Reader3, respectfully, you need to understand how debt works. Not all debt is the same. Some is very collectible. Other debt is not (might be disputed because of damaged goods or late delivery).
I strongly believe this average which the Judge referred to was between 49 cents and 50 cents. If it was below 49 cents then it would have read "an average of less than forty nine percent (49%)". If it was 33 cents like you contend, it would have read "an average of less than thirty four percent (34%)"
To get to an average of 49 cents. Some debt was paid at 66 cents on the dollar. Other debt as you showed in the PR was paid 33 cents on the dollar. That's why the Settlement Agreement used that specific language "average of less than fifty percent (50%)".
