BullNBear52 -- oh no he wouldn't -- never has, in fact he's very proud of himself and all he's done and wants to do -- and like heck he has any integrity whatsoever in his opinions -- Scalia is the quintessential ideologically-driven 'unitary executive'/etc Federalist -- see in particular the Boumediene dissents, http://www.law.cornell.edu/supct/html/06-1195.ZD1.html (his) and http://www.law.cornell.edu/supct/html/06-1195.ZD.html (joined), as well as the other stuff I linked

and those 4 Federalists on the extreme (as in quite literally openly-declared traitors to the Constitution and the rule of law [again, the Boumediene dissents/etc]) right of the Court, Scalia, Roberts, Thomas and Alito, have in fact been and continue furiously 'legislating from the bench' their in fact fascist Federalist doctrine every chance they get -- whenever necessary or convenient in open defiance not only of mere precedent but of the very Constitution and rule of law
