Riley - Warrant issued for man accused of failing to pay restitution

NEWARK -- An arrest warrant has been issued for a former Hebron businessman accused of failing to follow through on a restitution plan and engaging in more "probably fraudulent" activity, according to a motion filed with the Licking County Court of Common Pleas.

George M. Riley Sr., 44, last known address Tampa Springs, Fla., was given a 90-day window in June before sentencing to pay back the more than $355,000 he pleaded guilty to obtaining through deception.

In March, Riley pleaded guilty to aggravated theft and defrauding creditors, both third-degree felonies; and two counts of defrauding creditors, one of grand theft, one of aggravated theft and one of criminal simulation, all fourth-degree felonies.

Before he was due for sentencing June 4, Samuel Shamansky, Riley's attorney, and Licking County Prosecutor Ken Oswalt reached an agreement on a continuance to allow the defendant to make reparations before any punishment was levied. Shamansky noted at that hearing that Riley had already passed $70,000 into his care for that purpose.

In his motion, Oswalt wrote that the entire $70,000 is being garnished as part of a civil case whose complaint precedes the criminal indictment. Furthermore, he has failed to ensure the legitimate source of those funds through documentation requested in June, Oswalt wrote.

Oswalt said Monday afternoon the civil case involves a lender that Riley allegedly supplied bogus information to for $360,000. Charges related to those allegations were dropped by Oswalt due to federal authorities requesting to take up the case, which has yet to happen.

Attorneys for the lender in that case have asked for Riley to be held in contempt of court for violating an injunction that requires him to supply financial records and to not transfer funds to any entity other than the plaintiff, according to a memorandum filed earlier this month.

A hearing in the criminal case has been set for July 31 and Oswalt said he might be calling a Florida businesswoman to testify on her interaction with Riley.

According to June 30 e-mails from the woman and Oswalt, Riley has made dozen of claims to her that are identical or similar to fraudulent assertions he has been accused of making in other cases.

In June, Oswalt said he was contacted by a New York woman regarding business dealings she characterized as deceptive. No charges were filed in that case.

Oswalt said the Florida woman indicated she did contact her local authorities, but that her involvement with Riley might not have crossed into illegal territory.

Allegations have repeatedly surfaced outside of Ohio against Riley during the past two years.

He was arrested in January 2006 and taken to Colorado where he was charged, and convicted, of theft. He served no prison time but paid back more than $500,000.

In February, Riley pleaded guilty to felony unauthorized use in Franklin County and was placed on probation.

A warrant was issued in October in connection with bank fraud in Louisiana, but no charges have been filed in that case.

In the local case, Riley owes almost $100,000 to a local car dealership, $142,000 to a mortgage lender, $11,789 to an equipment dealer, $49,590 to a bank and $51,850 to a second bank.

Originally, Riley was charged with 14 felony counts, including a first-degree felony pattern of corrupt activity charge that carries a 10-year mandatory sentence, that included almost $1 million allegedly garnered by deception.
