Very poorly captured video on cell phone, but early on there's a remark something like this, "And thanks to AT&T, &^%&^something*** requesting spectrum transfer *&^&%$ something *&^%$ during Time Warner merger." And the room full of lawyers continue to laugh along.
Suggests the merger may be what is holding things up on the spectrum front, not to mention Verizon.
Enjoy the comments below the story too.
We can also read legal documents related to the Fibertower bankruptcy and the FCC lawsuit at the following link by entering Fibertower in the search box and agree to the terms.
"AMENDED SCHEDULING ORDER Based on the United States’ May 6, 2016 Motion for Entry of Amended Scheduling Order and any response thereto, the Court enters this Amended Scheduling Order. The new dates governing discovery and trial of this matter are as follows:
1. The deadline for filing a response to the Complaint is December 18, 2017."
(the document continues... through item 10) So that seems to set a mark to which the FCC must make a reply to the court on the spectrum or not if they are going to fight?
Item 10 reads: "10. Docket Call is rescheduled for the month of July 2019."
The court allows some settlement between Fibertower and the FCC, but exempts item one as being not one of the things they can agree to delay in the process. My note.
Here's what the court actually states:
This Order is without prejudice to the parties' requesting further extensions of time with respect to the matters addressed herein. The dates set forth in paragraphs 2, 3 through 6 and 8 may be extended by agreement of the parties without the need for a motion or Court order. Any other extensions of time shall require a further Order of the Court. ###END OF ORDER
