complaint against the individual board members on the breach of contract. A good mediator will require that a person with "authority to settle" for all parties to be at the mediation session, or be available by telephone at all times. This could take the decision out of Rosen's hands.
