He has shifted Ms. DL's 22% DL to himself and it has a zero impact on the common shareholders.
The included waterfall shows a "sample" distribution of 50M settlement. In this 50M distribution, even the three inventors of the patents will not be getting anything. I believe their target is significantly larger than the 50M.
IMO, if the final settlement is 100M then the three inventors, DL (44M shares), Carter (900+ shares), Rob Howe & insiders (? shares), and common shareholders will get their share per the included waterfall. Carter's 900M shares will translate to 6+ million and he is not going to leave this money on the table.
If the settlement is further north of 100M then Carter's, DL's, and our shares will translate to a much larger number. So, whenever Carter's 900M and DL's 44M translate into $$$, we all will get our $$$. If not, then there will be many lawyers willing to bat for the common shareholders at that point.
