The Supreme Court held off Friday on deciding whether to
grant a hearing in a long-shot lawsuit that would decide
whether Barack Obama can constitutionally become president
as a "natural born" U.S. citizen.

The Friday list of court orders that denies or grants hearings
did not mention the lawsuit, which says Mr. Obama should
be disqualified from the presidency because he purportedly
acquired the same British citizenship that his father
had when he was born.

A spokesman for the court said the decision on whether to
hear the suit brought by retired New Jersey lawyer Leo
Donofrio is likely to be announced next week.

A decision not to grant a writ of certiorari --
the legal term for the declaration that the justices
will hear the case -- would mean that a lower court
ruling that dismissed the lawsuit can stand.

The Supreme Court's justices met in a private conference
Friday morning to discuss the issue.
At least four of the court's nine justices must approve
before the case is heard.

Justice Clarence Thomas picked up the petition to hear
the lawsuit after it was denied by Justice David H. Souter.
Justice Thomas referred it to the full court, which decided
to distribute the case for the justices' conference.

Mr. Obama demonstrated his citizenship during his campaign
by circulating copies of his birth certificate, which
showed he was born in Hawaii on Aug. 4, 1961.
But unlike many of the lawsuits regarding Mr. Obama's
citizenship -- which claim he really was born on foreign
soil -- Mr. Donofrio's case concedes that Mr. Obama was
born in Hawaii but says he still held foreign citizenship
at birth.

"Since Barack Obama's father was a citizen of Kenya,
and therefore subject to the jurisdiction of the United
Kingdom at the time of Senator Obama's birth, then
Senator Obama was a British citizen 'at birth,' just like
the framers of the Constitution, and therefore, even if
he were to produce an original birth certificate proving
he were born on U.S. soil, he still wouldn't be eligible
to be president."

Kenya was British East Africa until it received its independence in 1963.

Legal scholars doubt the court will hear the case.
The Supreme Court rarely grants the kind of court orders --
or stays -- sought by Mr. Donofrio.
And doing so in this case would set up an unprecedented
challenge to the presidency of a man who already has won
the election and almost certainly will have taken office
by the time any hearings or decisions could occur.

About a half-dozen people who say the court should stop
Mr. Obama from becoming president protested in front of
the Supreme Court on Friday morning.

"He does not meet the criteria of the Constitution that
the Founding Fathers set out," said Roger Bredow, an
Internet publisher from Bethlehem, Ga., who has tried
to rally lawsuit supporters to block Mr. Obama's presidency.

Valerie Wohllheden, of Alexandria, said the danger is that
in deciding the lawsuit, the Supreme Court might bend to
"the will of the people" by allowing Mr. Obama to
become president despite constitutional provisions.

"Then you've got mob rule," she said.
"How can he uphold the Constitution if he's breaking it?"

After the list of actions was released, Washington resident
Theresa Cao said she took heart from the court's delaying
its decision on whether to grant a hearing.

"They apparently need the time to deliberate," she said.

Obama may or may not be a natural born citizen. His COLB is not sufficient proof of whether he was born in America. His original BC should be examined and verified. He could be simply registered here. The only way to know for sure would be to examine his parents passports and his passports. Also he may have retained citizenship with Kenya after his 21 birthday by continuing to travel on a Kenyan or Indonesian passport which would make him a dual-citizen today. I would like to know the truth. I think these aspects about Obama have been kept secret from the American people - and in my mind - invalidating the election. If the president of the US has foreign allegiances or maintains secrets about his life, HE CAN BE BLACKMAILED!!!!!! Yes he can be blackmailed if he is hiding any of these facts about his life. BY WHO? Well - if there are records in Kenya of his birth - then someone in Kenya could blackmail him. If there are records in the U.S then the FBI, the CIA or any of a number of agencies could access these records and blackmail him. We do not need a president - who can be blackmailed. The press did not do their Job. The election officials did not do their job (and verify where he was really born). Everyone reading this who has concerns should write to your congressman write to your Secretary of State for your state. Demand that they properly investigate this mans eligibility to hold office.

Young people thought, "Oh, he looks cool, sounds cool, must be cool.
People got caught up..Blacks were elated to see a man they considered 'black' running for President. The 'black' vote from last election was significantly shifted this election result 92% dem.
I seem to remember some blacks were republican? Anyway, then their were a group of 'whites' that thought, "OH let's give the 'black' guy a chance."?!

Was this a real election or did it show us we still have upside down racial issues that haven't been dealt with?

Obama's a smart guy. Obama taught on Constitutional law. He just doesn't agree completely with it so it wasn't a big deal in his mind if he met every letter of the qualification or not.

Remember Obama said, "The Constitution is fundamentally flawed."

Open your eyes and your ears dude !!! We could care less if the President is a Democrat or a Republican, Black or White or Red or Green...... again, turn the BRAIN ON !! We just want the President to be CONSTITUTIONALLY ELIGIBLE !! GEEZ!! Can you not get that? The only thing that keeps cops from busting a person's door down at night with no warrant or cause is the 4th Amendment. The only thing that keeps you from HAVING to testify against yourself is the 5th Amendment. The only thing that lets you talk your stuff on this site is the 1st Amendment. And, THANK GOD the Founding Father's made it CRYSTAL CLEAR that we could keep and bear arms for personal defense, militia, and to fight off tyrannical government by giving us the 2nd Amendment IN WRITING. I can understand how folks are sick of Bush... so am I. But, this is NOT about that! The government is stealing our rights routinely these days with Executive Orders and bad legislation.

The argument here is this: If we allow the government to get by without doing it's job in determining who this Obama REALLY IS, then we stand the horrible chance of a Usurper being sworn in to our highest office in this land. If he IS natural born, then I say he won fair and square and I'll support him. But, if he IS NOT natural born as the Founding Fathers dictated as mandatory (and I agree with that) then ANY order he issues, any legislation he signs, and any appointments he makes are all NULL and VOID and lawful people do not have to abide by them. Thus, if we let this critical issue go unaddressed and the Constitution is violated then we might as well be ready for more and more and more breaches of this wonderful document.

This is not about race, it is not about liberal vs conservative. This is about the INTEGRITY of THE CONSTITUTION. Wake up.

Are you willing to give up your rights? Those 1st 2nd 4th and 5th Amendments that I mentioned above? I didn't think so! So, get off our backs for wanting to know without a doubt that our President is eligible to serve. I ask for nothing more than the Constitution affords us, but I shall DEMAND the Constitution be Honored.

I think you need to go read the Constitution AGAIN. Someday you might just appreciate it a little more.

All of you brilliant Constitutional scholars keep forgetting that the next President is going to be a Democrat whether Obama is disqualified or not. Go back and read how the Constitution spells out the process of the Electoral College. There is not going to be a do-over election. Either the Electors or the House will decide and guess who is in the majority in both groups.

The Supreme Court got their fingers in deciding the election 8 years ago. Do we really want to start making a habit out of this?

One of the aspects of this country that is so vital is the "rule of law". I believe that all citizens should be considered equal before the law. This is a matter addressed in our constitution, which each President swears to uphold, and I believe that there is more than adequate doubt as to Obama’s ability to qualify as our president under the constitution. This is not rocket science, settle the issue, one way or the other, and let us go forward, but please don’t try to sweep it under the rug!

When the msm FINALLY reports on this very important story -- that, incidentally, has been ongoing for months, their version of it is so filled will slant and pro-Obama bias that you can hardly stand to read through it! They refer to only one lawsuit when there are several, and call that one a "long shot."

They say Obama "demonstrated his citizenship by circulating copies of this birth certificate." HE DID NO SUCH THING! This is out and out false! Hence, all the other state and federal cases. What about Alan Keyes? What about Berg and all the others?

The article points out Obama "was born in Hawaii," as if that were an established fact. IT IS NOT! THAT IS THE BASES OF MOST OF THE DISPUTES.

This tripe about him being a British citizen is a red herring. OBAMA WAS LIKELY BORN IN KENYA, as many other suits allege and strong evidence suggests. That's the only plausible reason he HASN'T "circulated copies" of his birth certificate.

And when it is established that he was NOT in fact born in Hawaii, then GAME OVER, or our country if finished. And it is NOT a long shot!

I think the Supreme Court most definitely should rule on this case. If his presidency-to-be is not constitutional, he should not become the president. Our Constitution is what has made this Country what it is...the "sliding away from the Constitution" as has been happening under our more recent presidents, is what brings the greatest harm to the Nation. Sadly, Obama undoubtedly knows the truth, and it would truly be upsetting to know that he played a part in a fraudulent attempt at the presidency.

No matter what the US Supreme Court rules it is clear that the denizens of this publication will continue questioning President-elect Obama's citizenship throughout his presidency, and beyond.

It is a shame that if one can't win on the issues, one resorts to these scurrilous backdoor tactics.

I recommend three things

1) read information other than the assumptions, rumors, and out right lies bandied about in this forum. Start with Snopes.com http://www.snopes.com/politics/obama/bir...

2) Find a sympathetic judge and get a court order to examine the birth certificate/certificate of live birth which are terms of art and essentially the same thing depending on the jurisdiction.

3) Find someone among those who agree with you to examine their own birth certificates/certificates of live birth from Hawaii from the same time -- hint how about the people whose births were announced at the same time as that of the President-elect in the Honolulu Advertiser issue dated August 13, 1961. Do they have the same kind of document? I expect that they do, but I'm open minded enough to be proven wrong. Are you?

I would like nothing more than to see this man disqualified. However, given the current distress in this country, I don't think the supreme court will hear this case. Although if they did, and he is disqualified, it would be poetic justice that Clearance Thomas took this case. In the Saddleback Church debate Obama told Rick Warren when asked which justice appointment he disagreed with, that Clearance Thomas lacked the intellect to be a Supreme Court Justice. If you remember Clearance Thomas' confirmation hearings, Joe Biden was leader of that senate committee. They treated Clearance Thomas with such disdain and the NAACP never gave him any support. Clearance Thomas like Barack Obama also made history. Only Clearance Thomas was guilty of being black and conservative (republican). I hope I am wrong here and that the court does decide to take this case.

If the only credential you need to become President is to post an altered birth certificate on a website and seal up all your records so no one can check, then anyone, including a member of AlQueda, could seize power & take over the country. There has to be a better certification process.

In this present situation, we should not put into power someone who has shown his untrustworthy character by deliberately refusing to disclose his records and hoping he can get away with it. If he thinks we don't have the right to know who he is, what other rights will he take away if he becomes President? If Congress does not hold a full and fair hearing and investigation into this grave matter, they should all be tried for treason for failing to defend our Constitution.

What happens if it turns out that Barack Obama is not a "natural born" citizen of the United States?
Does it really matter? He has won the popular vote;
he has, in effect, won the Electoral College vote;
and he has nominated an impressive array of high-powered people to lead the nation.

Should he be forced to relinquish the presidency simply because his mother reportedly was too pregnant to fly and was forced to deliver Obama in Kenya?
What difference does it really make?
Is he not the same person that he would have been had his mother actually made it back to Hawaii before he was born?

What would be the public reaction if the Supreme Court forced the state of Hawaii to release his birth certificate that revealed that he was actually born in Kenya and his birth "registered" in Hawaii?
Would the millions of people who voted for Obama respect the Constitution and demand that he step aside?
Or would they demand that the Constitution be ignored so Obama could take the oath to "… preserve, protect and defend the Constitution of the United States"?

This scenario – in the unlikely event that it should unfold – would reveal just how deep and wide is the chasm between the two Americas that occupy the 50 now-divided states of America.

Every elected official takes an oath to "… preserve, protect and defend the Constitution …" and then many of them proceed to ignore both the oath and the Constitution.
Hillary Clinton's reaction to Al Gore's failure to win the Electoral College was to declare that she would work to abandon the Constitutional system.
Congress has repeatedly rejected efforts to establish rules or law that require every new legislative proposal to cite the constitutional authority for the proposal.
Every time a new Congress convenes, the Constitution is pushed a little further back into irrelevance.

The system of governance created by the U.S. Constitution is unique in the world.
It was created expressly to recognize that the government
is limited by the Constitution and is empowered only
by the consent of the people.

This government created by the Constitution no longer exists.
