Judge declines to throw out patent suit against Apple

Apple Inc., which has sold more than 119 million iPod music players, lost a bid Thursday to have Burst.com Inc.'s patent-infringement lawsuit thrown out.

U.S. District Judge Marilyn Patel in San Francisco upheld some elements of Burst.com's patents for receiving, storing and transmitting audio and video files. Cupertino, Calif.-based Apple had sought a ruling invalidating parts of four patents.

Burst.com, a three-employee company that lost $533,000 last year, claims that inventions by its founder, Richard Lang, are at the heart of the iPod and that Apple owes it millions in royalties. Patel invalidated some elements of Lang's patents, saying they weren't new inventions. That may narrow issues against Apple if the case goes to trial.

Burst.com, based in Santa Rosa, Calif., provides software for broadcasting audio and video over the Internet.
