That isn't true about the innovation patent in Australia (that is still pretty funny - Australia) protecting your IP for 8 years.

"An innovation patent is usually granted within a month of filing the complete application. This is because there is no examination before it is granted."

Anyone can challenge the innovation patent if the believe it would be a patent infringement on their patent - then OWCP would have to file a Standard patent application and it pass a patent examination.

"An innovation patent lasts up to eight years and is designed to protect inventions that do not meet the inventive threshold required for standard patents. It is a relatively quick and inexpensive way to obtain protection for your new device, substance, method or process."

If you remember - all of the OWCP patent applications were rejected because they failed the Inventive Step.

Also, you need to remember that OWCP filed a request to change the standard patent application to a innovation patent application because OWCP knows a Standard patent application would be rejected.
