If SPS are equity, then they should never have been in conservatorship.



An utter logical fallacy. FnF's boards consented to conservatorship before the senior prefs even existed!

The seniors are equity (check the balance sheets in the 10-K and 10-Q forms), and FnF are in conservatorship because their regulatory capital levels are hugely negative.

The seniors are not, and never were, a loan or a liability.

Got legal theories no plaintiff has tried? File your own lawsuit or shut up.
