What is misleading? You really need to clarify your post. Neither I nor the company to my knowledge ever said that "pending issuance" means "suspended indefinitely," if that is indeed your point.
The DEC link you provided us shows that a prior air permit application submitted by JBI has been suspended. There is nothing "misleading" in the DEC's characterization of the application either, if indeed THAT is your point. According to available public information, in particular the consent order, JBI is currently operating pursuant to the DEC consent order. As part of that order JBI was required to submit a NEW air permit application, as well as a solid waste permit application. I believe those applications will be processed together.
So what is misleading? And why?
