Very good and that is nearly the way I see it. The court may have already made the decision and all that would be required is making note of the objection finding it late or “frivolous” or having no substance. All that would just be added to the decision and it is over until the appeal. The appeal would be little more than an examination of case law that is in effect at the time of the decision.
