Hello Moderator Team –

I have been asked what our policy is regarding the listing of stores on the locator service, and in particular why more than half of the Walmart locations were originally entered, if the original distribution was to start with half. The answer is that we only enter store names when we have been provided with names and addresses by distributors who supply them, in the case of independent stores, or when we receive a formal store list from a larger retailer – and that our product appears on that retailer’s computer so that consumers can request that product be brought into locations that do not yet stock the product physically. In other words, this is done as a service to consumers when we have been given to understand that a consumer who asks for the product by special request may also receive it at the other locations.

We do not enter stores for which there is no reason to believe that the product is in stock, nor if a retailer has no intention to supply a consumer’s special request.

On the subject of the recent question that was answered in the forum, my memo responded to a point of broad interest that had been put forward by a board moderator on behalf of the community of readers, regarding a situation that has no more available facts than stated. Answering questions put forward by forum moderators does not constitute private correspondence because the posted responses are available free of charge to any interested party, and equally importantly, the Winning Brands website Investor FAQ specifically alerts current and prospective investors to the fact that issues of interest are discussed on such boards, mentioning iHub by name, and that answers to questions from the company may be found there.

The exact wording is this:

The company may from time to time provide responses to the moderators of discussion forums in order to preserve the flow of accurate information to interested parties in a public environment. The company cannot however be held responsible for comments purported to be made by the company unless such comments are verified by the company to be authentic. The following is a short list of discussion forums popular amongst persons interested in speculative securities.



Moderated investor forums provide a valuable service to the public by putting discussion of the company into a public arena, wherein the company may respond to questions publicly. In this way, answering questions to moderators is equivalent to providing a broadcast interview on a particular channel, regularly. The case can be made that not everyone receives or watches a particular program, just as can be said that not every investor reads iHub. To answer moderator questions on iHub is not different in principle than to do so on CNBC – it is only a different broadcast “channel”. The fact that Winning Brands specifically alerts interested parties to the existence of the forum is valuable disclosure for the purpose of due diligence. It is not legally possible, nor practical, to issue a News Release in response to every question asked of the company because of the consent that would be required in advance for every such News Release by every party referred to. It is therefore clearly in the interest of shareholders that the company preserve the flow of timely general commentary on topics that moderators find of interest to the public in the forums.

Whatever the (disingenuous) criticism levelled by anonymous forum posters at the company for being so responsive to queries in the forum environment (some of whom are self-described short sellers) there is far more appreciation expressed by shareholders who gain confidence that issues are discussed in a modern (ie electronic) venue that is easily accessed and informative. For this reason, ie the best interests of our shareholders in general, the company will continue with its policy of preferring to answer shareholder questions publicly through forum moderators, rather than on an individual basis, when circumstances do not call for a News Release.
